Is Jolley Incident Racist?
here it is

When asked why Mr. Jolley returned to the high school the following week, Dr. Sharber explained that she had directed him to. "He did come to school on Monday (April 19) because I told him Friday that I wanted to meet with him first thing on Monday and would be delivering a letter to him," she said.

If she believed him to be a danger to students, then why did she have him return to school. That is criminally negligent and reckless endangerment. She'd be in more shit if something had happened.

Is this the way she makes risk assessment decisions.

Sounds like FCBOE may have hired the wrong person.

Be sure to listen to Jan Tavlin's news Monday morning. It could be his last day on the air.
Tavlin will be indicted by the grand jury Monday for broadcasting the name of a juvenile involved in an offense on school property. it is a federal crime, not his first. He ran the story on April 20 without permission from the principal. He had been ordered not to put on the air anything important or controversial without Mrs. Spaulding's premission. She gave the order in front of two school board members and Mr. Bishop and stated state law giving her this authority. Tavlin will be fired when he is arrested on the indictment, so it won't be necessary for Mrs. S. to ban him from the high school. But she may do it to show her authority and keep his from working elseware.
That leaves thet question of who gave Tavlin the information in the first place and told him the name of the Taylor girl. I'm not pointing fingers but if it was our retarded sheriff, articles of impeachmenty will be drawn first thing Monday morning.

The sheriff gave Tavlin information before without Mrs.Spaulding's permission and boy, did he get a piece of her mind.

I wonder if the Bill of Rights is trequired reading for school officials in Franklin County.

Apparently it doesn't apply here. But if the Buckley amendment can cost the school department its federal funds, how about violating Freedom of the Press?

I have nothing but respect for Mr. Jolley. He probably should have retired several years ago. He is a wonderful man and who knows what made him do this. The administration could have given him the option to retire with grace.

rebekkah -- poor Ms Spaulding may think she controls the press, but I thank God she does not. Nor does she control the Sheriff. Though she thinks she does.
And the Buckley Amendment in no way applies to this situation. Neither does the Freedom of the Press. It probably most closely borders on Federal FOIA or State Sunshine laws. But it's a tricky one.

FERPA (once known as the Buckly Amendment) applies only to FER (Family Educational Records) and it does not protect teachers under any circumstance, nor students in any non-educational circumstance. This is not an educational issue.
The lawyer already OKAYED the release of the juvenile, Shiri Taylor's, name. He was with her at the press meeting and is not allowing press contact without his oversight. Diana also doesn't tell him what he can or can't do.

because this one was mishandled from the beginning (like everything she does, almost) it is now out of her hands...

Absolutely no law was broken here except by Spalding yet again attempting to cover up by threatening people, and denying people (students and staff) their civil rights. Remember...I argued w/ Atkins on this issue earlier...and who was correct? Me.

You are missing the point. Mrs. Spaulding ordered a reporter in front of two school board members not to air anything important or controvsial about Her school without Her permission and the school board and the board members were silent as if she were a sergeant telling a boot camp recruit to get a shave. This was an illegal order that the school board is condoning. What next?

Wagner Creek that might be very well true, HOWEVER, this kid was in the wrong as well because she, nor the other kids involved, did what they were told to do...........so they, too, should have faced some repremand for their actions.

I know nothing about anyone telling anyone in the media NOT to report info from any school without principal's persmission ....except when the woman in question told me much those same words two yrs ago. I Should have been more bold and stepped up to the plate; called deputy on site telling I'd just been assaulted. There was a whole room full of witnesses who saw what happened...I messed up by not calling the law enforcement fellow standing in the hallway.
When is person in question supposed to have given this ORDER to a reporter? Recently? Where and when? What subject was supposed to be kept quiet?
Threads have been busy while I was out of town.
Calls coming in on my return trip and messages left at home were a hoot!!! Is it possible there is a 'parting of the waters' taking place? If so....its about time. But....who will suffer? THE CHILDREN.

I think Mr. Jolly and Jan Tavalin should duke it out, winner take all. Then have Tim Fuller v. Mrs. Spaulding as the undercard.

The principal of a school has the right to ban from her school anyone who ceates a distraction from the educational process or causes lies to be spread about her school. The warning she gave Tavlin and others was before school board members Michelle, Steve and Tom was in her first month as principal. Tavlin got gotten information from Sheriff Tim about an incident of violence or sexual activity involving juveniles at the school where the sheriff has not jurisdiction and the principal has complete authority. She gave the sheriff warning that if he persists, he would face abuse of office charges and Tavlin would be banned from her school. Mrs. Spaulding will make the announcement Monday that Tavalin will not be pernmitted on the grounds of Franklin County High School, nor will information be made available to him. See if Stewart can get him out of this.

Well one thing I think YOU ARE DEAD WRONG about is the sheriff not having any authority at the school when sexual activity/abuse, whatever the case maybe, is going on!

We're getting off topic here........

Winchester, Tn. is a small town. Everyone knows everyone. Nearly every person who has graduated from FCHS had Mr. Jolley as a teacher. He taught the parents & grandparents of many of the current students. He is well known in the community. He IS NOT a racist, nor is he abusive. That is why people are outraged. If you have drawn your conclusions based strictly on the "video" please do everyone a favor & keep your ignorant opinions to yourselves. According to the BOE, the student has NO record of being problematic (in the 4 or less yrs she has been there) AND Mr. Jolley has NO record either...the difference is he has been at that school at least TEN times as long as that student. He is a tremendous educator & the BOE should be as proud of him as his co-workers and current & former students are. In the name of justice the student should have been suspended pending the "investigation" as well.

The school board made the best choice available.
Dr. Sharber knew the law and she followed it.
She is still in the process of following the law.
This was a difficult but necessary decision on her part.
The rumors that have surrounded this incident have been terrible.
