I would think this is similar to what happened with Kaloko Resevoir on Kauai. He should hire one of the attys involved with that case. Someone at the state, county, or city level did not do their job and should be held accountable.

There you go, somebody in this blog gets its. The stream is privately owned so it is the owner's responsibility. But the City does have authority as emergency first responder to take steps to protect life and property.

I never heard of a 'private' stream. Rivers and streams are natural occurrences and will flow wherever gravity takes them. Whatever gets in their way will suffer consequences. The owner should've at least built barriers to redirect or prevent the water from eroding the dirt underneath the house such as flanks of plywoods and such. The weather service warned of rain for the coming week and yet nothing was done. Flood insurance should cover this disaster, isn't this why we pay for it?

City and State officials will protect themselves first. It will be your words against theirs. They will tell you things but if it's not in writing, they will deny saying it. So it's your words against theirs.

You idiot. There was a retaining wall there, before all this happened. This predicament was brought to the attention of the city, state and DLNR years ago, that the intergity of the wall had deminished. No one stepped foward to take responsibility.
Now you come into the picture telling how foolish these people were for building on earthen river bank. Give me a break.
enjoy the beauty of the stream.. with it comes risks.. one of those risks came to fruition... action => consequence... live with it..

Exactly! If I were going to build or buy a house or condo, it would NOT be next to a stream, especially on the wet windward side. It would also not be up next to the mountains or hills - too many cases of bolders crashing into houses in wet weather when the ground gets saturatead with water and the boulders come loose. And I would not live in or buy a structure right on the street on a busy street or intersection - there have been too many cases of drivers losing control of their cars (either drunk or they fall asleep a the wheel) and they crash into the structure.
My friend's sister's father in law was killed because a drunk driver lost control of his car and crashed into their house; he crashed into one of bedrooms, which was on the front of the house. The father in law was sleeping in the bed and the car landed on top of him, killing him.
Yeah, and you would not cross any street, even if in a crosswalk, because you still may get hit by a car. And you would not fly on an airplane because it may crash, and you will die. And you would not go inside of a bank because the bank may get robbed, there may be a shootout, and you may get shot and killed. And you will not eat at a restaurant because you may get botulism food poisoning and die. And you will not stand in the shade of a tree because a gust of strong wind may knock that tree down, crushing and killing you. And you will not eat fish because a fish bone may get lodged in your throat, after which and infection will develop, the bacteria will get into your blood, and you will die. And you will not use a kitchen knife because there is a chance that you could faint in your kitchen, accidently fall on the knife, thereby killing yourself. And you will not pump your own gas because there is a chance that static electricity may cause and explosion, killing you.

Stay in the house you worry wart old lady!

There was that stream bed between the Kaaaawa Fire Station and Crouching Lion that got a retaining wall rebuilt that was damaged from last Dec 2008 rains...who did it (State, City n' County or private?), how long did it take and how much did it cost the taxpayers?

People we need to have an uprising and start ousting elected official who do nothing, the same old baloney. Same old cronies who do nothing to help the little people. Fasi was the only politician who gave a damn, yes he was not perfect but at least he fought for the little guy. Now it is all about big business and who can put what money into pockets. Arrogance and a no care attitude from those in office and it is a trickle down affect and displayed.

These hard working families deserve help and I hope a good attorney steps forward to help them out against the state for not doing their job even after timeless warnings from these residents. Shameful, wait until it shows up at their front door. We need massive numbers to show up at the capital.

You're right about that and either the state or city came in with bulldozers and built that retaining wall...What about the flood in Keapuka in 1965 and 1969? Once again either the state or city came in and demolished the houses next to the stream that overflowed. Why is it that certain area and people receive help from the state or city without all the red tape and delay? Bureaucracy?

You people are funny, private stream huh, then can we pump the water free and not pay Board of Water lol Try building a massive private dam and then see how private the stream is or try redirecting the water flow to Linda Lingle or Mufi's house and see how private the stream is then lmboooooo
