I recently bought a few books from Kessinger and, fortunately they are fine, no missing pages or anything. I didn't find this tread until after I bought them. The back of the book says to download a free catalog on their website, but as mentioned earlier, the website is minimal and just has a search box. When I searched for the catalog, it came up on amazon for $500.00!!!

I just searched eBay for the 2 books my grandad wrote in the early 1900's. Sure enough a couple of the originals are posted, AS WELL AS KESSINGERS reprints of the 2nd book, dated 2007, 2008, 2010! How can this be? Who gave them permission? And they're more expensive than the older editions. This is all new to me as I know nothing about copyrights, royalties, reprints. They can just do this?? My sister and I are the remaining heirs. How do you find the history of a published book?? This is all very interesting! I'll be following your posts. THANKS.

It seems that Kessinger Publishing is simply scanning old books that are in the Public Domain, reformatting them, and selling them under their own copyright.

You people need to understand what is happening here. Any book published in the U.S. before 1923 is not covered by copyright and is therefore free to use by anyone for any purpose. A person can scan and republish the work, claim to be the author (or just the publisher) and can then sell the work as their own.

Works published between 1923 and 1964 might also be in the Public Domain if the copyright was not renewed at the appropriate time.

Before you spend a lot of time and effort trying to find Kessinger and take action, you would do well to understand exactly what Public Domain is. I suggest you get a copy of this book as it is considered the "bible" on the subject.

As unfair as this may sound, you really do need to inform yourselves before you waste a lot of effort.

I just purchased a Kessinger book from 1889, an Alphonse Bertillon instruction manual.(I have no idea if there are any copyright infringement issues). There is a library slip obstructing the text on page 13. I just wrote to the ebay seller but after reading all of these postings I don't expect to get any satisfactory responses!

As far as Kessinger using selling your relatives works, contacting Amazon may be the best route. I have a relative in the process of suing multiple infringers against artwork, and it is a long and tedious process.

I have bee looking for a book "A Practical Guide to the Climates and Weather of India Ceylon and Burma" written by Henry Blanford and published by Macmilan & Co. London. in 1889.
I have contacted Macmilan London to enquire about the copy Right, but they replied with having any copy right presently. I am unable to understand, without purchasing the copy right of the above mentioned book, how the Kessinger Publishing House has republished the same book which is gross violation of the copy right law. They need to be chased and brought to book.

This a gross violation of the copy right law, Further these people need to be sued as per infringement issues.

Kessinger Publishing does need to be held accountable for poor workmanship. I am no Lawyer, but my research shows the if a book was copyrighted prior to 1927, it is now in the Public Domain and anyone can legally publish it and sell it.

I too am having the same issue. They are printing a book by my Grandfather and it even clearly states Copywright 1929 by JG Keeling. How are the reprinting this and not contacting the family. We have all purchased beautiful reprints of his book "The Art of Acrobatic Dancing" by John Gilbert Keeling through Amazon & Barnes & Noble. I have been trying for months to contact this publisher as we were never notified of a reprint which leads me to the same question as many of you, "who is collecting the copyright money?" Obviously none of us. Would like to hear more of what everyone else is thinking for next steps.

Thought I would share an update. After speaking to the Secretary of State's office, they referred me to the states Consumer Protection division. After speaking with them, they do not see any other complaints on this company that are under investigation. They did recommend me to file a complaint, which I plan to do right away. I would like to recommend that everyone on this email trail do the same so that it draws some significant attention to our issue. Their website is www.doj.mt.gov/consumer . Click on file a complaint and the follow the instructions.

Mr. Mitford--I could be wrong about this, but the reason why you often see numerous copyright dates (years) listed on the copyright page of a book, is that copyrights are not lifelong--they have to be renewed to remain in effect. If they're not, then it appears that about anyone can publish the work w/o paying for the "right" to do so.

You might want to check this out; I believe that a copyright is a patent on the work, but you have to keep it active, or someone else can publish the work.

One way of obtaing an out-of-print book is to check with WorldCat which library has it and ask them for a photocopy. They might send paper or they might scan and send a disk. Quality will be high, cost honest.

I'm in the same position. My grandfather's book is not out of copyright and they have published it and are selling on Amazon. Did you find them?
