Something went terribly wrong for sure. Dave Caspillo killed a man who was sitting at a stop light, on a sunny afternoon, minding his own business. He could have killed any one of us who have sat at that stop sign. He injured a number of people. He terrorized a school by driving by in a 25 mph zone at 75-80 mph or more. And now he's dividing a community, where a minority, incredibly, believe that a killer who has to live with himself has suffered enough!! We need justice, and it won't come until Caspillo is behind bars.
p.s. the relevance of the cost of the car is that throttles don't stick in $40K BMWs, except in the mind of the perp.
who said the throttle was stuck? did i miss something? justice also means innocent until proven guilty,thank God for a court of law because if you are ever in a situation you will get the same treatment...God Bless America

Greg, please DO NOT post the police report here. I think you would be doing more harm than good. Even though am one of the people who wants to know what happened this is not the way to go about it. There might be information in it that might not be allowed at trial and you would be hurting the case more than helping. Please reconsider.

I'm not going to post the police report. It is public record however. The report is very interesting, I don't see where any of the facts in it could help Dave Cospillo in any way. He is a true menace to all of us.

Yes I think the county recorders office is where you must go. I beleave there is a per page cost if you want to take a copy home. Let me warn you it's 82 pages long. I beleave you can read it there for free though. I would call them first and make sure if it were me.

What is the current judicial status of this case?

The CCC District Attorney charged DC with Felony Vehicular Manslaughter in August.

"Supposedly" there was an arraignment in October. Did this actually occur? Was a plea entered? Guilty. Not Guilty, No Lo...?

"Supposedly" there was a court appearence "To Set" in November for another court appearance. Did this actually occur? What was "set"? A pre trial hearing? A trial date? A sentencing? A postponement?

"Supposedly" there is another court appearence in February in Martinez. For what? Sentencing? Evidideniary hearing? Pre-trial motions? Jury selection?

Anyone with answers to these question should post their information.

Anyone who stops by the court clerk's office or is around the municipal buildings in Martinez might also check the status of the civil lawsuits filed against Caspillo. All those suits must be filed, by those injured, within one year of the damages caused by Castillo. I'll bet some have already been filed. If Caspillo's deposition was noticed he might be trying to take the Fifth to avoid testifying prior to his criminal trial. But curious minds would like to know what defense he's cooking up.
BTW, whether or not information in the police report is allowed at trial is irrelevant to whether it can be discussed in a public forum like this. If you have interesting excerpts from the police report, just quote them here. There is zero chance of tainting the jury pool, aiding a change in venue, or prejudicing the trial. The public has a right to know, and for some reason the Contra Costa Times and the authorities don't think the public should know what's going on.

This forum may not be dead but it is definitely on life support in regards to information as to the status of this case.

There has been two court appearances in WC that I know of, but no one has posted any information as to what transpired at either of those.

A recent post refers to a pre trial appearance/hearing on Feb 28th.

I presume this to mean that Mr. BMW has pleaded not guilty and that this case will go to jury trial.

This forum serves the purpose of disseminating information and opinions on the case because we are surely not going to get any information from the DA, defense attorneys or the CC Times.

If you know what is going on, let us know.

I heard that there is a court date on the 28th but there is also something happening on the 26th in court regarding this case. Has anyone heard anything about that date?

It seems Mr. C has waived his right to a prelemanary hearing. So there will be no evidence in court tomorrow. They should set a trial date as I understand it. This is set for 8:30 am in Walnut Creek.

In addition to David Caspillo waiving his right to a preliminary hearing this morning - where it would have been possible to have his charge reduced by the judge if the evidence were thin enough, which it is not - the prosecutor added wording to the complaint to make sure there is no escaping some charges of violating traffic codes - and according to his own defense attorney do not require conviction by the jury for Caspillo to be found guilty of. The arraignment will be on March 13, 2008 at 8:30 am in department 24. This is when he will enter a plea.
