So who owns it? Can anyone explain? Why are we funding it if we don't own it?

I was told by one of the trustees that the library deed was in the name of the Town of New Hartford.

Are you saying that this it is not?

No its not. This first came up during a Town Board meeting.

The article says in part:
"Wiatr’s request for a legal opinion from town Attorney Herbert Cully regarding the New Hartford Public Library and its ownership was the most controversial.

The relationship between attorney and client, in this case the Town Board, is a main reason why Cully said he was uncomfortable in allowing his opinion to be released. Also, in potential future litigations, his opinion could be construed as the town’s view."

It is shocking, even for New Hartford politics but the town does not own the library and the town board refuses to even reveal who does.

Why would the town refuse to release the opinion? I think the town needs to let the public know whose name is on the Deed. WE the people have supported the library and it now is suspicious that the town is guarding the opinion for whose benefit?

If the town does not own the Library then who pays property and school taxes for the Library. Since the town does not own the property or business then why would it be exempt from paying taxes. Are back taxes now owned to the town?

According to the IRS it appears the NH Public Library is a public charity. It appears there are two EINs associated with the NH Public Library:

22-2141661: New Hartford Public Library
80-0163258: Friends of the New Hartford Public Library

If you search for the IRS 990 using the following web site:

IRS 990 forms are only available for EIN 22-2141661:

So the so called "friends of the New Hartford Library" are the owners of the library??? Who are these "friends"???

I just looked this up. Very interesting. On the Library's IRS form 990 under block 1F for "Name and address of Princible Officer" it just says "Officer". It has no name listed!! So, who owns the Library??

Section VII (Page 7) of the IRS 990 lists officers and trustees. There are 4 officers listed... So the Officers of the board own the Library?

That's a good question. Who owns the library? Is it the "Fiends of the New Hartford Library" or is it the Library Board of Trustees.

So let me see if I understand this: if the rechartering vote passes last year we would have transformed a private charity ie The Friends of the Library, into a quasi governmental agency with the ability to tax NH to the tune of 1 million dollars a year guaranteed!!! What a deal!

I found this which would indicate the library would have been converted to a school ibrary...

No, that was one of those misconceptions. The library would only have been called a "School Library" because it's boundary's of the area it can tax would have been the same as the NH school. Otherwise, the library would not have been part of the school district and it would have its own separate budget from the school. Here's another interesting fact of rechartering: If it had passed, the Library would have been able to approve bonds for the library without taxpayer approval although the taxpayers would have been on the hook for the debt.

While searching about the New Hartford Library I found they recently donated money to a charity. While I am sure the charity does good work, my concern is why would an organization with financial problems be donating money they apparently do not have? Did the full Library board provide the approval to donate Library monies to charity? Under the donor section, there are donations provided by both the New Hartford Public Library and Friends of New Hartford Library.
