I am sorry, but it is not the fault of the railroad that the driver ignored flashing signals and drove onto the tracks when he could not clear ahead. It is the DRIVER'S responsibility to STOP, LOOK, and LISTEN before fouling the tracks. While I sympathetic to the losses of veterans, they should not get a penny from the railroad, but their suit should be directed towards the driver, the sponsors, and, perhaps, the city for imposing unreasonable safety restrictions on trainsm, which backfired on the unfortunate victims. The railroad is innocent here!
