Anyone want to argue that "Smoking Status" should be a legally protected attribute like gender, race, ethnicity, and religion?

Either ban it or remove any and all discriminatory measures against businesses and people.

The money Ohio received from the tobacco companies was used for everything except what it was for, to help those who wish to stop smoking. Let's tax the legal substance to death, impose penalties and as people quit, pass the lost revenue on to everyone else.

Why it hasn't been but it could be taken to court under the Americans with Disabilities Act. It has been described by the Surgeon General as more addictive than Heroin. If it is a recognized addiction on a legal substance I believe you would qualify as someone with a disability.

As long as purchasing/owning/use-of tobacco products is legal then any discrimination should be illegal.

What is next for these employers? Not higher (or even fire) someone who is overweight?(they are more at-risk for health problems)

Certain employers, such as those in a health care field, can have a legitimate concern as far as their employees smoking. Take dentists for example. Smoking can delay healing after surgery and dentists tell their patients they should not smoke for the health of their teeth. If they have that conversation with an assistant that reeks of smoke, how can that argument work?

In the case of a business where smoking makes absolutely no difference at all, to not hire someone just because they smoke isn't a good HR move.

People on both ends of this topic are so closed minded. This is why this issue gets people so fired up, because no one will listen to what anyone else is saying.

We didn't get where we are as a nation by holding our hands over our ears when other people say something that disagrees with us. Act like an adult and not a two-year-old.

on one hand you addicts cry that if it is legal, you shouldn't be allowed to discriminate against it and on the other hand, you say that it should be the business owners "RIGHT" to allow smoking or not smoking in their PRIVATE PROPERTY. Should it not also be the business owner's "RIGHT" if they don't want to hire a fuggin smoker?! You can't have it both ways. Lose the habit! Join the land of the living!

I have no problem with employers not allowing smoking on their property. But to start testing employees for things done on THEIR OWN time OUTSIDE of work is not only a slippery slope but beyond the line.

...they have a plan? Great! That helps all the Americans that are unemployed, facing foreclosure, and basically on the verge of despair. Did you ever hear the saying "talk is cheap"?

The problems we have right now are the fault of democrats and republicans. When the republicans were in control, the democrats were more than happy to sit back and say no too. Now that the democrats are in control, its the republicans turn to sit back and say no. It's not right, but both parties are doing it. The democrats and republicans know how the system works, and they'll keep doing it because they get paid to do nothing. This will keep happening until people that are so blindly loyal to one party take off their blinders and see what's going on. Don't vote for garbage just because your party threw it in front of you. Vote for the best. Vote for someone that will make America better, not run it into the ground. It doesn't matter what party they're from, we should be voting for the best.
