The parents asked Fisher to stop contacting their child and thought he had, but secretly the two found a new way to communicate.

Um this sounds crazy a 25 year old is accused of doing nothing wrong but being friends with somebody young!

Maybe read the article? "Rowcliffe said when police went to Fisher's home, he turned over two cell phones. One phone, according Rowcliffe, had inappropriate photos taken of the Skype interactions Fisher had with the boy. Fisher is charged with promoting a sexual performance by a child and possessing a sexual performance by a child."

Also, they continued communicating in secret after the parents asked him to stop contacting their son. An unrelated child and adult with a large age gap can be friends, but no normal adult will go against the wishes of a minor's parents nor engage in surreptitious secret messaging.

When I was in my late teens/early 20s I would sometimes encounter fellow nerds at the bookstore where I pretty much lived, who had an interest in the same reading material. Sometimes I met young teens or preteens who were of above-average maturity and precocious like I was at that age. It was hard finding anyone of ANY age who had the same interests so yep I was willing to talk about it with (mature, intelligent) 13-year-olds. Sometimes we would exchange email addresses or add each other on Facebook. I would ALWAYS ask them if their parents knew we were talking, and if they said no, I said they should tell their parents and make sure it was okay with them. I also did not Skype/video chat with them ever.

If the young person was skyping him and he kept photos then it may be considered child porn but we should let him get a lawyer who can get the judge to determine what to do.

A judge or jury will in fact determine what to do unless the 25 year old takes a plea bargain which happens 99% of the time. No body wants to have the evidence of ugly things they may have done shown in court and fodder for the TV news and daily newspapers. He will also be given an attorney whether he can afford one or not. Unless you choose to break child pornography laws, you don't keep sexually charged images of a younger person or anyone if you use your head. No one HAS to engage in a Skyp session with any other person, it doesn't matter who made the connection. It also doesn't matter why the boy was naked or showing his genitals or engaging in sexual activity. An adult knows not to let that happen, much less encourage whatever happened to take place.
It won't be long before the courts will be packed with cases of people, without permission, distributing images of another person that are embarrassing, or sexual. Sometimes people act without thinking, in children the more acute reasoning and judgement won't develop until they are 21-22 years old. What may seem OK to send a boyfriend you trust and know will love you forever when you're 14, becomes a huge regret when you are 25 and haven't seen the guy in 10 years. Especially if those images are being sent around to people you don't want to see them. Most all states have revenge porn laws to punish people that distribute these kind of images, but not everyone gets caught, it may also prove hard to track who sent them to this person and who that person sent them to. The point I'm making is that it's never a good idea to send nude or partially nude pictures of your self to ANYONE. Because you completely lose control of who will see the images, they can even be sold to websites that display such images and be seen by 1000s of people all over the world. As such there should never have been a question whether the 25 yr old did something wrong, He Did
