WARSAW -- A Wyoming County Court jury returned a not guilty verdict Wednesday in the assault trial of a Castile man.

The jury found Victor Salada, 33, formerly of Leicester Street, Perry not guilty of assault on a peace officer, a Class C felony and second-degree assault, a Class D felony.

The trial began Monday in front of Wyoming County Judge Mark H. Dadd and ended about 4:30 p.m. Wednesday. The jury deliberated about 61/2 hours.

The case was in connection with a fight that occurred March 19 in Wyoming County Jail, where Salada was incarcerated.

Salada and jail inmate, Randy C. Davis, 28, of Kings Mountain, North Carolina, were involved in the altercation. The pair fell on a jail guard who tried to intervene.

The officer suffered a compound leg fracture and has been unable to return to work.

Salada and Davis were each indicted on five charges, including one count each of first-degree assault. Assault first is a Class B felony; a conviction carries a prison term of up to 25 years.

The jury did not deliberate on the first-degree assault charge because it would have first had to find Salada guilty of one of the lesser felonies. Once the jury reached a not guilty decision on counts of second-degree assault and assault on a peace officer, the court automatically entered a default not guilty verdict on the most serious charge, according to the prosecutor, Assistant District Attorney Donald O'Geen.

O'Geen, in a statement he issued, said he was "extremely disappointed" in the trial's outcome, in part because the injured officer sustained a permanent injury to his leg.

"At some point during the trial the jury saw or interpreted something that we didn't; regardless, it is hard to argue with 12 people when they all agree on anything, so as always, we respect their decision," O'Geen stated.

Salada was represented by attorney Merlyn Bissell.

Davis accepted a plea bargain in his case this fall. He was convicted of second-degree assault and sentenced to three years in prison and five years of post-release supervision.

and the crooked da's couldn't make up a bogus count? you guys are good at that.

The person who said go for the people with coke and pot. Well coke yeah they should deffently go for them. But pot dealers honestly don't make that much and pot is harmless besides the whole point. They should go for the coke and herroin and pain killers. Yes pain killers are oh no! Worse then weed dumb ass. They ruin your liver and you can get highly addictied. Weed um actully can cure cells that give you cancer, and is only mentaly addictive not physically like cigarates, pills, coke, heroin(ect.) Yes some people I'm intending will throw back well our goverment says that weed is bad for your. Hum you say they're full of bullshit one time but they're truthful others? Our lovely goverment has been lieing about weed since the 30's 40's 50's and don't go oh well they didn't have proper reaserch. No they could but the lovely goverement wouldn't let them.
