Marcy woman loses land to Mohawk valley edge ? news is late? because of eminent domain ? i would have ether fought it to the end ? i would have made an agreement that they cant sell it to anyone else but the chip company and cant piece it out? or i get it back at the fair market value period...also the chip company cant sell the land or piece it out or sell it///and to only sell it to her or family members? or make sure my family members get good jobs at the plant ? in the end of that deal she would have made out well ?? WHO WAS HER LAWYER ? HE DIDN'T EVEN WANT TO SPEAK OR BE ON CAMERA ? HOW COME THE NEWS IS REPORTING SO LATE ? ON THIS

When MVEDGE was looking for site for Federal Express building they found land owned by a relative of MVEDGE Staff and that family was able to SELL their property for HUNDREDS of Thousands if not Millions ( I don't remember exactly how much).. Worthless land because very valuable to a person with relatives on EDGE. This board should have been eliminated long ago.

Edge has sucked millions of dollars out of this area for this imaginary chip plant that has been in the works for what; over 30 years? Sometimes they talk about this Chip Plant like it exists. Who’s picking up the mail at “The Chip Plant”? Twenty-five or thirty years and all there is to show for that money is grass that needs mowing LOL. I think the Chip Plant is Edge’s version of Utica’s “Master Plan”. Oh sorry. Utica’s Master Plan rough draft number 25.

The sad part is the chip plant will never happen because the Army Corp isn't going to allow them to disturb protected wetlands without a company committing to move there. And no company is going to commit to a site that is not shovel ready.

This is yet another taxpayer funded mess that EDGE has created. EDGE shows how it is actually possible to get a negative return on investment.

Grey area. Unless the subsequent sale terms were part of the agreement she signed, she has no say in what they do or the timetable for doing anything.

However, if they do something besides the chip thing with the property, or it becomes clear there is no chip thing, she might have a fraud claim. But there is a statute of limitations so if they wait long enough, no fraud claim.

could she put in a "notice of a fraud claim" that she will be perusing so that she could file a claim before the statute of limitations ends... sorry if i dont know the right terminology

The normal procedure is you file with the court, and serve on the other party, a Summons & Complaint. The Summons initiates the action, establishes jurisdiction and calls the other party to appear. The Complaint specifies the allegations you are making against the other party.

She could serve a Summons right before the statute of limitations expires to save her claim and initiate the action. But she would have to file and serve the Complaint within a specified time by law. I know its 180 days in other types of litigation. I'd think that applies to all types litigation but I'm not sure.

That's the best she can do to take the longest amount of time to preserve her claim.
