The Oneida County District Attorney’s Office will be asking that an outside prosecutor look into the incidents of taped kittens found in the Whitestown Town Park to determine if the two matters are connected.

District Attorney Scott McNamara said he was declaring a conflict in the animal cruelty case – as well as a recent stolen property arrest – involving 19-year-old Joseph Sullivan because the teen is the son of Whitestown Town Justice Daniel Sullivan.

Joseph Sullivan was charged with misdemeanor torture in July after a Whitestown police officer found the teen alone with two kittens in the women’s restroom at the Gibson Road park after the park had closed. One kitten had its paws tied in tape, and there was a lighter on the floor, police said.

But after McNamara became aware Thursday that another kitten had been previously found in the same park several weeks earlier, similarly bound with tape and one of its rear paws burned, he said the July 3 and July 19 incidents should be investigated further.

“We are forwarding the cases that we currently have pending in our office to a special prosecutor,” which has not yet been assigned, McNamara said of Joseph Sullivan’s arrests and the earlier kitten report.

Although Whitestown police Chief Donald Wolanin said this week that his department concluded the two incidents weren’t related, McNamara added,“Because of the unique fact pattern in both, we would investigate that in our office and, therefore, we would forward those reports to the special prosecutor so he or she could look into it.”

Joseph Sullivan is due to appear on Oct. 9 in Oriskany Village Court, where the teen’s attorney plans to argue that the torture charge should be dismissed for not meeting the legal definition of torture.

In the meantime, Joseph Sullivan is also facing a more recent felony charge of fourth-degree criminal possession of stolen property, state police said Friday.

In that case, police said, Joseph Sullivan is accused of selling nearly $1,900 in stolen gold jewelry to a pawn shop in New Hartford on July 13 – just days before he was found with the kittens at the park. According to police reports, the jewelry went missing from a friend’s home on Cavanaugh Road in Marcy after Joseph Sullivan had visited sometime between July 8 and July 13.

The stolen jewelry was not recovered, however, because it has already been melted down by the pawn shop after being held for a mandatory seven days, police said.

Where's the cooking kittens proof? He could be a smoker or needing light to see his way to taping the cat in the dark restroom? Yous guys are way out of whack with this. What's worse is that a potentially innocent young man may go to jail because public pressure and politics saw to it- the people must have their blood. Kinda reminds me of how Scott Barnes got set up and put away.

Commend McNamara? For what being a corrupt and politicized douchebag? He had no choice but we see while this was 'under the rug' nothing was done by McNamara's office about transferring this kid or the possession case to a different jurisdiction. Yeah, sure, Scott is to be commended for realizing the word was out and finally after a few months doing the "right" thing to keep the last shred of credibility or freedom? And you wonder why people think upstate folks are a little daft do you? If you need this explained to you forget it.

Let's see if we can put this into perspective: The perp's name is "Sullivan," the Town Justice is named "Sullivan," the Whitestown P.D. Chief is named "Wolanin" & the Town Justice's secretary is named "Wolanin" (the P.D. Chief's wife). This must explain why there is NO CONNECTION between the two incidents of kittens being tortured, bound & left to die in a swamp because there cannot possibly be a CONNECTION between these four people either! Town politics? No way (yeah, right!)

This decision was made well before the newspaper said it. Just because the news says it doesn't mean that it happened at that moment. The people with the second cat just came forward yesterday for crying out loud. Give some credit - he is doing the right thing.

McNamara is doing the right thing. How about focus the attention on the Judge and why the kittens were turned over to him. Where are they now? Dead? I am sure. Makes me sick. Chief Wolanin's got a lot of 'splaining to do I would think. Would the police turn over a murder weapon or a bag of heroin to the family members? NO!
