Muskegon - A convicted killer with a history of sexual assaults is scheduled to be released from prison soon and the Muskegon County Prosecutor is looking into means to keep him behind bars.

The crime he did sounds terrible.
But you cant have a legal system that changes its mind like this. The guy served his time, he is scheduled to be released and should be. Just because his crime was shocking doesn't give some prosecutor any right to decide to lengthen this mans sentence.

no matter how much time was served the crime that was committed to the women that lost her life she will not see life again so why should he.

While I agree that the crime committed was heinous, and he should have received the death penalty, since our State doesn't have this enacted, the man has served what the judge sentenced, and should be released unless he has recently commited similar crimes while in prison. They should also be looking at why he claimed temporary insanity, and if those conditions still exist.

Sorry in my book 27 years is not near enough time for taking someones life, mental or not, what if he went mental again and killed your wife or girlfriend. Would you be saying he did his time then?

I am 100% for the death penalty, but under our laws why didn't he receive life without parole? Are they cutting him loose early due to over crowding? Has he committed other crimes with in the system that he should have tacked on to his time? You do not see prosecutors fighting every time someone is released so what is the true story behind this? Was there more to his crime? This just leaves me with a lot of questions, but I do feel that over all the prosecutor is trying to protect us from this individual.

Try to put yourself in the shoes of the womens family that he murdered, would you want this monster out.

Tony Tague has some reason for wanting to keep him in and I hope he suceeds.

Here is an update from the Muskegon Chronicle.

"A Muskegon County judge on Monday issued a temporary restraining order that for now will keep convicted killer Wayne Lee Stevens behind bars.

Stevens, 54, was scheduled to be released from the Muskegon Correctional Facility today after "maxing out" his sentence, according to state Department of Corrections calculations.

The former Whitehall resident was convicted of the 1979 sexual mutilation slaying of 27-year-old Mary Ann Scharphorn of Muskegon Township.

Prosecutor Tony Tague, who twice was instrumental in preventing Stevens' release in the 1990s, said the inmate has a history of brutal sexual assaults of women and that his release would pose an ongoing threat to women.

Tague and his appellate attorney, Charles Justian, appeared before 14th Circuit Judge James M. Graves Jr. on Monday with a request for a temporary restraining order. Graves issued the order around 6 p.m, and the prison warden was served with the order at her residence.

The document "orders the Department of Corrections to keep Wayne Lee Stevens in custody until a court can review the legal issues surrounding his release," Tague said this morning.

A hearing has been set for 9 a.m. Monday before 14th Circuit Judge Timothy G. Hicks."

People that are supporting his release should think twice. He could do this to your mother, sister or daughter. The man is a danger to society and needs to stay behind bars.

I can't believe that a man that mudered a woman would only have to serve his minimum and not the full sentence. There is something wrong with the department of corrections if they let this man out. For this particular case, its a shame Michigan doesn't have the death penalty.

I don't get this system at all. My sons father is in prison for 25 years for lying during a trial but a person who actually did a killing gets out.
