Ontario District Attorney Tantillo Pays to Settle Civil Rights Violation

A judge in Ontario County has granted a former Fairport woman $55,500 to settle a civil suit she filed alleging that the county had committed civil rights violations in her criminal case.
The agreement has the county making the payment to Stefanie Adams, stemming from an incident on Dec. 11, 2005, at the Bon Ton store at Eastview Mall.
The settlement spares the county mounting legal fees, said Ontario County Assistant Attorney Michael Reinhardt.
Adams filed the civil suit April 4, 2007. Defendants included Ontario County District Attorney R. Michael Tantillo, the Ontario County Sheriff’s Office and Ontario County Sheriff’s Investigator Matthew McDonald.
In the court papers, Adams’ attorney, H. Todd Bullard of The Bullard Law Group of Rochester, alleged Adams was denied her constitutional rights because she did not get “a fair and thorough investigation.” Specifically, it alleged retaliatory action during the prosecution and “retaliatory filing of increased (felony) charges.”
The suit claimed Adams sustained damages beginning March 28 (during grand jury proceedings) and called for “monetary damages to defend unfounded, retaliatory charges; humiliation; ridicule; extreme emotional distress; and psychological damage,” in addition to covering her attorney fees and “any other relief” the court deemed proper.
Bullard maintained Adams was a victim. The testimony “was pretty clear,” he said.
“I am behind whatever Mike Reinhardt recommends,” said Supervisor Skip Buck, D-city of Canandaigua, a member of the county Insurance Committee.“While we would like to pursue cases — we don’t want to lay down here — we have to look at the realistic side. We could lose a whole bundle.”
If the county pursued the case,“spent a few million dollars” and lost due to a sympathetic jury or other factors,“how embarrassing would that be for the sheriff and district attorney?” questioned Buck.
