If you're such a lousy driver that NY is making you take the "driver responsibility assessment", I don't want you sharing the streets with me.

You should take up bicycling or rollerskates, anything that makes you less likely to injure me or damage my car!

You should be worried about the in-state drives who go to court and get their charges reduced to no or low point tickets. This scheme nabs out of state victims who plead guilty and is a Tax not a fine.

Since NY sets it's speed limits using a "Political" structure instead of a traffic safety engineering basis calling a driver nabbed in a revenue generating scheme unsafe is kind of ignorant.

> All it takes is one speeding ticket for someone to get 6 points which calls for the assessment. Calling someone unsafe for one ticket is a joke.
> The NY Thruway for example is engineered as a very limited access toll road with miles of straight highway in between exits. 65 MPH is the posted speed limit. A similar interstate highway with the same conditions is 70 or 75 in another state. Why? Safety or Politics. The truth is politics.
> California for example speeding tickets will not be enforced by courts for highways and roads where the speed is not set by the 85th percentile. This is a traffic safety survey which determines the normal speed of travel of 85% of the drivers on the road. NY for example on State and US Highways has "Village Speed Limits" of 30 MPH
regardless of safe speed.
>NY has more badged tax collectors than any state I have ever driven in. They find the right hiding spots and write tax bills, er Tickets.

The truth is this responsibility assessment is just another way for NY to generate more revenue.

What is it with excise fees that we as citizens get mentally beaten into submission.

This an unthinkable Scam only a government as corrupt as New York or any others can concoct.

Wake up people! Its real and not going away."Stop overspending Albany"Politicians realize our economy is in the crapper and will be for a long time, regardless of who occupies the White House. They also realize passing additional taxes is likely to earn them a loss in the next election. So, faced with continuing pressure from labor unions, special interest groups and so on, to increase spending, how do they raise additional money without it looking like a new tax? The answer is fines and fees. The NY Driver Assessment program is just such a beast. Its only purpose is to raise money for the overspenders elected to Albany. Argue all you wish about constitutionality and so on, none of that matters. The crooks in Albany only want our money and our liberties stripped from us.

I agree with you Michael, so what do you propose we do? Maybe start an organization similar to change .org , but only dealing with New York State? That may be a good start. Any other ideas?

I just got one of these as well....and even though this thread is old I will comment.

Getting 6 points in NYS ain't shit, 21+mph over (whether accurate or not) and there is your 6 points, one single offense. What OP was complaining about is he took the guilty plea, paid his fine. It should end there. What NYS does is send you another $300 Driver Assessment after you already paid your ticket. It's pure bullshit and not fair at all.

My only concern is NYS/NJ share driver info and don't want there to be a problem when I goto renew my license. So I'll probably end up paying a $100 a year but this is a pure money making scam

My Auto Insurance has increased significantly over the years despite my clean driving record, mainly due to people who believe 21mph over the LEGAL speed limit is "No big deal".
The NYS Driver Responsibility Law is Harsh because our roads are packed full of irresponsible IDIOTS.

This is nothing more than a straight-up scam; they aren't "assessing" a damn thing.
How can our government get away with crimes like this?
You should be happy they don't suspend your license for having 8 points on it.

Anyone that can rack up 8 points within an 18 month period deserves any punishment DMV can give them!!!!!

