It is common municipal practice that, if a residential or commercial property is destroyed by a fire, tornado, hurricane, etc., the owner(s) may build new at the same site under the same requirements that took place when the original structure was constructed. The same building foot print must be adhered to or lessened. Zoning and other restrictions (with the general exception of wastewater needs) adopted post the original facility are waived and the builing is grandfathered. Additionally, if the above were to be incorrect, the local Zoning Board of Appeals could grant a variance.
Why there is a need to spend $$$ for a legal opinion simply implies the Town is chicken to make a decision.

Simply because the VT. Moonbats have begun to infest New Hampster.
Spend town $ like it's water and we got nothing but time 'cause we don't work is their motto.
Keep nasty capitalistic businesses jumping through hoops and spending their time, effort and $$ for permits.
A fine family business that's been in business for years is treated like this.
But, don't worry, the guys you voted for will do the right thing, right??
Gee, I wonder, any relitives of select board members do building, excavating, plumbing, carpentry, roofing??? Got to make sure the friends and family are taken care of.
