I dont know if he is from Binghamton but I know for sure he lived in Michigan. I saw a bio on him in the paper when he first came. Has anyone ever noticed how weird he acts when he is on television?

Well well, seems to me like your all part of the problem and not the solution. It's a shame you'll spend more time complaining and down talking others than you would to do some good. So what if some people don't fit your bill of how a director should be. Or how a non profit should work. Many people have been helped, changed their lives, given back. That's what the Mission is for. They even have a learning center that's open for the community so you can go and learn correct grammar and spelling. Leave others alone and focus on yourselves and what you can do. It's not your fight. All bad things come to end. If its a bad program then it will fizzle out. But talking about someone or some place does no good. So why do it? Sorry to be harsh but damn. Look at what you say! Aren't you better than this?

I appreciate the compliment but I'm not the reverend. You can however call me the chief of all sinners. Or just a simple servant. Because im no one special. Just tired of seeing the same people waste negative words on something that they have no effect on. And it would be better to "look" bad (in your opinion) in the things one does than to not do anything at all. Unless of course this web posting is proficient in getting things done.

Dear Judge Gall:
This office represents Michael S. Rizzo (“Rizzo”) in the above-captioned proceedings. I write in furtherance of my April 5, 2012, correspondence (another copy of which is enclosed for the Court’s convenience) to request a status conference and to bring to the Court’s attention a case recently decided by the Appellate Division, Third Department that is on-point with respect to the issues raised in Rescue Mission of Utica, Inc. v. The City of Utica, et al., RJI No. 32-09-0714 (referred to herein as “Proceeding No. 1”), and Rizzo v. The City of Utica, et al., RJI No. 32-10-0327 (referred to herein as “Proceeding No. 2”).
When we last conferenced these matters on or about May 10, 2012, the discussion largely centered on whether the City of Utica (“City”), as the respondent in both proceedings, had furnished the Court with a certified record thereof, as it is obligated to do under N.Y. Civil Practice Law & Rules (“CPLR”)§ 7804 (e). At that time, counsel to the parties made tentative plans to re-convene in your Honor’s chambers for the purpose of reviewing the voluminous file that has developed in these proceedings (which have been transferred and reassigned on several occasions), and to identify for the Court those records that are pertinent to the determination of these matters. That has not yet occurred. Thus, if the Court is not prepared to consider these matters on the current record, then I respectfully request that the Court schedule a status conference for the purpose of sorting and organizing the record and certifying to the Court that these matters are ready for its consideration.
Next, the dispositive issue in Proceeding No. 1, supra, is whether the ZBA’s finding that the Rescue Mission had enlarged or expanded its nonconforming use of the premises -- and thus lost its legal nonconforming use status -- was arbitrary and capricious. As previously stated, in Proceeding No. 2, supra, the issue is whether it was arbitrary or irrational for the City Building Department to have issued a building permit to the Rescue Mission to enlarge the use that the ZBA had already deemed illegal. The case Nemeth v. K-Tooling, et al., decided by the Appellate Division, Third Department on November 29, 2012 (Appeal No. 510898; copy enclosed), is instructive on both issues.
In Nemeth, the petitioners sought, among other things, to permanently enjoin the use and operation of a manufacturing facility on the grounds that the facility had lost its legal nonconforming use status by way of expansion or enlargement of that use, even though the expansion was purportedly authorized by various building permits. As pertinent here, the Court held in Nemeth that:
defendants built an addition, measuring between 800 and 1,000 square feet, to the brick building. This addition was intended for and actually used for manufacturing purposes. Although they apparently obtained a building permit from the Village, issuance of “such a permit cannot confer rights in contravention of the zoning laws.”(City of Buffalo v. Roadway Tr. Co., 303 NY 453, 463 [1952]; see Marcus v. Village of Mamaroneck, 283 NY at 330). Construction of this addition violated the provision that a nonconforming building or use not be added to or enlarged unless made to conform to the residential district where it is located (see Village of Hancock Zoning Law § 115-14 [A]). Accordingly, plaintiffs were entitled to an injunction prohibiting defendants from using the addition to the brick building on their property for any nonresidential purposes.

As discussed at greater length in Rizzo’s answering papers in Proceeding No. 1, and in his Verified Petition and supporting memoranda of law in Proceeding No. 2, and as reiterated in the undersigned’s April 5, 2012, correspondence, section 2-29-81(c) of the City zoning ordinance states, in pertinent part,“[A] nonconforming use of a structure shall not be extended or enlarged after passage of this chapter by ... addition of other uses,” except by the vehicle of a special use permit. Id.(Emphasis supplied) The ZBA determined on June 9, 2009 (at issue in Proceeding No. 1), that the so-called “residential” use of the Rescue Mission premises for a prisoner re-entry program was vastly different and more intensive than the permitted “Alcohol Crisis Center” that it had become, and for which further approvals were being sought.

Therefore, just as in Nemeth, the ZBA correctly found that the property’s legal nonconforming use status had been lost though expansion or enlargement of the nonconformity. In short,“if the courts allowed a defendant to continue the unlawful use, it would be tantamount to the courts ‘usurp[ing] the legislative function’ bestowed upon a village board and rezoning the land.” Nemeth, supra, Slip Op. at 5 (parenthetical omitted).

Accordingly, the Rescue Missions’ repeated attempts to demonstrate that building permits were issued for some (or even all) of these expansions of its nonconforming use are largely irrelevant. It logically follows, moreover, that no building permit could issue to authorize either a physical expansion of the nonconforming use, or “the addition of other uses,” which is exactly what has occurred here (and is at issue in Proceeding No. 2), in clear violation of the zoning ordinance. Consequently, the Verified Petition should and must be dismissed in Proceeding No. 1, and should and must be granted in Proceeding No. 2.The balance of the above-captioned proceedings, to the extent not withdrawn, abandoned or rendered moot by the Court’s determination of Proceedings Nos. 1 and 2, may be decided on their own merits in due course. In any event, they should not detain the Court’s consideration and determination of the proceedings discussed herein.

CPLR § 7804 (e) states in pertinent part,“[T]he body or officer shall file with the answer a certified transcript of the record of the proceedings under consideration, unless such a transcript has already been filed with the clerk of the court.” While it seems clear that the City of Utica has failed to file any “certified” record of these proceedings, no party disputes that the documents and other materials annexed to Rizzo’s answering papers in Proceeding No. 1 above and/or those annexed to his Verified Petition and supporting affidavits in Proceeding No. 2, were all before the City Zoning Board of Appeals (“ZBA”) when it rendered the June 9, 2009, determination that is directly at issue in Proceeding No. 1 (and implicated in Proceeding No. 2, in which Rizzo seeks to annul and vacate a building permit that was issued for the purpose of further expanding and intensifying the land use that the ZBA had deemed illegal on June 9, 2009). Accordingly, the Court could reasonably waive the City’s obligation here and find that Rizzo has already “filed with the clerk” the necessary transcript.
