I was unjustly terminated.I cant find a job.My wife is going without her medications.And we arent eldgible for food stamps.Also I have not received unemployemnt insurance as of yet.
Regarding my termination from The Utica Rescue Mission,212 Rutger Street,Utica,NY13501.I allege that my termination was in retailiation for my continued complaints of harassment,by a employee who was on parole.These complaints went unaddressed by Human ResourcesAnd this fellow employee continued his harassment.And continued to work at the mission.And continued to live on mission property. Each time I made a written complaint.It was followed closely by a written reprimand.As you will see below.In my emails ,and written complaints to Human Resources I stated I feared retaliation from both this employee and my superviser.

Approxmately,one year after I began employment.A parolee was released to the Utica Rescue Mission.To their RSP Program(Residental Stabilization Program).Soon after arrival this parolee became a employee.His position entailed him to work at mainly at The ParkerHouse Program.Which is next door to Emergency Housing.And in Emergency Housing. From the onset of his employment it was obvious to me,dealing with clients and fellow staff was very stressful for him.When his ill behavior was brought to the ParkerHouse Director attention..The Directors response was"He gets frustrated".This was my first indication that the director was making excuses for him.The second indication was say for instance.One of the clients failed to clean his eating utensils.Instead of the employee addressing the issue with that peticular client.This employee threw away all the clients utensils.And instead of reprimanding this employee.The director sent around a memo.Stating Any dirty utensils found by clients.Are to be bagged up and put in the directors office."It was obvious,the director was making allowances for this one employee.And thevother employees were being corrected for this one employees actions.
Another example was.As staff we had the authority of reprimanding a client.For say not doing their daily chores.As staff we were expected to be compassionate.And to take in account all circumstances as to why the client did not complete his task.Sickeness,etc. This one employee would reprimand a client so severely.Like taking his weekend home visits away from the client.When one peticular client went to administration.And complained of this ill treatment.A memo was passed around by the director.That any client reprimands are to be authorized by him.Up till then.We as residential staff had no problem.In excercising this authority over clients.But because this employee did not use sound judgement.

All staff were corrected.It was indications such as this.That brought me to the conclusion.This peticular employee was being treated differently,for some reason.At one time,this employee was also in charge of donations.That were given by the community,for homless clients.He would hand out abundance of items to one client he liked.But gave little to a client he didn’t like.All this was brought to the attention of the ParkerHouse Program Director,by me.Each time.The Director would make excuses for him.In one form or another.At this time.I believed this employee was either a good friend of management.Or he was a relative.At my termination.Through my research.I determined the relevance of this employee’s position.To The Utica Rescue Mission.
Now please note the dates of my complaints versus my writeups and termination.
April 13,2008 my first complaint against this employee
From this point on my overtime hours were reduced
July 18,2008 Written complaint against employee
July 19,2008 Called into Parkerhouse Directors office.Showed complaint against me by employee.In reponse I wrote"I believe this to be retailiation for my complaints against employee
August 20,2008 My first writeup
October 14,2008 My written complaint against employee
October 15,2008 My second writeup
October 23,2008 Written complaint against employee
December 9,2008 Written complaint against employee
December 20,2008 My 3rd Writeup
January 27,2009 Written complaint against employee
From January 27,2009 till Febuary 12,2009.This employee went on a leave of absence.When it was found that this employee was found to be conspiring with a client at Parkerhouse.To have another employee.Who had been one of the employees who came forward at the time of my first complaint.To complain of this employees same behavior.

Febuary 12,2009 Employee returned to work at Parkerhouse.
Febuary 18,2009 I met with the Executive Director and the Assistant Director concerning my termination.I presented each of them.With a 22 page document.That clearly showed my concerns,the pattern of complaints versus retailiation from my supervisors..Neither acknowledged or denied any of my allegations.Mr.Dodge did state at one point.He was not ware of some of my documentation.. Febuary 25,2009 I presented my case to The Utica Rescue Mission's Board Of Directors.Their response was that they gave me my PTO)personal Time Off)pay that I had accrued
March 13,2009 I met with Mr.Peter Scalise, Deputy District Director.Assistant to Congressman Mr.Michael Arcuri.To ask him if you would encourage the Utica rescue Mission Executive Director Bill Dodge to have this unjust termination expunged for my reason for leaving The Utica Rescue Mission.Because of this termination.I have had great dificulty securing employment.
Please review the listed dates of my complaints against this employee.Versus my writeups.And you will see the pattern of retailiation from my supervisors.

The state’s Re-Entry program goal is to reduce recidivism in communities and increase public safety through improved coordination and collaboration among local criminal justice, workforce development, social services, educational, health and mental health systems

