Comments from WaPo:

For the purposes of a libel case, then, Zimmerman should have little trouble proving that NBC News broadcast false and defamatory material about him. The stiff legal challenge for Zimmerman & Co. lies in another phase of the proceedings, and that is proving damages from NBC’s treatment.

Just why should that be so difficult? Because of media saturation. Think back to March: What news outlet — local, national, international — sat out the Trayvon Martin case? Cable news appeared to talk about nothing but. Newspapers had their reporters covering every step of the police investigation/quasi investigation, and their opinion writers opining on the case’s lessons for race and criminal justice in America. There was only one way to escape it all: a cabin.

BTW, the article also lists Beasley, rather than O'Mara as attorney on this one--dunno but what he might just be an ambulance chaser taking it on a contingency. And O'Mara has nothing to lose by co-signing. If Zimmerman wins, O'Mara gets paid. If Zimmerman doesn't win, Beasley is the one out the time and cash.

911 Call - Zimmerman: "This guy looks like he’s up to no good or he’s on drugs or something. It’s raining and he’s just walking around looking about."
__________

Actually that guy (Trayvon Martin) was walking home and talking on his cell phone to a girl friend, when he was wrongfully profiled by George Zimmerman to be a criminal up to no good.

Zimmerman may have been right on the money about drugs:

Purple Drank or Lean is a coctail that is created by mixing Robitussin or other over-the-counter cough medicines with, you guessed it, Skittles and Arizona Watermelon Juice, the flavor of tea Trayvon Martin was carrying that night.

Purple Drank also goes by other street names such as sizzurp, lean, syrup, sip sip, drank, barre, purple jelly and Texas tea. It has opiate like effects. Some of its side effects include confusion, agitation, and hallucinations among others.

911 Call - Dispatcher: "OK, this guy is he White, Black, or Hispanic?"

911 Call - Zimmerman: "He looks black."

911 Call - Dispatcher: "Did you see what he was wearing?"

911 Call - Zimmerman: "Yeah, a dark hoodie like a gray hoodie and either jeans or sweat pants and white tennis shoes. He’s here now and he’s just staring and looking at all of the houses."
__________

No problem with the above exchange, right? Right!

I see no problem. Apparently you have an issue with Zimmerman giving an accurate description. He was asked specific questions and he gave specific, pertinent answers.

911 Call - Zimmerman: "Now he’s staring at me."

911 Call - Dispatcher: "... He’s near the clubhouse now?"

911 Call - Zimmerman: "Yeah, now he’s coming toward me. He’s got his hand in his waist band. And he’s a black male. He has a button on his shirt."

911 Call - Dispatcher: "How old would you say he is?"

911 Call - Zimmerman: "Late teens."
__________

While talking to a girl friend on his cell phone, a male Black teenager enjoying a leisurely walk home from a convenience store where he purchased candy and a soft drink, has now been profiled by an armed private citizen, not a law enforcement officer, as a criminal who is most likely to be up to no good, on drugs and armed ("He's got his hand in his waist band.")

But does that armed private citizen say anything during the 911 Call to cause anyone to suspect him of being racists or to harbor ill-will against the alleged suspect whom he has profiled to be a criminal? The answer is YES!

You're evading the points I made. What, in the timelines you've posted, did Zimmerman do that is illegal? Or even ill-advised?

911 Call - Zimmerman: "Something’s wrong with him. Yep, he’s coming to check me out. He’s got something in his hands. I don’t know what his deal is."

911 Call - Dispatcher: "Let me know if he does anything, OK?"

911 Call - Zimmerman: "OK. Just get an officer over here."
__________

Can anyone fault Zimmerman for reporting a suspicious person to law enforcement? NO! In this case the suspicious person or alleged suspect certainly might also be armed because he has his hand in his waist band, and he has something in his hands.

But there is a problem, a really big problem with the armed private citizen Zimmerman that manifest itself as the 911 Call continues and Zimmerman eventually causes the death of the unarmed teen by a single gun shot through the teen's heart.

911 Call - Zimmerman: When you come to the clubhouse, you come straight in and you go left. Actually, you would go past the clubhouse.

