To Whom it May Concern:

My life is Hell! In 1996 I was involved in a consensual relationship with a
16 year old girl. I was 23 at the time, we dated 3 months later we broke up and just over a year later she pressed charges. I was charged with Rape in the 3rd degree in New York State. I took a Plea deal which gave me 6 Months in county jail and 5 years probation. If I knew then what I know now I would have have seriously thought about the deal I was about to make. I took the deal in 1998, I was told I would also have to register as a sex offender for 10 years. Of course around here in about 2006 the laws and conditions changed dramatically. I was living with a relative in 2006, a
local ordinance was put in place where sex offender level 2 or 3 could not live within 1500 feet of a school or playground. So I was given 30 days to move. I am a level 2. Then I was informed that my picture was on the Internet. So that's when I found out about watchdog.com . I was devastated but still held out hope as at this point I thought I had only two years left to be on the list as was my sentence. Well that has also changed. It was first raised to 20 years I must register then went to 30 years and now is Lifetime registration subject to relief. I have had several jobs that I
excelled at only after a period of time someone saw my picture and rumors started to flow around the work place. I have not been able to nmaintain steady employment because of constant harassment and being the general public sees no difference between Rape 3rd (Statutory) and 1st Degree which is by force, I am a monster to my community. I am called pedophile , child molester, rapist etc etc etc. I have had posters stapled to telephone poles near my home which state this. Told by local police
this is not against the law.I am currently on SSI/SSD as I now have Severe Anxiety and Depressive disorder. I have become some what introverted as I always think I am being talked about and judged when I am around people, and in quite a few cases i
am correct. I live in a small town/city and I am VERY well known. I have lost pretty much all hope of any kind of a successful meaningful life. I almost feel uncomfortable around kids now , not because of what I might do but because of the constant harassment I receive from others. I am dating or in a relationship with a town elected official. I lived with her in the past but cannot live with her now as her address will effect her re-election. She does not need nor deserve the attention or harassment that I receive. These laws are so out of whack. I am lumped in with all other offenders,
from the man or woman who sneaks into a small child's room and commits disgusting acts, to a man/woman who would kidnap and violently rape someone. The general public hears " Sex Offender" and you are a POS that's it. I have done quite a bit of research on this since it has consumed my life since and since the laws were dramatically toughened. In 32 other states what I did was not even a crime. Sixteen is the legal age, but in New York it's 17
so I am a Monster for life. I cannot attend a school play, go to a park. Reside near a school or a park. I have my picture posted online like a Monster and neighbors steer clear of me as if I am one. I have had no similar charges but after 8 years the laws made me into one. This is unconstitutional. I pled guilty and accepted a ten year term on the list but they raised it to
life. This in my eyes it is Double jeopardy, It would be no different then for example Pleading guilty to say DWI accept a fine and a 1 year suspension on your license. Then when your fine is payed and your time without your license is almost over they just say well now we think you shouldn't have
a license for ten years, without a hearing or a chance to defend myself.

My only hope for relief is to petition the court for relief, to lower my sex offender level from a level 2 to a level 1 , then after 20 years I can
petition the court to be removed. This is disgraceful. I know the Supreme Court has ruled this to be constitutional but they are WRONG! I am no saint by any means but I am not this monster society sees me as. I believe this
to be a form of social torture. I cannot work, I have Anxiety and Depression
Inever had before, I do not feel comfortable being out in the local public
as I feel I will be recognized and ridiculed. I have lost all quality of life and have contemplated suicide and actually been admitted to a Mental
Hospital. Let me quickly discuss another situation i endured. In May/June
2011 I moved out of my Girlfriends house. I briefly went to stay with family while I found a place. Well I have 10 days to register an address or I am guilty of a Felony for not registering my address. Being Homeless is illegal punishable by 4 years in prison. Well I was staying with Family and I had to register my address, well the address was flagged as me living there and the landlord of my family member was told i had to leave ASAP or she would be evicted. So I had no legal residence on the 9th day one more day I would be guilty of a felony so i went to the Mental Hospital and told them I was going to harm myself. On the way to the Hospital I sent a letter to Albany
stating the Hospital was my address. After a few days I was released and the clock started again. Ten days to find a place, well let me say that for
the next 6 weeks or so I was looking for a place and unable to find one would go back to the Mental Hospital and repeat the cycle every 9th day until I was able to find an apartment through help of public assistance. I am able to work Physically but Mentally I am a mess. I just do not know how much
longer I can keep this up i am so sick of living with the false label society has given me, I just do not know what to do anymore. I am asking for help. I have to fight these inhuman, unconstitutional laws. If I am not
proactive and fight this I feel I will never crawl out of this giant pit
of dispair. Please help me , tell me what I can do. Are there Class actions
lawsuits in place, events to attend for support. I need to know I am not
alone. I feel with the current laws they want me Jobless and or in prison.
Is there no redemption for me? Can a poor mistake in judgement 16 years ago
never be understood or forgiven? Am I forever to be an outcast or can I
become a productive member of society again? Please help as I have lost
all hope. Recently I was approved for SSD/SSI because i cannot take the the label and what it does to me emotionally, the public ridicule is horrible, once my co-workers find out they look for any excuse to get rid of me. I am able to work but because of this label i cannot. The Federal Judge after i told him my story agreed that he felt it was unjust. So I was approved. I now get $817 a month cash,$200 in Food Stamps. They also pay 2/3's of my rent under another program. Free medical and dental for life. Also heap 3 times a year at $450 a pop. I did a little guesstimating and I figure with everything I make the equivalent of $25,000 to $30,000 dollars a year if I was on the books maybe a bit more. After all I pay no taxes on my income, which is both gross and Net. I Dont want to live this way but this is the ripple effect of lumping all Sex Offenders into one category, There is a difference folks between a violent rapist and someone who dates someone a little to young. It was a poor choice I made but far from rape. So until these laws change I will take the free ride of sorts, not a fortune by any means but is enough to get by and then some. I just want to work but I need this label lifted, it's been 17 years, it's time people. Allow me to put my past behind me and live a productive life, PLEASE!!

