Proposed construction of a Winco Foods grocery outlet on Redwood Parkway has hit a new roadblock, nearly a year after winning environmental approval from Vallejo city officials.

A Solano County Superior Court judge is expected to rule on a challenge to the City Council's approval of an environmental impact study. Store opponents say the study failed in many ways to adequately address the project's expected cumulative air pollution, operational noise and construction vibrations.

A tentative ruling late last month indicates that Judge D. Scott Daniels is siding with the project challengers, who include California Healthy Communities Network, Vallejoans for Responsible Growth and Friends of Lake Chabot, on all three issues.

Daniels writes in his tentative ruling that the city report does not adequately identify a construction vibration threshold; that it proves insufficient alternatives to a sound wall to protect neighbors from store operation noise; and that cumulative air pollution concerns were not resolved.

Joe Feller, of Vallejoans for Responsible Growth, said his concerns about the Winco extend beyond issues raised with the court -- namely, increased traffic congestion and an oversaturation of grocery stores in one area.

The council was unable to consider those issues when voting to certify the study, which focuses solely on environmental impact.

"I think that this bodes well for the city of Vallejo in that we can now start devoting resources to a new general plan that reduces the over-retailing that we have, and somehow tries to come to grips with the vast amount of blighted space that dots our city," Feller said Friday.

Winco developers have been eyeing the for-sale Elks Club site on Redwood Parkway, near Admiral Callaghan Way, in recent years. The development includes demolition of the Elks' existing structures and construction of a more than 71,000-square-foot facility -- just under the city's big box store ordinance threshold -- in its place. Elks representatives have said they support the project, which would allow the group to use sale proceeds to relocate elsewhere in Vallejo.

Phil Tucker, of the California Healthy Communities Network, said he was happy with the judge's early ruling. He said the city is likely to either appeal the final decision, or possibly redo the environmental impact report.

Deputy City Attorney Alan Cohen said this week that the city is evaluating its options, and is in the process of challenging several points in the tentative ruling.

One of the oddest sights ever seen in Vallejo was ole Joe and Vicky protesting alone, out in the middle of the old Kmart parking lot. There was ole Joe in his crocodile Dundee hat and Vicky in his best Sunday dress. Walking back and forth with a picket sign. They sure did a good job preserving that parking lot. I wonder what they have in mind for an encore at the Winco site?

Odd, isn't this the same judge that sits on the CCP board that gives the Solano Co Board of Supervisors direction on where to place the parolee's?

I used to live in Vacaville and Winco was at my backyard fence; we didn't have problems with noise and I have two small children with both their rooms at the back of the house. We moved to Vallejo and the grocery stores are expensive; Grocery Outlet doesn't have a huge selection or a lot of things expire before I can use them at home; thus causing me to waste more money than if I had a Winco local. I believe this would help all the Vallejoans to afford better groceries during this Fiscal Cliff crap happening that is going to screw us all!

hey WINCO, take out a full page ad in the local fish wrap and show how much tax you would provide to the city leaders/grifters and then tell them to screw off, I will drive to VV and not worry about getting shot or mugged

No problem with having a WINCO in Vallejo, but this is just another example of poor planning. Why would you allow it to be located right next to Safeway. Do you really think this is GOOD planning? Anybody remember Home Base? Allow it to be built somewhere where it is not in direct competition with only one other store. Otherwise, you're trading one blighted lot for another.

Don't anybody worry about it, it's not going to happen; this was clear two years ago when the elks, through their corrupt membership shilled the property and sold a bill of goods to the brothers, many of whom had no idea what was happening. Most people will do as you tell them. Too much traffic alone is enough of a reason for a competant planner or architect to nix this loc. Politics work best in the gutter.