911 Call - Dispatcher: "OK, so it’s on the left hand side of the clubhouse?"

911 Call - Zimmerman: "No, you go in straight through the entrance and then you make a left. You go straight in, don’t turn and make a left. Sh..! He's running."

....

911 Call - Dispatcher: "OK, which entrance is that he’s headed towards?

911 Call - Zimmerman: "The back entrance. F..king coon"
__________

Zimmerman is chasing after Martin as he informs the Dispatcher of the direction Martin his heading. The sound of wind buffeting can be heard at this point during the call and the Dispatcher is clued to ask if Zimmerman is following. This is also the point during the call where Zimmerman utter the words the sounds like "F..king Coons" although he subsequently claims that he said "Punks" not Coons.
__________

911 Call - Dispatcher: "Are you following him?"

911 Call - Zimmerman: "Yeah."

911 Call- Dispatcher: "We don’t need you to do that."
__________

Zimmerman was never heard to identify himself to Martin on the 911 Call but he chased after Martin having in his mind that Martin might be armed and was an arshole and a fiiking coon or an fiiking punk according to his claim.

Zimmerman who was knowing armed may or may not be a racist, but he induced fear and displayed poor judgment and malice when he recklessly pursued Martin and eventually caused the death of Martin. His actions warranted that he be charged with wrongful homicide and be required to defend his actions in a court of law.

911 Call - Dispatcher: "OK, do you just want to meet with them at the mailboxes then?"

911 Call - Zimmerman: "Yeah, that’s fine."

911 Call - Dispatcher: "Actually, could you have them call me and I’ll tell them where I’m at?"
__________

About seven seconds after Zimmerman says he will meet the officers at the mailboxes he changes his mind and says he wants them to call him so that he can tell them where he is. Is that because he was on the move and still actively pursuing or searching for Martin?

In this case, Zimmerman should indeed be held accountable for taking the life of another human being and be required to defend his actions in a court of law? He may or may not be found guilty as charged, but indeed it is justice that he has been charged.

Nice theory. At least until you consider that "skittles" is street slang for dextromethorphan, or DXM ( http://answers.yahoo.com/question/index... ). This is the part of the concoction that accounts for the high--not the Arizona Tea. Skittles candy and tea gets you nowhere. Sorta like claiming that someone with a Coke and a bag of ice was on their way home to make some cuba libres. Key ingredient is missing.

Add to that the fact that nothing along those lines showed up in a tox screen and we can pretty much rule out any active state of influence.

You may notice that when Zimmerman states that Trayvon looks like he's on drugs or something, the dispatcher probes for evidence, asking, what's he doing. Zimmerman then moves away from looking like he's on drugs to "he's checking me out."

I think it's time to move away from the question of whether or not George Zimmerman is, was or could be a racist. The key question here is whether or not he profiled Trayvon based on his being a young black male--and George had in his mind an image of neighborhood lawbreakers being young black males. Because he never really articulates anything of substance to around suspicion about Trayvon's behavior.

As far as the civil case against NBC, seems like Zimmerman has a clear shot as NBC 'doctored' and eliminated statements that lead the listener to believe Zimmerman was profiling and it that would most certainly taint his upcoming criminal case.

He needs no criminal representation on this and, most likely, NBC will make a out of court settlement.

As far as the events that night, and the criminal action that resulted in a death......I would not opine on that. The only sympathy I feel is for the Martin family.

Seems to me George lost his job before NBC ever had a story.
It will be interesting to see how this one come out. Despite the posturing on both sides, I suspect neither one is actually eager to go to court. George seems to need the money and big corps are typically loath to put bucks into prolonged court drama over fairly ambiguous stuff. Yes, their editing was irresponsible. However, the full unedited versions of the tapes were also readily available to the public--making it very difficult to gauge the impact of the NBC broadcast.
And the reality is that while the initial reference to race was prompted by the dispatcher's question, a bit further along, when the dispatcher probes for specific suspicious behavior, Zimmerman offers UNPROMPTED that Trayvon has his hand on his waistband and that he is a black male.
The first time he said he LOOKS black (implying he wasn't positive). The second time he was sure, because Martin had come closer to him, so he communicated that to the dispatcher.
