the OD is sensationalizing the issue(??) once again. Nowhere did the article indicate by fact that the grant would be in danger of not getting awarded. It's purely speculation on the part of Mr. Humphreys and as usual picked up and ran with by the OD.

As for the town suing Concerned Citizens, that too is hogwash. CC is suing the town. Is the town defending Fairbrother--yes, they have to and they have insurance for that purpose. As far as Fairbrother's countersuit, she would and presumbly did hire her own attorney.

Actually, the town is paying for Fairbrother's attorney in the countersuit...Herb Cully said so at two town board meetings when he was questioned about it.

Former Town Bookeeper Fairbrother is suing the Concerned Citizens and the Town of New Hartford is providing her a free, taxpayer supported lawyer to do it. Make no mistake, the Town of New Hartford is suing the Concerned Citizens in order to shut them down. If that wasn't true, then why was New Hartford Town Attorney Herb Cully present in court a couple of weeks ago when Fairbrother's lawsuit was in court. I wonder if as a Town of New Hartford resident I can get free lawyer too provided by the town. This is going to be a big embarrassment for the Twon when Fairbrother's lawsuit gets thrown out.

Using your analogy, anyone who files a lawsuit against a municipality is a nut bag. Must be the NH Village government is full of nut bags because they likewise filed a lawsuit against the town.

NEW HARTFORD —

Town Bookkeeper Carol Fairbrother is fighting back against allegations that she illegally sought requested $71,544 in back overtime payments she was not entitled to.

She is seeking at least $3 million in damages for defamation.

In a legal document, served against the local watchdog group Concerned Citizens for Honest & Open Government, Fairbrother’s attorney contends that the group has “negligently and maliciously published false statements impugning Carol Fairbrother’s character, integrity, honesty, trustworthiness and ability to perform her job.”

The document is counter claim against a lawsuit the Concerned Citizens filed against Fairbrother, the Town of New Hartford, and some present and past town officials.

The counterclaim quotes extensively from the Concerned Citizens’ blog, www.newhartfordnyonline.blogspot.com and also statements made by the group’s co-founders in stories in the Observer-Dispatch.

The O-D has not been named in the counter claim.

It also states that evidence that the Concerned Citizens have exposed Fairbrother to “public hatred, shame, aversion and disgrace” can be found in the comments on both the Concerned Citizens’ blog and the O-D’s comments sections on related stories.

Concerned Citizens co-founder Catherine Lawrence declined to comment on the counterclaim.

Fairbrother could not be reached.



The history

In December 2008, after many years of lobbying town government, Fairbrother was given the payment of $71,544 to cover back overtime from the years 2002 to 2007.

The payment was made despite the fact that Fairbrother had been given a $10,000 raise in 1999 when she took over the town’s payroll function. In the resolution that enacted that change, it clearly stated that she would not be entitled to overtime.

In their lawsuit, the Concerned Citizens allege that Fairbrother knew the overtime payments were illegal and that the overtime payment was “in effect a bribe for her silence in known town accounting irregularities.”

Fairbrother also began receiving her pension in 2007 without a formal break in her employment with the town as required by law. This year, Fairbrother is set to collect a pension of $42,696 in addition to her $58,714 salary.

The legal side

The town of New Hartford’s liability insurance is paying for both the town’s and Fairbrother’s defense against the Concerned Citizens’ lawsuit, Town Attorney Herbert Cully said.

The insurance is paying for Fairbrother to have a separate attorney from that of the town, he said.

New York City-based attorney Carl Sandel, who is representing Fairbrother, said he stands by his counterclaim.

“If I didn’t believe it was valid, I wouldn’t have served it,” he said.

Never once did I say those who sue the town are nut bags, I was referring to only the concerned Citizens party of two. CC lies include that the town is suing them. it appears only fairbrother is.

First of all, I have never read where CC said that fairbrother is suing them. Second of all, if the town is paying the bill, guess who is suing them. Not Fairbrother, but the town and the town taxpayers.

If there are only two of them, why are so many people trying to take them down by trying to discredit them? Sounds to me like you are all running scared!

3. suing for reduction in tax assessment (ED, back a few years ago)

1. Lawsuit against the town was to recoup lost town monies; read the article in the OD; CC will get nothing from it.
2. Nuisance FOILS? you have to be kidding. You can keep your head in the sand if you want, but personally I am glad that CC has made these documents public. They should have been public information to begin with.
3. Reduction in tax assessment...it is EVERYONE'S right to grieve their assessment. Just because a member of CC did it, you think that makes it wrong? Shows just how little you have against them other than your own narrow-minded point of view because you are probably one of the ones sucking the life out of NH taxpayers.
4. Numerous Notice of Claims which increase the town's insurance costs...sweetie, check with the town clerk. There are many NOC's and lawsuits and they are not from CC. You should be sure to attend the town board meetings in May so you can hear the representative from the insurance company talk about the risk level for the Town of NH. NOCs do not increase the town's insurance unless they turn into a lawsuit that the town cannot defend!

You are grasping at straws and obviously one of the good old boys. Calling people names with nothing to back it up sounds more like you are the bully. Hiding behind your computer to make these claims leaves little doubt that you are a bully.

Good Post! I'm going to attend the May meeting myself and talk to the Town Insurance agency. They will either canacel the policy ro raise the town's rates. I want to know why they are paying for Fairbrother's lawyser when she isn't even a town employee. This will be a hoot

They already do. You might be too late there is already someone other than the "CC" group investigating th etown already. They were at the county bld asking lots of questions last week and photcopying 2 boxes of papers.
