According to the Federal Bureau of Prisons Dave Cotney is still in the federal prison in Talladega, AL. However, his accomplice Allen Nelson was released in January of 2013.

Valley man who shot Chambers County police dog gets 10 years

The 37-year-old Valley man who shot a Chambers County K-9 officer seven years ago pleaded guilty to the crime Monday in Chambers County Circuit Court.
David Franklin Cotney, who was indicted for killing a police dog, agreed with the prosecution’s recollection of the events of March 24, 2003, that led to him shooting Narco, a German Shepherd. Sgt. Mike Parrish with the Chambers County Sheriff’s office was the dog’s handler.
Judge Ray D. Martin sentenced Cotney to 10 years in state prison for the dog’s death. The sentence will run concurrently with a related drug conviction he is presently serving in Talladega.
The Chambers County drug task force went to a local residence that day after receiving a tip that an odor, believed to be related to the manufacturing of drugs, was coming from the home.
When Cotney, one of the men at the residence, fled, officers called out for him to stop, warning that they would release the K-9 unit if he did not. When Cotney failed to stop, Narco was ordered to get him. Cotney subsequently shot and killed the dog.
Narco was the first K-9 with the sheriff’s office to be killed in the line of duty. The office’s first dog, Ace, developed cancer and had to be put down. Kilo, Narco’s successor, passed away suddenly on Sept. 1.
Sheriff Sid Lockhart said the results of Kilo’s necropsy indicated its death was heat-related. He said the office still plans to get another K-9 in the near future.
