Lawsuits usually ask for extreme high dollar amounts. MAYBE, the City only could come up with 2 Million and this is why it was settled for this amount.

Remember, since the City is self insured, the 30% that pay all the taxes would be the ones to pay double the taxes we pay now if the amount had been any higher.

I agree with you - this was a clear cut case of negligence on the part of the City as Kristen's life should never have ended so viciously as it did at the hands of her policeman husband Joe Longo.

Maybe - hopefully, they will bring a Civil Suit for her death against LaBella for Wrongful death!!!!

It is absolute BS i am forced to pay this award out of my taxes. The kids get Social Security, a benefit was held, scholarships started. They should have filed the civil suit and called it a day. BTW, the City will probably end up paying that settlement as well

Whole thing is tragic, but I totally agree with this post. That it happened was sad; that this lawsuit appeared and was allowed to advance is ridiculous.

The family deserves every penny. But LaBella and Roefaro should have to pay for it. LaBella is named in his personal capacity and the court has ruled so. The city should have settled their end of the liability and let LaBella go to a jury for himself. They could have done so. But this just made sure that LaBella never has to pay a cent or take any responsibility. And no blaming Roefaro, it is Palmieri that just agreed to pay $2 million to save LaBella's arse.

And I wonder how much Arcuri and his firm were paid to represent the city for a couple of weeks. They simply came in and filed a brief and then said settle for $2 million. A lawyer just out of law school could have done that. The Corp Counsel's office could have done that. So, on both ends of this the same friends and family bunch made money. Only in Utica. Someone ask for the bill to Arcuri and his firm, along with a detailed billing statement. See how much they billed for their BS services.

From the beginning and when the whole fiasco began after the buy out of the contract with pylman and all the water board money spent and all the deals with chiefs tests and appointments ,,, how much did it all add up to cost the taxpayers. Could some one add it all up for me I lost count.

It has nothing to do with how much Utica can come up with. It has to do with what the potential liability for the city would be if this were to go to trial.

If you haven't done anything wrong then you don't settle unless the cost of defending against the allegation will cost more than the proposed settlement. If it can be proven that you did do wrong then you settle for the least amount possible. There must have been something presented that led to the Board of E&A and the Common Council to vote unanimously in favor of settling. It doesn't seem like it would cost the city more than $2 million to defend against the lawsuit does it? That only leaves one other possibility.

I don't think the city should have settled. I don't think they were responsible. If you would have put my on the jury the city would not have been liable. Maybe the family knew their case wasn't the best and figured why chance it?

A settlement represents a mutually agreeable compromise though doesn't it? Something that we don't know convinced the Common Council that it was better to borrow(with interest)$2 million and settle rather than fighting it in court. That says to me that it was the city who thought their defense wasn't strong.
The fact that you said if you were put on the jury you would have voted in favor of the city, before knowing all of the facts says a lot about the validity of your opinion.

The city basically paid $2,000,000 to keep this case out of court, and bringing to light how corrupt and sleazy the Utica Police Department is.

There was a documented pattern of abuse and harassment by Joe Longo, and all of this was covered up by the department. UPD officers continued to "take care of their own", and it ended up costing a young woman her life.

Adding insult to injury, a city in financial ruin now has to spend two million bucks that could have gone to paving streets or repairing sidewalks.

The amount of money the children will be awarded out of this "Settlement" will be small in comparison to everything they have lost and the emotional trauma the death of both their parents caused them and the relatives that took on the burden of caring for all of them.

Don't forget the lawyer's fees of at least 25% will be DEDUCTED from this award for all of his legal services providing this lawsuit.

Bottom Line: When it comes down to an officers job and their spouses rights, the officer wins. Unfortunately, you have no knowledge of the status quo internal corruption that has plagued the UPD for years. Let this be a lesson to the powers at be to ensure EVERYONE'S RIGHTS ARE PROTECTED!

If they took away his gun, had a order of protection, placed him in prison which they couldn't, an even as a psychiatric hold, this would have been outpatient.

So even with prison, with his release, SHE WOULD STILL BE DEAD.

I respectfully disagree (based on many years of legal training).

IMO - the City (represented by LaBella) was 100% responsible for allowing Joe Longo to remain on UPD's workforce as an active policeman. If a private citizen committed all the domestic abuse he did to his entire family, they would have been arrested and spent some time in OCJ. Why was Joe Longo treated any differently. LaBella did NOT earn the right to even be in the position of Chief of Police (political "mishandling by Roefaro) and protected Joe Longo who was a personal friend of his. Many other Officers would have testified that Joe Longo's mental state had deteriorated very rapidly during these family court hearings and he was a "ticking time bomb".

IF this case had ever went before a Jury, this lawsuit would have been awarded MORE than the 2 Million that it was settled for. I know if I was on the Jury, I would have voted for the Plaintiff - NOT the City of Utica!!!! They settled IMO because the City is in a near bankruptcy condition and the City would have had to declare bankruptcy if this case proceeded to a Jury Trial.
