John Caldwell chaged with Animal Cruelty To Horses

SALINA, Kansas -- A truck driver who was hauling horses from Colorado to Oklahoma has been charged with animal cruelty after two of the horses had to be euthanized when he stopped in Salina.
Salina City Prosecutor Jennifer Wyatt also charged 23-year-old John Caldwell of Wetumka, Okla., with failing to provide care. The charges are both misdemeanors.
As of Wednesday, a court date hadn't been assigned for Caldwell.
Prosecutors say Caldwell and his 18-year-old girlfriend, Chelsea Proctor, picked up 15 horses Oct. 31 in the Denver area.
Caldwell says three, or possibly four, of the horses went down in the trailer as he trucked them across Kansas. But he told The Salina Journal he was unaware of the horses' conditions until he stopped in Salina. A Salina veterinarian euthanized two of the horses.

dont know why you posted this about John. he is a good kid and would not intentionally hurt animals.The business he is in, hauling animals for other people you just never know what they ( the other people)are sending on your truck. So check the full story before you start to slander people.....

Grammsy, this story was ran in the Tulsa world newspaper as well as aired on Channel 9 out of OKC and Channel 6 out of Tulsa. In my opinion, if a person is going to haul animals, then once they are on his trailer then they are his responsibility. I'm not trying to say anything bad about Mr Caldwell, but those animals were his responsibility.

Here is the Salina City Municipal Code regarding mistreatment of animals. Appears to me like he was responsible for the animals once he took possession and custody of the horses he transported, therefore charges were filed. Sometimes you can get in trouble with the law for something you do, but also for something you fail to do. I believe he just had a court date just this week.

CHAPTER 7. ANIMALS
(17) Inhumane or cruel treatment or manner means any treatment to any animal which deprives the animal of
necessary sustenance, including sufficient and wholesome food, potable water and protection from weather,
or any treatment of any animal such as overloading, overworking tormenting, eating, mutilating or teasing, or
other abnormal treatment that causes suffering to such animal.
ARTICLE IV. RESPONSIBILITIES OF PERSONS OWNING ANIMALS
Sec. 7-45. Duty of all animal owners to be responsible owners.
It shall be the positive duty of every owner of any animal or anyone having an animal in possession or custody, to
exercise reasonable care and to take all necessary steps and precautions to protect other people, property and
animals from injury or damage which might result from their animal's behavior. In the event that the owner or
keeper of any animal is a juvenile, the parent or guardian of such juvenile shall be responsible to ensure
compliance with all provisions of this chapter.

Sec. 7-46. Animal care requirements and prohibition of animal cruelty.
(a) It shall be unlawful cruelty to animals for any person to own any animal and:
(1) Fail to provide such sufficient and wholesome food; potable water; shade and protection from the weather, which
shall include a structurally sound, weatherproof enclosure large enough to accommodate the animal, but not so large
that it would not retain body heat adequately; opportunity for exercise, veterinary care when needed to treat injury or
illness, unless the animal is instead humanely euthanized; or other care as is needed for the health or well-being of
such kind of animal; or
(2) Abandon or leave any animal in any place. For the purpose of this provision, "abandon" means for the owner or
keeper to leave any animal without demonstrated or apparent intent to recover or to resume custody; leave any
animal for more than twelve (12) hours without providing for adequate food, potable water, and shelter for the
duration of the absence; or turn or release any animal for the purpose of causing it to be impounded; or
(3) Leave any animal unattended in a vehicle when such vehicle does not have adequate ventilation and
temperature to prevent suffering, disability or death to such animal.
(b) Any animal impounded for being kept in violation of this section or section 7-71 may be humanely
euthanized by the supervisor if he deems it necessary to relieve suffering. The owner of any animal that
is not euthanized shall be entitled to regain custody of such animal only after such custody is authorized
by the court. All expenses accrued for the treatment or care of such animal shall be paid by the owner,
whether or not he seeks to regain custody of such animal.

Lets hope they euthanize this John Caldwell, what an idiot to not know a animal in his care is down. I agree, idiots in the world shouldn't have the privilage of living..

The law is clear so he will be prosecuted.
However, John was doing a favor for someone we all know. The horses were wild mustangs being brought to a farm where they could be cared for. Some were not in good health. The fact they didn't make it says a little about the straits they were in. It's not so clear cut now, is it?