."The mission of the Re-Entry Task Force is to use these state dollars to provide case managements and support services that help the State Division of Parole in its efforts to successfully aid inmates in making the transition from prison back to their home community," Picente said. "Oneida County participates in this state initiative because we believe that successful re-entry to society is important for the greater good of the community as well as the offender and his family."
"From a public safety perspective, it is important that offenders are reintegrated into the community because if they are not, they are a very real source of potential crime," McNamara said. "The justice system believes that people who have broken the laws must pay their debt to society. When that debt is paid, they have the opportunity to turn their lives around. The Re-Entry program is designed to help the community and the offender because the goal is the same – that people who return from prison don’t go back there."
The Oneida County Re-Entry Task Force functions in collaboration with the Second Chance Project operated by the Workforce Investment Board of Herkimer, Madison and Oneida Counties and the Oneida County Office of Workforce Development.
"When someone comes back home from prison, they have a range of needs and problems; what the Task Force does is help coordinate services so that we can address those problems and not let them become a barrier to someone finding work," said Workforce Development Director David Mathis. "One of the real keys to the success of this task force has been the support we have received from the District Attorney, the Sheriff, the Utica Police Department and all of our justice system partners. We all want the same thing – to help men and women who have made a mistake get work, keep work, and stay out of the justice system."
"Studies show that having and keeping a job is the best indicator of whether or not a returning offender will stay crime-free," said Alice Savino, Executive Director of the WIB. "The goal of Re-Entry is to help people who have one strike against them get the education, training, and support services they need to find a job, keep that job, and stay out of jail. The community also gains because we help local employers. Employers are always looking for people who will be motivated to keep a job, to stay out of trouble and to succeed. People who have made mistakes and are aware that they need to make changes in their lives can be the kind of workers our employers want and need."

Local and state agencies that work with or are part of the Oneida County Re-Entry Task Force include: NYS Division of Criminal Justice Services; NYS Division of Parole; NYS Office of Mental Health, NYS Office of Alcoholism and Substance Abuse Services; Oneida County District Attorney's Office, Oneida County Executive's Office, VESID (State VR agency), Regional Parole Office, Utica Police Department, Oneida County Department of Mental Health, Oneida County Department of Probation, Oneida County Department of Social Services, Workforce Investment Board, Oneida County Workforce Development, Rescue Mission of Utica, YWCA (operates domestic violence / victim programming), Johnson Park Center, Utica Municipal Housing Authority, Insight House (drug treatment), JOBS and HOPE (homeless employment program) Oneida County Continuum of Care, Mohawk Valley Housing Coalition, Mohawk Valley Council on Alcoholism/Addictions, Inc., Oneida County Life Skills Project // Oneida County Sheriff, Cosmopolitan Center- Fatherhood Initiative Program, City of Rome Weed & Seed Program, Rome Police Dept., Family Nurturing Center.
"The Re-Entry Task Force uses extensive collaboration and coordination among agencies and an outstanding spirit of teamwork to enhance community safety by promoting successful offender re-entry," Picente said. "With the support and leadership of the District Attorney’s office, the focus on finding and keeping employment that comes from our Workforce System, and the efforts of the community-based and faith-based partners that work with the justice system, we are working together to make the community safer."
This employee who is on parole.Represents everything that this program.Is attempting to do,in the community.The Utica Rescue Mission receives funds for their parole program.And is directly related to this Re-Entry Program.If this one employee who is on parole succeeds in reentering the community.After spending so much incarcerated.And remains employed.It would mean success for the mission.And in turn gurantee financial longetivity for The Utica Rescue Mission.

you can try to go to the state and make a formal complaint but I would file a civil suit and hire Leon Koziol. As far as immediate help, work with the doctor to get samples for the meds or pay for the generic at walmart $4. Go to the OCDSS and apply to emergency assistance, that will cover medical and housing, food. Not sure how you know you don't qualify for food stamps. If your not working and your wife isn't working, you may have to wait a few weeks, because they count the last months pay. This happens very frequently. However you should not of venting your personal information on the blog.

Judy Thankyou for your reply.I have contacted,the Attorney General,Congressman Michael Arcuri,Utica City Counsel,NY legislators,The Labor Board,The Charities Bureau for The State Of NewYork,Commissner Of Labor,and everone else on a political level.I will try DSS for financial assistance.I dont have anything to hide as far as venting.I found this happens alot in the work place in the State Of New York.NY State does not have protection for workers in the private sector.I for example can harrass you ,another employee.And as long as it doesnt have to do with religion,sex,or race there isnt anything you can do.Unless file criminal charges.And what private employer wants their employees to go to the police.That certainly will come back to haunt the employee making the complaint.Their is a legislative campaigne going on right now.See it at

BTW In NY state you can be fired for any reason or no reason at all. The fact that even unemployment turned you down is further proof that you are just a dirtbag. Go flip burgers if you really cared about your family you would work ANYWHERE and do ANYTHING. Hell even walking the streets collecting cans, anything. Attitude?Ok never judge a person until youve walked in his shoes.How would you act,if you found your wife crying because she had a choice to make.Her medication or food.How would you feel if you gave a million % to try and help others who came to the door of your employer.But then a so called Christian Organization turns you out.Because you would not put up with harrassment.And it was in their best interest financially to choose the other opposed to you.How would you feel once you found you dont have a legal leg to stand on so to speak because the state you happen to live in doesnt have any employment laws to protect you.Ive got reputable charcter refrences my friend that will attest to my charcter.You take on the responsibility of caring and looking out for approx.20 homeless clients.Trying to make a positive change in each of their lives.Going home and thinking every waking second of how you can make a change to help them.Can you imagine the emotional load that you carry around?Not because you were paid $10.50 an hour.But because you wanted to make a positive change in this world while you were still alive.Because when you go home to meet your maker.You will not be judged on how many times you read the bible.It wont be because you know your scripture.Your judgement will be based I believe on the way you have treated others.My wife and I will survive.Just because we have each other.Some how,some way God will look out for us.And he will seek out those that have been self seeking.Please dont judge me.I would not judge you,if I didnt know you

lol yeah I applied to fast food resturants,and very little mom and pop store.Im not too good to do anything legal for my family or myself.You dont know me,or what I have been trying to do!!I dont need to reply to comments like this.So I wont any longer.Believe what you will friend.
