New York has outlawed self-help eviction. That means any sort of behavior designed to drive out the tenant other than going through proper legal channels: changing the locks, turning off the utilities, taking off the doors, putting possessions on the curb, etc. Any of those sorts of behaviors can be cause for the tenant to sue for any costs and expenses associated with the illegal eviction, and under the Real Property Actions and Proceedings Law, such damages can be tripled. Eviction in New York can only be accomplished by court order, requiring the filing of a petition with the court leading to a hearing before the court.

When a tenant does NOT pay the rent on the 1st of the month, you can evict them within 3 days.

If they want to do it the legal way and spend more time in YOUR property without paying rent, having a bunch of close friends and relatives over 6 feet tall armed with baseball bats does wonders in getting the deadbeat tenant to leave.....

Doing it the legal way, cost the owner of the property a minimum of $150 and takes over a month to get them out (even if they did pay the rent and living in a month to month rental).

If the file to evict you go spend the $20 bucks and start a bankruptcy proceeding.

The cops can be in the middle of throwing your furniture in the street but the moment that judge sees your papers have been filed it STOPS the eviction indefinitely until the bankruptcy is settled. PERIOD.

Also the guys who serve papers in Utica don't do it legally and you can FORCE the courts to recognize the real law vs. the "way they do it there in Utica". What they do in utica is called "Sewer Service" and they do not perform the services legally and correctly. That's why Utica is so fzzked up because they try to bend the rules and allow it to become a harassment. More on this soon if you need more info and help.

All you have to do is go to the City Clerk's Office; she gives you a Court Date where the Judge issues the Eviction. The Clerk also gives you the Legal paper to serve the Tenant by registered/certified mail informing them of the eviction. All the eviction proceedings are perfectly legal if you are forced to get a tenant out of your property.

Personally, I like the idea of men with baseball bats - much more effective!

If the Bankruptcy is commenced after a Judgment of Possession and warrant have been issued to the landlord, the bankruptcy stay is not automatic and it is then be necessary to apply to the Bankruptcy Court for a stay of eviction."

And BTW a bankruptcy petition is two forms and a fee. If they can wait 3 hours to sign up for welfare they can file a bankruptcy petition in about 18 minutes with information found online. The initial form is about as difficult as a power of attorney form duuuuuh.

You file it, you take the paperwork to the judge and that's it. You don't even have to follow through with the bankruptcy ha ha ha!

Oh my mistake it's only one form to commence the action. And here is a site set up for Rochester but the applicable laws are the same.

Also it reminds me that there's also some exemption laws in NY that will apply here but not to all.
