If there were witnesses that saw her drinking until dawn of that day, I think that goees beyond hearsay. If this is thrown out because of all the legal wrangling, shame on the prosecutors for dragging their feet on this. I'm not expressing whether I feel she's guilty or innocent, but this should go through due process.

The prosecution properly obtained her cell phone, and the text message that morning to her friend show that she believed she was drunk. That, in itself, is admissable, as either an excited utterance, or as a lawful record, and it is a statement against interests. Weren't the original manslaughter charges dismissed at the magistrate level? Does the 365 day clock get re-set when that happens? And finally, isn't it interesting that the state legislature comes down on the side of the defendent so often?? Who in the state legislature pushed through the 365 day rule? It would be interesting to find out.

Great ?'s lakerman1. I'd also like to know why she appears to have not been charged with underage drinking from last Saturday's incident. Why isn't she sitting in jail right now - she violated the terms of her bond. Most people out on bond go back to jail for lesser violations - she had three - curfew, alcohol and underage drinking. What the hell is going on?

Why is this girl getting away with this? She should be in jail NOW after her drunken binge this last weekend!! Had that been my kid who did that, she would already be sitting in prison!!

This girl is a defense attorney's wet dream. Even if she gets out of this one on technicalities, she'll be back in trouble with the law. She can't seem to help herself. Local law enforcement is going to be very tired of her.

That's completely rediculous. I have a friend of a friend who was there the night it happened and she was totally wasted on drugs/alcohol, spending her precious time with this guy. Unbelievable how 2 kids could perish and leave a family torn and this girl walks. where the heck is the justice? At least we can take comfort in knowing that when judgement day comes, she will have to stare in the face of God and face her sins.

District Attorney Brad Foulk should be fired. He's probably on the golf course for the summer.

The defense had a hand in the delay, this is just a defense tactic, and no judge in their right mind would toss the case.

If this is true, a cold-blooded murderer can walk away scott free if the prosecution takes to long in performing their job. Just think someone like Saddam Hussein or Adolph Hitler will be able to continue their carnage due to the stupidity of our legal system.

PEOPLE!!!! Why isn't anyone coming after the parents of these little girls. As a mother of two children I would of never left her with these children. Shame on the parents. What are they being charged with? I use to camp with one of these dads and let me tell you, he had his share of alcohol all the time, so is this a case of someone only doing what she saw growing up. Maybe she thinks this is normal. Don't get me wrong what she did was wrong. But, I think she will pay for what she did for the rest of her life. As a mom how would ever be able to send your daughter to jail???? I think everyone involved in this case should be held accountable. I think something VERY BAD happened and they are just venting their pain out on someone, and I think these people know deep down in their hearts it was their fault. But, on the brighter side those two little girls are in the greatest place. Heaven

There is no greater punishment than the loss of your child at the hands of someone who has shown no remorse. She got on with her life hours after it happened, by going out to a dance club. She hasn't looked back at all. The families, on the other hand, are the ones who have to live with this forever. And saying that because John had a few beers now and then somehow absolves Brittany of responsibility is ridiculous. She lied to everyone involved, and she's still lying, all to protect herself.

You obviously don’t know the heartache Maggie’s parents endured to have her and that they would never intentionally put her in harms way. They knew this girl from the time she was little and had no reason not to trust that she was telling the truth that she was okay. Maggie’s Mama gave her three chances to get out of babysitting and all three times she ASSURED her she was okay. She even gave her her cell # to call if she felt too tired. NOW she has to live with the constant turmoil of knowing she trusted someone who didn’t deserve her trust. They live with this hell EVERYDAY so before you go judging them, think about how ridiculous that is. Someone who prayed for and wanted a baby so badly for so long, why the hell would they throw that away. Maggie’s and Jenna parents are VICTIMS. They lost their children and their lives that day. They will never be the same. Having people such as you judge them only adds to their pain. They don’t need it, they don’t deserve it, so think the next time you write something such as that. So what if her Dad had a beer, he is over 21, did you EVER have a beer? Would it be YOUR fault if one of your children grew up and killed someone while drunk???? Listen to how incredibly stupid that sounds. Look at how she has responded to this, going out and endangering another unborn soul, HER OWN!!!!! Is that John Walker's fault too? You can't imagine the pain and I pray you never have too. You mock the Walkers and the Kovskis. I was at the gravesite yesterday, nothing was ever more emotionally draining then seeing those two miracles and the love that was so obviously pouring from the site. How DARE you.

I see you knew who I was talking about. I don't know what John you always saw around. I always remember growing up knowing his little pack of guys he hung around as very heavy drinkers. Not just a couple of beers. His step-daughter is living his life he had at that age.

Like I said in past postings, If she had to ask 3 times if she was ok to watch those babies she knew there was something wrong. Plus she left her cell number come on. I would of never left my child.
