I can't recall if use of deadly force is justified in protecting property or not, but something in my memory tells me that it is.
Sarkes Tarzian brings up a decent point in his post above... One of the "gray areas" that all the circumstantial evidence would be in play. If I, as a 6'3", 265lb guy were to approach someone (say 5'10" and 200lbs) in my car and they turned towards me and took a few steps... If they were unarmed and not overtly threatening me, I'd probably be up a crap creek if I used my weapon. However, if a 5'1 100lb woman approached the same guy and the guy took a few steps towards her...different scenario if SHE pulled the trigger. "disparity of force" is the usual jargon in describing a situation like that.
Even if someone is 100% justified in shooting in self defence, with no chance in the world of criminal or civil charges, it's still a very tough call. Personally, I don't think that I'd be inclined to do it over a car. My crappy Alero isn't worth a lifetime of associated pain and guilt that follows (As I've read).
In my apartment, though, and someone's likely to get 1-3 .40 155 grain Federal jacketed hollow points, traveling at 1000fps, in their chest. NOT my definition of a good day.
hey wait a minute a year opr so ago an off duty indiana patrolman shot a man thru his front door. later the news brought up a point that you can not only protect youselve but your property as well.

The idiot was trying to kick in the front door of a State Trooper, with his patrol car in the driveway. This was the dumbest slice of the american pie. The only reason they weren't screaming racism is because the Trooper was black.

I think everyone should take the Sheriff's advice seriously.

Campbell of all people advocates people arm and protect themselves... but this lowlife has proven he is armed, don't go confronting him. Not that I care about his life, I care about victims. Its not worth risking death over "stuff".

Take precautionary measures, if possible park your car in a garage. Don't leave your garage door opener in the car. Definitely don't leave any guns in the car (common sense here). Have plenty of lighting around your house (possibly on motion sensors). Trim shrubs around your windows so they don't provide concealment for bad guys. If you have an alarm, set it. If you don't, buy some cheap door and window buzzers. If you don't have one, install a peephole (AND USE IT).

If you hear something, call the cops and get your family barricaded into a room that you can guard. Preferably one with a nice long hallway or staircase (a tunnel) they have to walk through to get to you. An extra bonus would be to have something on your end to provide concealment or cover. If they try to make it through your tunnel, you have an easy shot. If they don't enter your "tunnel" let the cops deal with it. Plan all this ahead of time with your family. Don't be paranoid and lose sleep over it, just be prepared. No different than keeping fire extinguishers in your house and having a family plan for fires.

Go somewhere else and preach your liberal ways! Because all you will find on this message board are Right Wings supporting their right to bear arms; as it states in The Bill of Rights! If you don't the what our Bill of Rights states then move to Canada! There is no problem with owning a gun if you use it properly to defend yourself, hunt or go out with your friends to the local gun club to practice. I love falling asleep at night knowing I have the right to defend & protect myself with my gun readily at hand!

My gal has a giant old S&W .357 magnum that her dad gave to her. I have just about got her convinced to trade it in (or sell it) on a smaller "ladies" revolver. Ha... She kinda looks like the girl in "True Grit" when she "brandishes" it but she can still hit stuff with it.

Rooster Cogburn: Why, by God, girl, that's a Colt's Dragoon! You're no bigger than a corn nubbin, what're you doing with all this pistol?

Mattie Ross: It belonged to my father, he carried it bravely in the war, and I intend to kill Tom Chaney with it if the law fails to do so.

Rooster Cogburn: Well, this'll sure get the job done if you can find a fence post to rest it on while you take aim.

Lets all hope that we read in the paper soon about an armed homeowner blowing the top of this turd's head away with a blast from a 12 gauge with buckshot. The sooner that this crapbag is gunned down, the better off all of us will be.
