Damn right. They managed to keep the St Es Dr Page hit and run dwi and shitcanning out of the papers but it was same day news here and 100% accurate. I come here for news. I'm careful to take it with a grain of salt but more often than not its accurate. Why? People can't wait to spill the beans.

Lets tell it like it is, she wanted a disability so she don't have to work and collect a check. She was turned down at an arbitration hearing. An investigation by the DAs office cleared the fire fighter named. Well what is there left to do? Try and get the money from the City. A Utica firefighter and her husband are suing the city in a $7 million federal lawsuit alleging that her civil and constitutional rights were violated after she reported being sexually assaulted by another firefighter in 2010.
The 18-page lawsuit accuses the city and its corporation counsel of failing to conduct a fair and thorough investigation into the woman’s sexual harassment claim against firefighter Michael Knapp.
The lawsuit also alleges that the city retaliated against the woman by trying to punish her for her related anxiety and by not taking steps to guarantee that she would not encounter her alleged assaulter while both were on duty.
The O-D does not identify victims of alleged sexual assaults.
The woman’s lawsuit revolves around the allegation that Utica’s Corporation Counsel was acting under a conflict of interest when it took over the sexual harassment investigation instead of letting it be handled internally by the Utica Fire Department according to past general practice.
The conflict existed, the woman’s attorney, Frank Policelli, argues, because the city’s corporation counsel took on the responsibility to evaluate two intertwined matters: whether Knapp should be disciplined for his actions and whether the woman was entitled to disability benefits for any stress-related medical conditions.
Following those proceedings, Knapp was found not guilty of the allegations and the woman was denied compensation. Both continue to work full-time with the department.
Knapp could not be reached for comment, and the attorney representing the Utica firefighters union, Ronald Dunn, did return multiple calls seeking comment.
The woman alleges in spring 2010 she was on a 24-hour shift when she was awakened by Knapp, who worked the same shift operating a city ambulance out of a different station, according to the lawsuit.
The woman said she heard Knapp calling her name right before he exposed himself and urged her to have a sexual encounter with him, the lawsuit states. When the woman expressed her “shock and rejection,” the lawsuit continues, Knapp allegedly put his hand over her mouth, pulled down her sweat pants and attempted to climb on top of her.
The woman screamed at Knapp and managed to “fight him off” before he left, the lawsuit states.
The “embarrassed” woman did not immediately report the incident until her partner and husband asked her what happened. With her husband’s assistance, the woman recorded a phone conversation with Knapp during which Knapp made “incriminating admissions,” according to the lawsuit.
The woman’s husband then provided a copy of the recording to Utica Fire Chief Russell Brooks, and she filed a formal complaint against Knapp on Sept. 8, 2010. Brooks declined to comment on the matter.
The Oneida County District Attorney’s Office did investigate the incident at the time at the request of then-Utica Public Safety Commissioner Daniel LaBella and the woman’s husband. In the end, prosecutors believed there wasn’t enough evidence to bring any criminal charges.
“In order to proceed ethically, we have to have evidence that we feel would substantiate the charges and ultimately support a conviction, but we just didn’t feel we had that evidence,” District Attorney Scott McNamara said.“That does not mean that it happened or it didn’t happen, it just means that we didn’t have the evidence.”
Although the woman never was “enthusiastic” about seeing Knapp prosecuted, Policelli said, the “sham” administrative hearings offered by the city left her no choice but to have the civil matter heard by an impartial federal judge and jury.
Utica Assistant Corporation Counsel Armond Festine, who is being sued along with former Corporation Counsel Linda Sullivan Fatata, called the woman’s lawsuit “frivolous.”

Depending upon how far they wish to carry this frivolous lawsuit, those arbitration awards are likely to become public at some point.”
In response, Policelli said Festine ignores the inherent conflict of interest involved, including prior disputes between Festine and the woman’s husband and the fact that she passed a polygraph lie detector test.
“Neither hearing was full and fair, and his statements raise disingenuity to new heights,” Policelli said of Festine.
“When the same lawyer conducts a hearing on Knapp, while at the same time defending the city against her disability claims that stem from her sexual harassment by Knapp, you can’t have more of a conflict of interest than that,” Policelli added.“If he thinks this is frivolous, then he’s going to cost the city a heck of a lot more money than he already has.”
