all the marshall will give them is a 3day to demand payment. the l/l must file a court action, then marshall can serve those papers. so keep the 50/60 bucks you'll pay to the marsh and after 30 days, file a ct action

First, no her landlord is most likely not part of the 1%. I highly doubt the landlord rakes in over $660,000.00 a year and that's around how much you need to make to fit that bracket. Occupy is about fighting for justice so it's just common sense for Occupy groups to fight foreclosures, evictions and slumlords. Nobody else is. At least not locally.

As for fighting foreclosures, to answer your question - yes. Squatting is one possibility and there are squatters laws out there so there is some protection. The general answer is - direct action. Groups like Take Back the Land in Rochester and countless Occupy groups nationwide have been successful in fighting foreclosures and beating them. Foreclosures are only going to rise and I would say Occupy is your best local resource to find out how to fight, and how to win.

I am a landlord and I use month to month agreements, they do have to give a reason, the reason I use...I want to vacate the flat end of story. A month to month agreement is a landlords best friend.

You are correct except for the fact that the landlord shouldnt have done it in person. She's not actually being evicted that takes a court order. The landlord could technically scribble on a piece of paper if they want. That breaks the month to month if the tenant refuses to leave thats when you get the marshalls. trust me I've been through it all.

But she's not being foreclosed upon, she's simply been asked to move. The landlord has rights just as she does.

I'm going to shout this, because I waded through these ridiculous posts and I've come to the conclusion that people have a major element of selfishness running rampant in this country (this problem is nothing new throughout) renters seem to feel they can tell landlords what to do with their properties, renters feel they are "owed" by the establishment, and the laws are stacked MAJOR against property owners. It shows when landlords walk on egg shells around tenants hoping they don't upset them and then ruin the property, or stop paying rent all together. I say get your own house and see what it's like to have tax bills sent to your home, and repair bills, and upkeep, and mortgages too. Who does the property owner complain to? Mommy and Daddy? The government? YOU?

NO. But if your not ready to move after 30 days just stay and it will take another 30 or more days to take you to court to get rid of ya! It will cost the landlord big bucks too.....
