Every post on here saying that Joe Longo was solely responsible and the city is not has got to be a city cop or a retired cop. Then if thats the case why did the city settle? Isn't Arcuri a top-notch crack lawyer to vindicate the city during the trial? I'm betting Arcuri recommended to the common council the city settle this or the cronyism that is rampant in the UPD will be brought to light, including Tubby's little escapade of taking the WRONG chief's exam. All that would've been brought out in the trial. What sickens me is all of Joey's cop friends still stick by him even in death saying what a great guy he was, and how his wife deserved it.

Palmieri has no say in who is or is not responsible, the law does. Judge Hurd's rulings based on the applicable laws pertaining to this case spell it all out WHY the City of Utica would be liable here. The actions of Roefaro, L:a Bella and Longo are their responsibility, but also as agents of the City, the responsibility of the City of Utica. IMO, Roefaro should not have been excused in this lawsuit since it was HIS appointment of La Bella in the first place that put La Bella in the position to allow things to happen.

Bottom line, they were legally agents of the City and the taxpayers are stuck with it. I don't agree with it, but its the law.

Its not the crime the City is held liable for, it is the inaction to make any attempt to intervene before that crime occurred. The City is held liable for not taking appropriate actions to ensure public safety from one of its own employees, Joe Longo. Steps that should have been taken to evaluate his fitness were not taken, and its those inactions the City is paying for. It was never an allegation, nor established as fact, that any actions the UPD could have taken could have prevented the murder/suicide. The lawsuit points out that NOTHING was done which might have prevented it.

If the UPD took steps to evaluate Longo, as they were legally required to do, and he still went off killing his wife and himself, the City would not be liable. But they did not....
