In a unanimous, scathing decision, the 2nd Circuit US Court of Appeals once again overturned Judge David Hurd (Federal Court - Utica) regarding his extremely biased ruling against NYS Police CNET's arrest of Dean Steppello - local cocaine dealer.

They cited Hurd's refusal to acknowledge the totality of the circumstances that clearly established probable cause for arrest.

They cited his refusal to reference their previous overturning of his decision on very similiar circumstances - even after being reminded of it by the prosecuting U.S. Attorneys.

They even took the unusual step of stripping Hurd from hearing the case from here on, citing his obvious bias against the police.

Rocco's OD article was mostly fair with respect to delineating the information in the reversal, though he did quote not one, but two defense attorneys who were obviously going to disagree with the appeals court due to their motives. His article didn't go quite far enough, however, in absolving the troopers who are now completely vindicated in their investigative actions, contrary to Rocco's original article on this case, which made it appear that this scumbag's rights were violated while he was delivering a cocaine order.

With judges like Hurd, and media outlets like the OD, does anyone wonder why the police are so reluctant to pro-actively go out and do the right thing???

wasnt this case dismissed in county court also ?how come rocco didnt ask hurd what he thinks? i would love to hear what he thinks.. with all the wrong police have been doing in our county and city state levels he made the right move? cant blame him you have to blame the officers why does hurd have to take the heat because of bad officers and bad police work wasnt the drunk matt sullvian on this case the officer who drove drunk and held up in his home for three hours he was prob high on cocaine to run and lie to his fellow officer who clearly asked him was the car behind him with him and he said no then took off like a criminal would and would not stop the more i think about it and all the bad officers in our city doing wrong sounds like hurd made the right move

Hurd was completely bashed by superior judges for doing the wrong thing. They (100%) upheld the actions of every officer involved in this.

David Hurd is a complete disgrace - once again.

i know i dont want cops doing what ever they want like cowboys and then they walk when they get into trouble? wow they didnt even get a sale and he was arrested? and they didnt even ID the guy... wow something is wrong here .. hello america the police are doing what ever they want..people who are not even idenified will be arrested? unbelievable.... this was prob a way for the judge to have the brass punish the officers involved in the case but we all know they wont be punished didnt the same officers do the same thing with correction officer steroid case

LOL i was checking out the case and seen the names of the 3 judges and they are all X DA's district attorneys are you kidding me? whats right is right whats wrong is wrong they didnt even ID the guy i dont need to have grammar to understand that ? are you kidding me you must be a cop

the question isnt is the guy guilty or innocent its did the officers do wrong and break the law arresting someone they didnt even ID ? one of the oldest laws on the books? oh yeah a law that has zero punishment ZERO and people go to jail for codes violations i dont need to have grammar to understand this? judge hurd was sending a message he knew the pannel would overturn him

This seems to be his pattern lately. He will rule a certain way to insulate himself from local politics and let the 2nd circuit takeover. Afterall, the guy doesn't want to be the only one attending his retirement party someday.

its sad our system works this way but it does for all we know this steppello guy was prob set up? i heard his x laywer george aney put in a motion to test the cocaine why would he do this did he believe the powder wasnt cocaine? come to think about it his lawyer aney quit him and defended matt sullvian ? wow this steppello carciture has been getting scrueed from the get go

they based it on phone calls ? they never ID the guy ? their is no way in hell that the officers knew the calls where comeing from the person walking up a driveway who they didnt even know and didnt even see...lol? the judges admitted the officer didnt even see the guy because of fear he would see them ? a person they never seen or even ID.. wow sullvian said he tracked him but ended the persuit this is the same drunk officer who lost his job with nystate police and then recived his job back in another town or city because of his testomany in this case please i know how the system works and they all are covering for each other

I think not!

David Hurd's fellow judges and contemporaries have once again found him to be completely biased and wrong. Must be embarrassing.

really use your brain how hard is it for a cop to let them meet sell the drug and then arrest him right then and there or weeks down the road ? they arrested him in the guys driveway and didnt even ID him?? so they didnt care about anything not even the CI/confidential informant they arrested the guy in the driveway so this "szuba" guy is far from confidential? something went wrong ? we all know their are rats on topix.. answer this question ? have you ever seen a deal go down like this EVER????
confidential informants police officers use them FOREVER and never let the guy know who he was its always a guessing game who did it

every officer out there and DA and judge worth his grain of salt knows this judge does not deserve this and he did the right thing involveing this case... you are wrong in letting this happen even the officers who are going along with the lead investgator involved in this case other judges and officers with not respect you for letting this judge recive a bad name for upholding the laws of the land you will not have honor and it will hunt you forever in my eyes this judge did the right thing
