Does it matter now?? Traveling 3 days a week on airlines, I see what the law use to determine as "Lewd and Lascivious acts" being committed every day by the TSA. They do not need to grope 4 yr old girl or boy. So she should be set free.

It's real important for everyone to realize that there is a huge double standard involved here. A few years ago a male teacher in this area went to prison for having a relationship with a female student. In this instance, the female teacher will almost certainly be fired and that will be that--end of story.

Almost. The male pervert teacher goes to prison, the female pervert teacher gets probation. Both are convicted but the punishment is very different.

School kids know when a teacher is coming on to a student because it is so obvious by the way she/he acts toward the "selected kid" in class.

Schools should have a "suggestion box" in the office where kids can tell what's going on. I wrote a letter once that told about the female art teacher at Jepson who was hot for a tall boy in our art class. Suddenly she was no longer hot. LOL!!

It is time for the teaching "profession" to reevaluate their morality and level of personal integrity.

Other teachers will testify to this teachers upstanding character and "love" for her students.

Recently, in another district, a teacher was reinstated and given back pay after a judge ruled that having sex with an 18 year old student in the classroom was consentual.

Compare this scenario to a doctor who recently lost his license to practice medicine because he dated a "former" patient. He broke up her and she then filed a complaint with the medical board. Both were single and in their 40's.

Doctoros aren't allowed to mix their personal and professional lives, so why should teachers.

If teachers are truly professionals -- then why should they be held to a differnt standard?

Fraternizing with a student in any way and a teacher should be barred from ever teaching again; no where, no how.

A boink is a boink, no matter who initiates it. And when a teacher (an authority figure) boinks a student it is called "rape."

I suppose this teacher was only doing this boy a favor, helping to fulfill his sexual fantasy.

It's time to raise the bar and make all teachers more accountable.

Below is California Penal Code section 261.5, unlawful intercourse with a minor, please note that the code makes very little distinction between genders, pregnacny is mentioned. As far as being offended by "boinking", it no more offensive than the news media playing up these stories of highschool boys having sex with their teachers and listening to shock jocks on the radio cheering the kid on or reading comments in Topix saying "no big deal".
(a) Unlawful sexual intercourse is an act of sexual
intercourse accomplished with a person who is not the spouse of the
perpetrator, if the person is a minor. For the purposes of this
section, a "minor" is a person under the age of 18 years and an
"adult" is a person who is at least 18 years of age.
(b) Any person who engages in an act of unlawful sexual
intercourse with a minor who is not more than three years older or
three years younger than the perpetrator, is guilty of a misdemeanor.
(c) Any person who engages in an act of unlawful sexual
intercourse with a minor who is more than three years younger than
the perpetrator is guilty of either a misdemeanor or a felony, and
shall be punished by imprisonment in a county jail not exceeding one
year, or by imprisonment in the state prison.
(d) Any person 21 years of age or older who engages in an act of
unlawful sexual intercourse with a minor who is under 16 years of age
is guilty of either a misdemeanor or a felony, and shall be punished
by imprisonment in a county jail not exceeding one year, or by
imprisonment in the state prison for two, three, or four years.
(e)(1) Notwithstanding any other provision of this section, an
adult who engages in an act of sexual intercourse with a minor in
violation of this section may be liable for civil penalties in the
following amounts:
(A) An adult who engages in an act of unlawful sexual intercourse
with a minor less than two years younger than the adult is liable for
a civil penalty not to exceed two thousand dollars ($2,000).
(B) An adult who engages in an act of unlawful sexual intercourse
with a minor at least two years younger than the adult is liable for
a civil penalty not to exceed five thousand dollars ($5,000).
(C) An adult who engages in an act of unlawful sexual intercourse
with a minor at least three years younger than the adult is liable
for a civil penalty not to exceed ten thousand dollars ($10,000).
(D) An adult over the age of 21 years who engages in an act of
unlawful sexual intercourse with a minor under 16 years of age is
liable for a civil penalty not to exceed twenty-five thousand dollars
($25,000).
(2) The district attorney may bring actions to recover civil
penalties pursuant to this subdivision. From the amounts collected
for each case, an amount equal to the costs of pursuing the action
shall be deposited with the treasurer of the county in which the
judgment was entered, and the remainder shall be deposited in the
Underage Pregnancy Prevention Fund, which is hereby created in the
State Treasury. Amounts deposited in the Underage Pregnancy
Prevention Fund may be used only for the purpose of preventing
underage pregnancy upon appropriation by the Legislature.
(3) In addition to any punishment imposed under this section, the
judge may assess a fine not to exceed seventy dollars ($70) against
any person who violates this section with the proceeds of this fine
to be used in accordance with Section 1463.23. The court shall,
however, take into consideration the defendant's ability to pay, and
no defendant shall be denied probation because of his or her
inability to pay the fine permitted under this subdivision.
