It is a big shame that so many small time car dealers are ruining craigslist by posting as owners. Recently craigslist starting charging dealers 5 dollars per ad to post and all it has done is to make many post as owners instead.

While shopping for a second car recently so many ads that I had called were dealers cars that were bought as auction and then put up as owners cars.

There is a big difference as I want to buy from the original owner with a full maintenance trail not some guy who bought the car at the central auto auction.

In NY state it is against the law for any dealer to try to sell a car as an owner however it happens everyday here on craigslist. Maybe this would make for an interesting story for a local tv news piece all of the scams with used cars in town.

When buying a car always look for inspection and registration stickers in the window. A title in the persons name that is selling the car not a 3rd party. And proof of maintenance records.

It is to bad that some not all car dealers in town try to swindle people as that is what gives the business a bad name as if I wanted to buy from a dealer I would go to one of the bigger stores in town.

Ohh, and I must point out theres a big difference between advertising a car as an owner then there is actually selling it as an owner.
I'm sure after you contact the person in the ad, they will tell you its a dealer.

And not for nothing, but the dealer is the owner anyways, so they can post it as "owner".

By NY law dealers simple cant sell as owners as different laws apply like the implied guarantee a dealer must provide a 30 day warranty and the car must come inspected and an individual owner does not have to do this.

What might be even more of a problem on Craigslist is the blatant jumping of car titles . This scenario is when someone buys a car and they have the seller sign off on the back of the title but the purchaser does not sign it rather they leave it blank.

Then they simply turn around and sell the car without putting it in their name first.

This is a big no no in NY state as they want to collect tax after every transaction and under this scenario they are missing out on a transaction.

Just ask the seller to prove that they are the owner and this problem goes away. It is common to see a car listed 1 day for say 1500 then the next day the same car is listed at 2300.

The funny thing is dealers quickly flag any ads that bring to light what they are doing on CL. People need to report them to the state DMV

I must point out also that with the links you've gave, I see more of a problem with alll of them having very low mileage.
I bet they have changed the mileage on the car, which is illegal.

I really think your stupider then nickbo.
First of all, If it's against the law for a dealer to sell a car as an owner as you say, you are not showing us any examples of a dealer selling a car as an owner, and the links you show do not show a completed sale. I don't believe its against the law for a dealer to put a car on craigslist as the owner, especially if they own the car. I'm sure they are listing it as an owner to get more people to look at it, but when the person goes to see it I;m sure it will be obvious that its a dealer. duh.
But one more thing, with the links you've given, some look like a little repair shop that only has a couple of cars for sale, does that make them a dealer? What is the definition of a dealer in NYS law? I don't believe a little car repair show selling less then a handful of cars is a dealer.
And you go on and on nickbo, about the DMV needs to know about this, why??? The DVM doesn't run Craigslist. Report it to Craigslist.
First of all in NY state any person who sells more than 5 cars per year must register as a dealer that is the law.

Craigslist has 2 separate sections of used cars for sale and if as you suggest dealers are advertising as owners for more exposure that must show the truth . Car buyers would much rather by a used car from what they perceive as the actual owner of the car and one might wonder why. Car buyers are smart enough to know that cars that are put up for sale through the auction are generally cars that owners want no part of anymore due to many problems.

Dealers are trying to pull the wool over car buyers by advertising them as there own individual cars.

Face it as now with it being mid Jan in our city simply there should not be 400 used cars for sale by owners each and every day. This section is overrun with small dealers posting their junk cars.

Well you seem to be talking about 2 separate things.

1- "advertising them as there own individual cars".
2- "selling them as there own individual cars."

Are both against the law??

Maybe they are advertising them as there own individual cars, but later seeling them as they are a dealer???

This problem seems to be centered around those small dealers in town that dont want to play by the CL rules. Clearly there is 2 separate sections and one is for dealers and they other as CLEARLY marked for sale by owner.

You will never find a car from hoselton, dorshal, doan or even huge posted as an owners car it is only the 2 bit guys with no advertising budget that are doing this.

And yes it is against the law to advertise a car from a dealer as an owner car just check on the DMV website . Some have gone so far as posting the DMV number on CL to report these guys who are doing it.

For myself I will just keep posting examples of ads that are in the wrong category as hopefully someone from a local tv station looking for a story might pick this up and make the public that shops on CL aware what is going on.

I would never buy a used car from one of those small dealers as all they sell is the crap that cant make it to the bigger dealers lots.

I don't believe that for a minute.

Plus buy posting a car for sale in the "by owner" section of criagslist isn't against the law, and it doesn't mean you really not a dealer.