You say in your comment "If you're such a lousy driver that NY is making you take the "driver responsibility assessment"" this shows your ignorance to the law itself. They are not asking you to take a course to make you a safer driver. They found the person guilty of a traffic infraction and that infraction resulted in an already bloated and excessive fine and "courtroom surcharge" At that point you have paid your debt for doing the crime. In 2004 NYS passed this law for this assessment, saying if you accumulate more than 6 points you have to pay this assessment. using your cell phone without a hands free kit is 5 points. So get a ticket for talking on your cell phone while cruising down the thru way and if you get another ticket for anything your screwed. And by screwed i mean above and beyond the fines and surcharges you paid for that infraction they now want you to pay more fines only they call this one a "assessment" and they know you will pay it because we all have to drive to get to work and pay our bills and take care of our families. I am stuck in this state till my children are adults because i woudl not be able to see them if i lived out of state. If you do not have somethign forcing you to stay in this state. Run in any direction but here. There are states with no State income tax. No sales tax. and that treat there citizens like they should be treated or at least closer to the way they should be treated. NYS is all about money. The seatbelt law is the best example yet. How does the driver of a vehicle wearing their seatbelt make the people and other drivers around them safer? Because NYS plays the safety card on every one of these laws. You can make an arguement for some of these laws, and im not in any way saying that there should not be a way to police this. Remember the good old days when a police office would give you an opportunity to correct something before they wrote you afine bearing ticket? How about a quick check and note on the persons file that you pulled them over for speeding but let them off with a warning advising if they are caught again for this within the next year that they will be fined. We are all computerized. Raise awareness without fining? Or how about requiring we take a safety course about the dangers of using a cell phone while driving. All options that the state will not take because it cust revenue that they need because they cant manage thier money (oops "OUR MONEY") right so they have to find ways to steal more. Its all a big fat money grab, and america needs to wake up. I see cops talking on cell phones, checking the laptops in thier Cars, texting, and everything else that they ticket people for every day. Hypocrits. Oh and by the way before you try the old "you would feel different if someone you loved was killed by ..." My father was killed by a drunk driver at the age of 38 I was 10, and Ive been in several accidents in my life all of which i was not even moviong when i was hit by someone else, or was just a passenger in the vehicle. Accidents happen, do they suck yes. do people get killed yes. Is a giant fine going to help? I doubt it. It might stop the person short term, but a bad habbit is a bad habbit. Eating McDonalds in your car, drinking a hot coffee, changing a CD in your radio, or the radio station, even talking to someone in the seat next to you or having kids in the car with you are all distractions that can and have caused accidents. I dont see any tickets written for any of that. Why? Because the State woudl have a hard time getting re-elected if they said that having a child in your car with a rattle toy or pacifier thatthey could throw ant you is dangerouse andd therefore you cant do it, or you will get a ticket. Be careful how many inches of freedom you give up to these money grabbing hacks you may find yourself unable to afford to drive and support your family for fear of jail because you can afford the fines.

Higher insurance has nothing to do with other driver's license records. Insurance companies raise everyone's rates BECAUSE THEY CAN GET AWAY WITH IT.

Just as NYS will always collect fine money, whether they have to fabricate charges or not BECAUSE THEY CAN GET AWAY WITH IT.

I say lets extort more money before people get 6 points....Let's start with 2 points system and also increase time frame from 18 months to 24 months in order to have more chances to catch people to get more points from corrupt pigs....Cops, law makers and politicians only know how to extort money from people but they don't play by the same rules because they are corrupt and above the law when they drive their private cars

I will email crooks aka law makers in Albany in order to give them more ideas how to extort money from people, I bet they will like my idea and besides it will make them look busy..

Anyhow...Initial 2 Points =$50 each additional points within 24 months is $25. If driver exceeds 4 points within 24 months penalty increases from $25 to $50 and if driver exceeds 6 points penalty increases from $50 to $75. If driver exceeds 8 points penalty increases from $75 to $100. You all probably can make better ponzi schemes then mine.

Finally the bonus when driver gets 11 points crooks aka law makers, politicians and cops hit a jackpot. They get to enjoy suffering of person who will now struggle financially and also the means of transportation for him/her does not exist any longer that he/she relied to bring home money. I personally rely on my car to bring bread home, without my car my family will suffer.

They get to revoke person's driving privileges and force him/her to pay up very high dollar amount just to give him/her driving rights.

Don't get me wrong we need point system but usually good drivers never get 11 points. At most I got 6 points for something very minor and I don't need to be penalize as driver I have to pay a high price ticket and with fees and surcharges....and sometimes pigs feel like giving people points for no good reason.

Bottom line its extortion that was design by certain people in order to make general public feel more miserable meanwhile they are above the law....none of those crooks will have to deal with drivers assessment program bs. You people naive or just stupid. Keep obeying your masters while they steal your freedom and money.....

Bam! You already get 6+ points on your license. Doesn't really matter what the bill of rights say or not, in the end its at the officers discretion, to do what they want... when they want.... which is pretty sad.
