Sam Swope Auto Group has been doing business in this area for over 60 years and now owns or controls over 20 Dealership Brands. A lawsuit was filed alleging Racism and prejudicial and illegal business practices involving Hispanics and Spanish Speaking people.

The whistleblower was a 4 year plus employee who worked for their buy here pay here Finance Company wholly owned by Sam Swope Auto Group.

The wistleblower just happens to be a political refugee from Cuba who escaped from Cuba when he was about 17-18 after being arrested, jailed and hunted down several times by the Castro Regime. Landing in South Florida he was granted Political asylum, learned English and went on to have a successful career with several business in the appliance and furniture business. As a high performing mid level executive he asked by his Company to relocate to Louisville to help them expand into Kentucky. In 2005-6 he and his family did but the nosedive in the Economy forced that company to close this new branch in late 2007.

Jose, that was his name, was finally able to secure a job in the Louisville area with Sam Swope Auto Group's Finance Company. However his direct supervisors quickly informed Jose that Sam Swope had a Corporate policy going back some 17 years that they did not sell or finance cars to people that only spoke Spanish....no English? Hispanic and only speak Spanish then we do not do business with you.

This is an amazing story of Discrimination and Racism against an employee who just happened to be Hispanic and bi-lingual. Plus Discrimination against Hispanics in the Public being promoted by a large Corporation. It is very well documented.

PR is a U.S. Territory but not a State and everyone that was born in PR or born subsequently in the continental U.S. after moving to the Continental U.S. are citizens. This also applies to other U.S. Territories such as the U.S. Virgin Islands, Guam and the Marianas in the Pacific. All are part of the "Country" for purposes of Citizenship.

Legal Hispanics are the largest voting and consumer block when comparing Asian, Black and Hispanic....now some 17-18% of population and that is a lot of potential customers for a large auto dealer or anyone else.

It was emailed to me late last week by some friends who knew this family from their Church and they also knew that I had done some work in the Civil Rights Area a few years ago. Right out of Grad School I worked in for both a newspaper and TV station, then later as an Investigator for a large Law Firm that handled Civil Rights Cases.

I was very interested after I had read the Pleading and contacted Jose's Wife over the weekend.

In 2009 when the harassment over his Hispanic Heritage and speaking "Any Spanish at all"...even when it was a request coming from co-workers within the organization became overt and hostile by Supervisors, he bought a recording device that looked like a fountain pen and when he was in meeting with his immediate supervisors, human resources or middle managment where all these things were said by them, he reorded it. She played some of those recording for me over the phone.

Statements like it is a long standing Corporate Policy not to do business with people that do not speak English were said, they have it in their own words said by them.

Most of the out and out racist comments were made oddly enough by 'black' or 'African Americans' in supervisory positions or even in H.R. Positions. Pretty incriminating when their statements are in their own voices.

This Corporation needs to clean up the bullying and racism. The Founder, now retired, I am sure does not know this is going on in his company....at least I would like to think that???

We have laws in this country that protect people who come here from people who are racists. What does it mean to be an 'American'? Is it about hate? Is it about ignorance? Why is it that you worthless beaners feel that you deserve a loan when you can't or won't even learn to speak American? And if you can't speak english, then you're most likely an illegal alien. Why in the world would any finance company in their right mind make a loan to a criminal? especially one that could be deported or go back to their home country at anytime and skip out on the loan? Sounds like a damn good policy to me.

I have no problem with a company who refuses to do business that requires contractual obligations with persons who do not speak English. There's far too much liability there. The liability comes from the engaging person's possible misunderstanding of the obligations--leaving the company at risk. But, then again, it takes a little common sense to see it that way. PC dilutes common sense in today's society.

Sam Swope doesn't want Spanish customers OR employees - but that's okay with your type. Speaking of liability, there are doctor's offices all over this country who DAILY call translators to handle their patients who don't speak English. Doctors suffer the most from our litigious society, but they provide a translation service and issues stemming from mis-translations are RARE to never. It is a violation of not only Kentucky’s Civil Rights Act, but also a violation of Federal Law to deny Hispanics the right to purchase a vehicle because they do not speak English.
