Former Rochester police Capt. Michael Leach is planning to argue that he was suffering from post-traumatic stress and sleep disorders when he awoke and shot his son in Old Forge last summer, according to defense documents.

Leach and his attorney, Joseph Damelio, filed a notice last Friday with Herkimer County Court stating their intent to possibly call three psychological experts at trial to argue that a mental defect should prevent Leach from being held criminally responsible for killing his son on July 21, 2012.

Among the conditions Leach, 59, suffered from, according to the defense papers, was sleep apnea and parasomnia, which causes abnormal movements, behaviors, emotions, perceptions and confusional arousals while sleeping.

Leach is charged with second-degree murder and due to begin trial on Monday, Nov. 18.

Leach, who at the time was a part-time officer with the Perry Police Department, has said he believed his son, Matthew Leach, 37, was an intruder when he abruptly woke up and fired his duty weapon into the dark inside their Clarks Beach Motel room.

On Wednesday, Herkimer County District Attorney Jeffrey Carpenter said he has not yet decided whether he will object to that psychiatric defense. But if Judge John Crandall allows Leach to submit that testimony, Carpenter said he would have the opportunity to have Leach examined by the prosecution’s own psychiatric experts.

“I’m in the process of reviewing everything,” Carpenter said, referring to supporting documents that he received this week.“It adds a new element to the case that I will address in my preparations for trial.”

Although prosecutors note that Michael Leach is not accused of wanting to specifically kill his son, the murder charge alleges that it was his general intent to kill another person, regardless of that person’s identity.

In Damelio’s notice to offer psychiatric evidence, the defense alleges that Michael Leach also showed signs of suffering from a dementia-type disorder that impairs the thought process and physical movements.

Among the doctors the defense said it might call as experts to testify would be a forensic psychiatrist to describe Michael Leach’s state of mind at the time of the shooting and other doctors to explain the results of Leach’s sleep study and neuro-psychological testing.

If this guy had these disorders then why was he still carring a gun. It should have been taken away from him. Plus, if they were just on a get away weekend why was it necessary for him to carry his gun with him. Makes no sence. I think it is a poor defense.
