The Utica Fire Department, as instructed by the City is conducting fire inspections on peoples homes. These inspections involve counting smoke detectors and looking at the location of the detectors. The inspections are also looking for various "hazzards"
This, in my opinion, is unconstitutional and an example of unfair search. The fire department is going into homes that are old and have not been recently renovated. Therefore, there is no groun in existing law for a building inspection.
Also, instead of using a small vehicle, the fired department is doing this in a large fire truck. If there is a fire, this truck is out on an "inspection," not at the station ready for a call.
Does anyone else have a problem with this?

I believe it's a forth admendment violation to require a government agency to come and inspect your home. who knows what else they are looking for and whom they report what they see.
the gov seems to be taking all of our rights away and giving them to terrorist

now that the inspections are being handled by the fire dept,what happens to all the codes inspectors who never had any ability but political connections.Maybe they will end their trips to the culver ave nice n easy on a daily visit.

I can sort of understand Rentals, but a private home?? I don't think so. I have never lived where the fire dept. ever can in my apartment. Hallways of apartments, laundry rooms. But the apartment was off limits.

ufd just trying to keep people safe,making sure landlords have smoke detectors apartments are kept up and livable.Nothing wrong with playing it safe benefits .

I believe any inspector that looks for code violations has to be state certified.I don't think UFD has any state certified inspectors.What they are doing I believe is illegal,and it should be challenged.

I too can under stand rentals too a degree. as in getting a "certificate of compliance" inspection BEFORE you can rent an apt out. but owner occupied 2 families were exempt. but I hear now they are going after them in South Utica (well before finihing up the big multi apt in cornhill) where they are not rental units, but parents downstairs, and their son or daughter and family are upstairs. and they going through both families homes like storm troppers, checking every room, making notes.

You do have rights and you do not have to let anybody in your home that you live in, however multiple dwellings 3 or more, I believe they have the right to inspect as long as they show you a state cerification that the person who is inspecting the premis is certified and qualified.

Wrong, anything including a two family that is rented to anyone other than a family member is subject to a Rental Property Inspection. You are right you don't have to have the inspection, then don't rent your property, The Common Council voted it law for the city of Utica, YES it is legal,Cry to them

This law serves a few purposes, it raised money for the city so they can hand out bonuses. Codes workers each got $1,500 for raising over $125,000 in fees even though they only raised about $115,000. But who cares about standards anymore. The ufd can now single out drug houses and demand to go in or have it 'shut down'. Pretty slick law but whos to say it won't be applied to just anyone they don't like. Lastly they love to look like they are doing something. As long as you have a fresh coat of paint on the place it will pass...

Not to mention the UFD cares more about what you have then the condition of the place. I was asked more questions about my artwork and living room than anything else.
