Wal-Mart Brokers Deal in "Black Friday" Trampling Death

You might remember the case of Jdimytai Damour, 34, a temporary worker, who was shoved to the ground as he opened the doors to a Wal-Mart in Valley Stream, NY and trampled to death on "Black Friday," last year. The family eventually sued, but on Wednesday Wal-Mart and prosecutors inked a deal that requires the retailer to pay nearly $2 million and improve safety at its 92 New York stores, in exchange for avoiding criminal charges.

i agree, but the store knows the clientele they're catering to and should have provided ample security or safeguards against those savages.

Well thats a shame. Wal-Mart is horrible company but they are in absolutely no way responsible for this mans death. This is exactly why we are seen like such pigs around the world. My family has no monetary value. If they are killed in a horrible manner I will mourn my loss, but I will not seek menetary compensation to replace my loved one. These people are simple pigs.

..... yea, until it's YOU. You can say you would not, until you are experiencing it yourself. Then the tune changes. Your family has no monetary value til you have to figure out how to cough up $7k to bury one of them.

Legal and moral merit aside, I understand why the victims lawyer would go after Walmart looking for money.

it was "zulu" (2004 w/michael caine) or it could have easily been "black friday - walmart style.

How embarrassing for you that you don't know your rights as a citizen. Any retail establishment is required by law to have insurance to coverage the costs of incidents involving their employees. They are LIABLE for any and all injuries sustained during the time you are on their property and being paid by them as a worker. Would all of those people have been at Wal-Mart had Wal-Mart not invited them with the promise of a huge sale? The answer is no, furthermore this is not the first incident of a person being injured or trampled at a Wal-Mart Black Sunday sale. NOt to mention countless other sales like this where people have become violent fighting over merchandise. The obvious problem is of course that the worker was black, and the crowd was predominantly black. So we hear words like they were acting like "savages". I cannot believe that there are people that believe Wal-Mart is free from any wrong doing.

2.Most cities require crowd control and a permit when you create a mass gathering and there must be enough people on hand to direct and control the crowds something like 1 for every 100 people.Did Wal-Mart have adequate crowd control? Answer:1 employee dead

Wal-Mart would still be liable even if the guy didn't work there. His death was caused by no negligence of his own. He was by the door standing where he had been instructed to be.

for your information, a customer on the news that night - A BLACK FEMALE CUSTOMER, I MIGHT ADD - called them savages. if you're a savage, you're a savage...whether you're black or white. AND I DON'T THINK THEY WERE ACTING.

What about criminal charges against the people who trampled on the poor guy?
There was security tape footage of incident.

Let's assume that a crowd of mostly white people had trampled that black man; would the investigation and legal case have been handled any differently?

Wal-Mart is the largest retail corp in the WORLD! I doubt very seriously that they will miss 2 million dollars. A single store makes that in a month.

OK, that was a joke, right? Please tell me you are not this naive. Name the Wal-Mart that frequently on a average business day has 3000 people waiting in line to get in.

Wal-Mart INVITED the people there by mass advertising a sale on electronics and other items and selling them in limitied quantaties to draw people to the store to start their Christmas. Limited quantities implies "first come first serve" meaning the mob bears the burden of being first. Desperate people do stupid stuff. I was in a hurricane last year and I saw the same thing, people fighting over ice and supplies, while others cut in a line that was about 600 people long.(they were mostly white)

Every city/county has some sort of laws in place regarding mass gatherings including Nassau County. Wal-Mart used barricades and their existing workers.

All of this however is irrelevant. The DA would never have charged them if they had not violated any laws.
