I'm not sure but I think you only have to have the rails if the boat is moving and someone is sitting on the deck or side of the boat.

"RSMo 306.126 states, 1. The operator of a motorboat shall not allow any person to ride or sit on the gunwales, decking over the bow, railing, top of seat back or decking over the back of the motorboat while under way, unless such person is inboard of adequate guards or railing provided on the motorboat to prevent a passenger from being lost overboard."

"To sit on a front or back deck or fishing platform of a boat there must be a guard or railing at least 6" all around...We receive a lot of inquiries regarding this, especially on smaller boats like jon boats or bass boats."

Whether you have to have them or not, you might call the state water patrol and ask just to make sure.

By the way, it's a Missouri water patrol law. Not park service.

So let me see if I have this straight. It has been illegal to lay on the deck of a boat in motion for a quite some time. Right? The WP pretty much let it slide unless you were being stupid. Right? Now I'm expected to spend $200 on rails? I've noticed a few boats with rails, but honestly thought they look more like a tripping hazard than a safety feature.

So have they been cracking down this summer? I haven't seen a WP all summer, but I usually go during the week & stay down river from Big Springs.

They are working on getting jon boats taken off the list of boats that require rails, but at this time it is a law you have them in place. I've seen boats with PVC pipe rails, square tubing, ect there is no regulations on what it has to be made out of, and it sure doesn't have to cost no $200.00
