He should be serving his full 40 year sentence. Good behavior??? Please, give me a break, there were no girls in there for him to murder, so of course he behaved. 5 difference incidents while in jail that have a sexual nature?? I certainly would not want this man living next to my family. If he did, I think I would for the first time in my life own a gun!!!

But you cant have a legal system that changes its mind like this. The guy served his time, he is scheduled to be released and should be. Just because his crime was shocking doesn't give some prosecutor any right to decide to lengthen this mans sentence.
You're right it sounds terrible- HE MURDERED SOMEONE! You know...took their life! On top of that he's been accused of ****** assults WHILE IN PRISON...this man is not safe to be on our streets. All he has done is serve time-no good behavior, no internal changes, he JUST SERVED TIME! I'd be willing to pay double the taxes to keep this sick criminal behind bars because unfortunately in this state- that's the only option!

His sentence was 40 years, not 27. He did not serve all his time.

Per the law and the judge he did his time and they have to let him go. Maybe if those gov. people spent a little more time and true problems like this rather than raise taxes he might be getting out now. It's now their fault and not the guy that did his time.

Some of you seem lost. I'm not supporting his release. I'm supporting the way the system is setup. He was convicted of a crime, sentenced, and he served his sentence. This means he should be set free, unless he was a problem in prison.
Without following these rules, our rehabilitation/justice system doesn't work at all.If a prosecutor sees fit apparently they can add whatever term they want to your sentence. Thats not fair, ore just. If the prosecution wanted him in jail for life, they should have sought that in 1979.

drink bleach,

I understand where you are coming from, but he WAS a problem in prison. He had 5 offenses while he was in, never mind the fact if you read the link that prisondog supplied (thank you prisondog!) He actually has a pison escape charge on him!!!! He's suppose to serve a max of 40 on the murder charge, plus he has 5 for the prison escape charge. Why were these served together and not one after another?

Also, what's the point to giving the criminals time if the state can't even count??? Prisondog is correct. A max release dates of Oct 2, 2007 is NOT 40 years! Why isn't his max date the full 40 years?!?!? What's the point in even giving him a max date in the courts if the MDOC is not even going to follow that?

And the parole board who agree to release this animal needs to take care of him! I think he needs to spend a month at a time at their houses, rotating through the board. They are responsible for him and his actions. When he does this again (and he WILL do this again) they can serve along with him!

newaygo, are you willing to take him in and be responsible for him while putting your wife/sister/mother and the ENTIRE community in danger?

I agree, he comes by me, I will be owning a gun.

I am just wondering if Tague is running for reelection? Why did he wait until hours before the release to try to stop it? He has known of this man's sentence for years. I'm betting that the victims were notified of his impending release and had to complain about it for the prosecutor to get involved. This should have been straightened out years ago!

In the link that Prison Dog sent, did you see the offense for prison break? According to the site that occurred in 1985. I am sorry, but his sentence is 40 years; he should be serving all of it. He is a murderer. I dont care about his reasons!!! HE MURDERED an innocent woman. Why on earth should he be let our early??? I for one dont want him out so he can go and kill again!!!! At best, he might only molest someone's daughter, at worst he will kill again!!! Neither of these are acceptible!!! Think about your daughters, wifes, nieces. Do you really want this man out so he can do this to someone you love???

I think he should have to do the whole sentance and more. Murder is something you should get life for.

6,000 days GOOD TIME? What? You can murder someone and earn something called GOOD TIME? 16 years of it to boot. And the to serve time for escape simutanelously to your murder sentence. I don't know how someone gets to leave prison (much less continue to live) after killing someone.

Why did the story start out " In his 41 years of law enforcement, Otis Smith says the crime he'll never forget happened in August of 1979" and then not go on to explain? Can anyone at WZZM write a decent news story?
