Yes they are in Utica! They are even in the building I live in on Genesee Street! I have tried to get the manager to spray for them but am told by him that the tenants have to pay the exterminator $80 to get rid of them, even though New York State law says the OWNER has to pay; (and spray as many times as needed to get rid of them!) I would not be surprised if they were in the Rescue Mission, or any other large building in Utica. I have contacted the Mayors office, the health dept.,(NYS Codes, who tell me they have NO jurisdiction in Utica)and yes Utica Codes! Codes in Utica, I feel, is a joke. They are possibly in someones back pocket $$$. I called Codes 4 times to get something done,(months ago)and they haven't done anything yet! I myself have had small problems with bed bugs, but use home remidies to control them. Still, it is a problem visiting family members, not knowing if a critter has hitched a ride on my clothing and having to bring it to them! It is even more embarrasing when an Utica EMT takes you the local hospital and then plucks one from your pant leg, hoping YOU didn't notice!

and chris, why the heck should the landlord have to pay? they weren't there i am sure when the tenant(s) moved in, so how is it they bring them in, that now the landlord is responsible? the landlord is not liable. you got beddy bugs now? go sue the neighbor that brought them in. and yes, they are everywhere. genesee towers, the mission, the apts across from obliston, etc. what common denominator of the type of people these places have? sc_m..so you want to live that type of life, now you got yourself beddy bugs..enjoy..lol..

The owners of the building have to pay for any bugs/pest removals because New York State law say they have too.(I'm pretty sure ALL States have laws like this.) You can look this up under Real Property Law Sec. 235b. Also, there was a case in the New York State Appellete Court (June 21, 2004), in New York County, that sided for the tenant and decided that the owner of the property was legally responsible for the removal of the bed bugs, no matter how many times the place needed spraying. The case was Ludlow vs. Young.(NYSLJ, 18:1, June 21, 2004 - 4 Misc 3d515) And, because the tenant had to live with the bugs over a period of time, the Judge awarded the tenant a 45% abatement off the rent he paid during that time period! This case set president and is now the law! If you don't understand this, then I suggest you take a business law course at the local college!
As for those bringing the bugs into the building. They were here when I moved in and I was not told about them. This new law now also states that the managers have to keep a written record of ALL the apartments in the buildings they manage that have had problems with bed bugs or face legal actions against them! I strongly do not believe the manager of my building does this!
Bed bugs are a very misunderstood bug. They are NOT brought in by dirty or scummy people as you have suggested. They are found in the cleanest of places i.e. the Waldorf Astoria Hotel in New York City!(ABC, NBC, and CBS News have ALL reported stories on this.) Do you not watch the news? Most bugs are brought to the US unknowingly by those traveling overseas! SO the common denominator here would be people who can afford an expensive vacation are responsible for the bugs?
Now that I have given you the actual laws, and we know the buildings that have the bugs, can we now get the owners to spray these places and rid the tenants of this problem? If not, then I can start a rally with the tenants and start a class action law suit against the owners who refuse to do anything about these bugs! I already have a lawyer who is interested in handling my case, and with enough tenants siding with me, this will be the largest class action suit New York State has ever seen!

You people ate hilarious. Instead going through the proper routes to get rid of these bugs you just complain about it here. You know its the landlords responsibility to get rid of them but instead of taking them to small claims court which is extremely fast, you propose a lawsuit that will take years to complete. And you end up w $75 while the lawyer ends up w millions, have some common sense!!!

There are bed bugs in the theaters as well...also bed bugs in Best Western on N. Genesee St...recently had friends from out of town stay there and they were bitten fiercely! Apparently the owner has had rooms blocked off but never exterminated...opens them up and welcomes unsuspecting guests! With this mentality from establishments, the situation will perpetuate and never be resolved.

Seeing that the law is clearly on the side of the tenant on this matter, it will be their lawyers who end up with the $75 and the tenants splitting millions! Complain too much to the owners about getting rid of the bugs may result in you getting evicted and them still not doing anything about the problem. A class action law suit would gain much media attention and put the owners on the spot to do something!

First and for most, I would like to state that I am aware that everyone is entitled to their own opinion. Secondly, I would like to inform you that your slander isn't from your own experience, but that of word of mouth. I would like to mention that we take pride in our hotel facility and never ignore any situation that is brought to our attention. When we have a case of someone getting bit of any kind, we immediatly put the room out of service and call Pugliese Pest Solutions who comes in and does 3 separate treatments of the room over the period of one month. That room in question is NOT rented to ANY person until the solution has been fully resolved. Following a completion of treatment, we are provided with documents from Pugliese Pest Solution stating the date(s) of service, what was done, the finding(s), if any, and whether or not the room is ready to be back in inventory. If you are interested, please stop down and we will be glad to show you the documentation, for it is all on file. Feel free to call Pugliese themselves, they have a record of everything as well. Also, we are not "infested" with bed bugs. We have occurences, and we take action immediately. Bed bugs are a problem all over the world. Its travelers that are unaware they have them that bring them in. They are very difficult to see with the naked eye especially if they just hatched. It's not a matter of who has them and who doesn't, because the majority of hotels do. It's a matter of the action taken to prevent an infestation and taking care of the situation as soon as it is brought to our attention. We have an excellent plan of action that is followed here at our facility and so far it has worked tremendously. We do not lie when asked about our bed bug occurances, but we do inform people of the steps we take to resolve the issue. Honestly is always the best policy. Thank you for your thoughts and opinions.