I have since been put on SSD/SSI because I cannot work and a judge sided with me. I make $817 Cash each month,$200 in Food Stamps and they pay 2/3's of my rent and free medical and dental for life. I did the math and it is equivalent to a little over $30,000 a year on the books as I pay no taxes. I want to work but cannot do so until this label is lifted. It's been over 17 years, it's time people , please allow me to try and have a productive life again. I need a second chance 17 years of this is long enough!! Thanks for your time.

To me, the paranoid wackos that sit around and stare and gossip at those sites are just as creepy as most of the people on them. Meanwhile their kids are all fat stupid and dull just like the parents.

In the old days moms and dads simply taught their kids how to report these things but today they spend all day on facebook and looking at who the pedo up the street is. They're EVERYWHERE it's human nature and has been happening since before biblical time yet these lifelong whiners expect a website to substitute for their lack of attention or parenting. Talk about wanting to be victimized for attention. That's the motivator.

As I stated in 32 other states it isnt even a crime, was just a poor choice on my part to date a 16 year old. I don't think that warrants a life sentence on some screwed up list

I'm pretty sure you've posted before. It is NOT illegal to be homeless in NY if you are a sex offender. You can register your address as "Transient". The law states you have to give an address. But doesn't go into detail. Transient will suffice.

Maybe not anymore, but either way my point wasn't that it was This Lifetime suffering needs to end. People may say well your victim suffered, but I would have to beg to differ one that one, I gave her extreme pleasure consensual pleasure, until I broke up with her and she felt scorned. OK I can accept it was against the lay and according to that factor alone I should be punished, but not for life

I agree. The entire system needs to be redone. They do lump everyone into one group. You could of dragged a young girl out in the woods and raped her or you could of got caught jerking off on your own back porch. As long as your on the offender list people will think the worst case scenario.
It a total double jeopardy all around.

I know that it used to be that new laws cannot be retroactively applied to people who were convicted or plead to crimes before the new law was enacted.

Is this no longer true?

The solution to this is real easy. Organize all the marginal offenders and get a few lawyers to sue the state for about a BILLION-FUCKING-DOLLARS and DON'T LET UP and VOTE ENMASSE and watch how fast the sex perverts in the Legislature run for the hills!

I'm seeing a time where, barring any recourse for all they do to us assassinations in NYS are coming from fed up people. All it would take is a few popped heads and WATCH how fast those criminals in Albany stop their BS! I don't live or work in NY any longer but even if I did I'd have no problem paying your SSI and FS. When I was younger I was with lots of questionable chicks all consensual but I can totally see your frustration.

That chick who ran you in sounds like quite a doozie. You should just write up a blog and blow her name all over the place. Fukkit you have to live with what you two chose to do why shouldn't she? It's not like YOU'RE going to be any less embarrassed!

Barring that, since NY is so repellant to happiness and such a nannyhole you should just select a state where your crime ISN'T a felony or a state that has no sex offender gossip sites and move there. you and your family will do much better.

Well Actually I can leave the country whenever, It just is up to the country I would like to go to. I have to write to them and explain my situation, it's up to them whether or not they will allow me to enter. Canada for example wont allow anyone through with a Felony, my old boss had a DWI Felony and part of work was in Canada, it took him almost 2 years to get permission to enter Canada with just a DWi, and they are the one suppling all the beer to begin with lo.

Also on the other point mentioned, going to a state where it isn't a Felony. In 32 other states what I did isn't the slightest crime, however ALL of them I would have to register at, as they respect the Law of other states so even though say in Florida the Age is 16, here is 17, I would have to register in Florida as a Sex Offender because I violated NY LAW, whether or not it is against theirs, bottom line I was convicted of a Felony in NY it carrry's over.

Why is this discussed like it is not an earned punishment. The actual solution is to stop having sex with a 16 year old child when you are a 23 year old adult. In 1996 16 year olds were actually a lot less worldly than they are now, not that it should make a difference. You knew the law you knew she was still school age and you were not. Accept your punishment it fits the crime.

Maybe if you didn't have sexual relations with a child you wouldn't have this problem. If you're 23 and having sex with minors you definitely have some issues, or you can't find women your own age and need to prey on teenagers.

Wrong to judge for thousands of years woman married very early and to now label someone for life for what the world has done sonce the beginning of time is disgraceful. Besides if this happened almost 2 decadeds ago as stated that is grossly disturbing that they would be on any sort of list,
