This is not looking to good. I am really hoping that justice is served here. I am wondering if Mariah is going to start talking? David's lawyer is pretty much putting this on her. The evidence so far to me is not going in Mr Esparza's favor. This is not a good sign. I hope he does not walk. I hope Mariah grows a conscience and tells what happened. Now we will have to wait till Monday. Ugh...

I thought the cell phone records were already ruled inadmissible.

I like how everyone wants justice done, even if it may be at the expense of an innocent person. Who cares? Somebody's gotta pay! That's El Chuco for you.

Does anyone know waht they mean by "cell records"? Are they referring to the fact that his phone was picking up service from the towers near where Ms. Marmolejo's body was discarded? That would tear apart his alibi. But are they also going to be able to introduce the text messages between him and Mariah where he says "I did what Ihad to do"? If only the first one, then that is circumstancial. Yeah, he wasn't at the theater, but that alone doesn't make him a murderer.
I agree with Yikes, Mariah is the only one who can seal the deal or set him free. Ahhhh... the agony. There has to be something more concrete out there. Find it Mr. DA!

I think its the text that they are referring to, because the part of where they were located at that time was from what I understood Inadmisable. Heck I don't know anymore this is just getting crazy and its not looking good for the DA.. I think they both did this and they are going to get away with it.. Just don't know... Ugh we have to wait till Monday now. Ugh, Ugh, Ugh...

Ok this is what Dena Richardson form KFOXTV reported.

http://www.kfoxtv.com/station/23061148/detail...

This afternoon, the jury will see David Marmolejoís and Mariah Wilsonís cell phone records. His defense objected to allowing information on the records that indicates cell location. Judge Gonzalo Garcia stuck with his pre-trial ruling and overruled the object. So these records could provide some insight into where exactly David Marmolejo was at different points in time on July 25, 2009, the last day that Gloria Marmolejo was seen.

I agree with most of you here. I thought the cell phone records were inadmissable. Plus, eventhough lets say the tower picks up a signal by where the body was found, it is still circumstantial evidence. Doesn't mean he sent the message or made the call. Someone else could have been using the phone.

Keep an open mind. Let the facts convict him. Justice won't be cheated if he walks. We must protect our justice system at all cost.

As the general public we all enjoy the right to assume or even go as far as to say that David Marmolejo is guilty. But the District Attorneys office doesn't have that right. He must prove every element of the crime beyond a reasonable doubt. We must insist on that and accept no less.

Mariah knows what happen. Either she knows exactly (seeing) what happen or was actually part of it. Her TRUTH will determine this.

The cell records don't say much. If he was in the area doesn't prove that he actually killed her. The defense is going to say that so people think twice. The defense wants the prosecution to prove that someone actually saw him do it.

This is going to have a surprise ending just watch.

It's so sad that this is not a fair trial b/c the media has fed all of you a bunch of bs along with the lying tunnel vision police for over a year! So this jury has already been influenced! David has been their prime suspect even when they had no hard evidence n who knows if they even have any evidence now!! They didn't even want to look at anyone else! They haven't tested the shoe lace! Come on now do some police work! Most of the evidence is probably already gone b/c they been so focused on getting David for this and only asked the other "supposedly" suspects a few questions and let them go on their way when these other people have obvious motive! What was David's motive suppose to be? Everyone knew he was doin the little slut! Pussy don't have a face...David is a womenizer! He knew that and it is what it is! So what plenty of these guys out here are! Doesn't mean he would do this to his own mother! He is very protective over his family and he always had his family's back whenever in need. You all have already convicted him with no hard evidence! He could very well be innocent, just b/c he has a background and tatts doesn't mean anything! And that girl is a dummy whoever said she isn't stupid! Oh she is! She is just much as a suspect as he is so why isn't she locked up right along with him?! Doesn't make sense! She changed her story so many times...I don't think she knows which one she's gonna tell when it's her turn to talk! What if he is innocent and gets convicted off of lies and assumption! THEN WE WILL NEVER KNOW WHO REALLY DID THIS!†

Wilson was smarr in hiring attorney Ray Velarde. Velarde is very sharp and is probably the one asking for the delay. Over the weekend Velarde will probably go through drills with Wilson on what to say when she takes the witness stand.

I wonder where Wilson, a Hooter's waitress got the money to hire Velarde. Velarde is high dollar.

Yep! The SLAM DUNK Phone records that would have nailed him are the ones that got thrown out! The one they are introducing now are ALL Circimstancial! I hope Jamie is dragging on her testimony on purpose! Making her squirm to come forward & tell the truth! She may take the fifth & that would help DAVID because his attorney is blaming her! This is NOT LOOKING GOOD FOR THE STATE!:(

Are you for real? Or are you just playing the part? The phone records that would have NAILED his ass were not admitted! I suppose you really do think O.J. is not guilty of murder? Please tell me you are just joking right?:0

True.

EPKID & SOMETIMES IN EL PASO & others questioning the cell phone records...The one that would have NAILED HIS ASS were thrown out & not allowed! They were the TEXT records he was sending from the west side of town to WILSON's phone. SO it was TEXT that were not allowed where she asks, "Where are you? Why are you taking so long?" and his response was , " I DID WHAT I HAD TO DO" research the case from the beginning to see the texts.
If she does not take the deal & talk...he will get away with murder! What she has to remember is that they can always come back later and charge her with the murder! WHy do you think she has a HIGH PRICE LAWYER? Witnesses who did or know nothing do not go out and buy high priced lawyers! She better take the deal & tell the truth!!

If this is the mentality of El Chucoans, why have a trial in the first place? Just form an angry mob and deal with it yourselves, just like the old wild, wild west days.
