I hate employers who think they can dictate off-time activities of their employees just because they can. It is a total violation of your rights to have to submit to this kind of scrutiny. It is totally pointless. I.E. working in fast food or general retail. The jobs themselves have nothing to do with public safety and it wouldn't matter one iota what you did while not on the clock.
I can see certain jobs where an employee would need to keep clean such as ambulance, bus drivers, and pilots, but the average entry level job, no way.

You make the choice to work for the employer or not. It isn't a violation of your rights if you take the job with the knowledge that the employer doesn't want you using drugs. It's a condition of employment. Also, if your job involves safety for yourself and/or other employees, it's certainly justified. In addition, an employer expects a certain amount of efficiency, not just the presence of the employee's body, and drug use can cut into that.

If what you are saying is absolutely true, then employers would have to drug test every employee the moment they walked through the door. When it comes to entry level jobs and proficiency of your performance, that's what they have supervisors for who can grade how well you do your work on a daily basis. The way labor laws are written nowadays, any employer can fire you any time they chose to without needing any reason.
Also why is it you can come to work with a splitting headache from a hang over, not be able to do your job, but not be fired for it? For the simple reason alcohol isn't illegal. If you got intoxicated the night before, won't you be as just of much or more of a danger (or worthless)to your fellow employees compared to someone who smoked marijuana?
And how many employers that you know of who require you as an employee to be tested prior to employment, or randomly that will submit to the same scrutiny to prove they don't use illegal substances, just like they expect you to be clean just to keep it fair? I'm willing to bet that none of them do. Then one more thing on the back side of this, why not let everyone decide for themselves if they wish to live a free life outside the workplace to be tested only in the instance they were hurt on the job?
But yes I agree, certain jobs do have reasonable expectations of a higher safety standard and they should keep clean for that type of work, but for the average worker making minimum wage to be put under a test like this to me is very unreasonable. There is nothing to be gained by it other than making people worry, or encouraging people to learn how to beat the system.
One more thing too. Let's say McDonald's has a drug free employee policy and they put a placard on their door stating so to make you feel better about patronizing their business. They still have an open door for the general public which is not subject to that rule to which there is no guarantee how they will behave or misbehave.

wow, so i can go out and apply for any job and get hired that easily? i guess over in kansas there must be lots of jobs for everyone. here in missouri they have people who get laid off and even more are getting the pink slip pretty soon from what i hear.
i need a job so i can buy groceries and gas. i dont see all the rights your talking about.
btw are you an illegal immigrant taking up my chances to work?

taking a persons bodily fluids and testing it is the ultimate ivasion of privicy but, it really doesnt really matter what we think our freedom and all our rights as citizens have been an illusion for at least a hundred years or more. Old money and rich english lords have and always will run this country. It all comes down to hungry people will work. so give them what they want, warm yellow water in a cup, no big deal.

If you test positive for illegal drugs, that means you are personally responsible for the cruel murders and mutilation of thousands of foreigners including innocent women and children who paid the ultimate price so you could get high. More good would be accomplished if you were simply shot dead on the spot when you failed the test.

That doesn't make sense, as one can be a raging alcoholic in their offtime and what drug test is stopping them from coming in hungover or below par because they are craving a drink?

That does not matter. Would you have a problem with a landlord putting up a camera in every room to make sure you were living right and by his rules in his house? Maybe an employer doesn't want any promiscuous people working for them...should they be allowed to administer STD tests too?

well bottom line is drugs aint legal if youre not a dopehead you got no reason to complain take the test n stfu if a company is giving me a job the last thing im gonna complain about is a drug test cause i know mines clear and long as you aint a druggie whats the big deal if you dont like the test so dig in dumpsters and sale cans to pay youre rent see how that works for ya. Haha i dont like bosses in my business either but im not gunna pick a drug test to complain about so go start digging for cans or stay off the drugs

Just wondering , do you think its UNCONSTITUTIONAL for we the people to not know and not have the right to stop people who are collecting off welfare and spending their stamps on drinks and drugs ?????? I take it you don't think its right that the law has been passed for people to have to be drug tested in order to collect stamps or welfare of any kind ?? Any answers ?? I'm sorry I don't want any of my taxes being used on dopeheads .

What is so asinine about drug testing, is that someone can be a drunk or have a prescription and be abusing it, but that will go unchecked.Most white collar applicants never get drug tested. Basically, the drug tests are to dehumanize the working class and get out of worker's comp. LOL I worked as a pharmacy tech for years and was never drug tested. Had a FBI check, but no drug test. Worked at a gas station and was tested. Asinine.

To flip a freaking burger?!!! It is because it makes their damn insurance cheaper if everyone is tested. That's it. Bottom line. It's because they save more $ spending on the tests than they would have to spend to get themselves insured. The CORPORATION is unconcerned with respecting the rights of anyone and only interested in the almighty $.
