Statement by Dan Monnat and Kurt Kerns, Lawyers for Chad and Shannon Floyd In Response to CBS “48 Hours” Primetime Broadcast

“One year ago, the State of Kansas dismissed all charges against Chad and Shannon Floyd after two
laborious trials in a case originally filed by former Attorney General Phill Kline. The prosecutors correctly realized that no jury would convict this innocent couple, and that a third trial would gain nothing and do more harm than good in this small farming community.

“The Floyds and many residents of Stanton County had hoped that the dismissal would put an end to
the malicious gossip and veil of suspicion that had divided and exhausted their community ever since Michael Golub disappeared. But just when the healing had begun, CBS producers from 48 Hours came along and re-opened the wound for no greater purpose than the network’s own commercial interests.

“Chad and Shannon cooperated with law enforcement and answered their questions during the
investigation. Chad and Shannon presented their case twice in court, so they had no reason to rehash the ordeal again for the gratification of some ratings-driven reality TV show. Chad and Shannon wished only to put this case behind them and focus on their children, and they asked that CBS leave them, their children and their community alone.

“Trial by TV is an insult to the innocent and a sad day for justice. CBS’s 48 Hours program is pure television entertainment—the more sensationalized, the better. The program’s take on the Floyd trial was like its treatment of most cases—inflammatory and grossly incomplete. In its commercial-filled hour, 48 Hours could never fairly portray a case that took nearly a month to try in court. But, here, even the private eyes hired by 48 Hours couldn’t agree on what happened. That’s a far cry from proof beyond a reasonable doubt and exactly how innocent people get wrongfully convicted.”

So, was there a lie detector test done? How much time was spent searching the area for the body? Those two are guilty in my opinion. Why did she all of a sudden have him come pick up their son at her house? Then, he disappears the same day? You are trying to tell everyone that that was just random? How about the blood on the porch? They didn't even find dna from the people who lived there. I dare you to go to court in another town or city. They would be guilty in a matter of hours. I wish I would've been on that jury. There was no way this guy just skipped town; He had no reason to. But, his ex and her new husband had all the motive in the world. This is crap. Also, you want to talk about 48 hours only doing this for the money, take a look at yourself first. You are a defense attorney for 2 guilty people. Talk about doing it for the money. How do you live with yourself knowing you have gotten guilty people a verdict of innocent? It's okay though, karma will come around, to you and them. May Mike rest in peace, and know he will see his children again one day. My thoughts and prayers go out to Mikes family. OH, and, P.S. what kind of mother refuses to let her son see the other half of him. He wasn't made by just her. She should be ordered to let Mikes family see little Mikey.

Furthermore, have they searched the couples cars, trucks, atv's, work equipment for traces of Mike? Did they swab the truck for dna from the couple? Have they used dogs to search the area? Have they used lights to look down the wells? A lot of time has passed since his disappearance, but they can still search. There would still be remains. Justice needs to be served!

I just watched the case on 48 hours online and I am outraged!!!! I have watched and read about a lot of murder cases but this is definitely one of the most ridiculous cases E V E R!! I can't believe that these "people" (are they even human beings with a conscience??) are still walking around out there, continuing with their lives after what they have done??? The police investigation, if you can call it that, was a joke and trying the case in that little city with jurors FROM there..I can't believe it! In my opinion, they didn't have the guts to do the obvious: FIND THEM GUILTY!!! I am so sorry...SO SO SORRY...for Michael's family and himself of course! I'm so upset that they had to go through that, not only losing someone dear to them to murder but also having their loved one's killers still out there AND not being allowed to see their grandson. It breaks my heart, I wish there was something I could do to help them.
I'm 100% sure that they killed him and justice needs to be served!!!!!!

Chad Floyd's family has money and that's what decided the outcome of this trial...money. That's why everyone who's in prison or at least 99% of them are low income and unable to afford a perjuring lawyer.

To Mike's big sis:
You are accusing them of murder!!! They are telling you that they are innocent!!! Shannon would be absolutely crazy to turn her child over to anyone who is still accusing her of murder, grandmother or not!!!
I have no clue if they are guilty or not but I do see why she won't allow you to see Mikey. It's sad but you have bad mouthed her continually on this site. Why would she have any doubt that you wouldn't criticize her time and time again to her son if you had a chance?

I wish you guys God's Speed and a rigtheous ending (retrial and conviction of these murders). I can not believe with the evidence presented as I watched the 48hrs program that these two people were not convited. I am so very sorry for your family and will pray that all turns out as it should. Again, I am so very sorry for what your family has gone and is going through and for what his son is going through and will go through for the rest of his life (which obviously the killers did not care about). I will pray for you all.

Saw this today, 2/13/2011 on Investigative ID. What the jurors were afraid to do, God will do. So, so, so sad. I'm sure Chad and Shannon will be in the papers/news again soon. What goes around, comes around.......their actions will boomerang!!!!

To Dan Monnat -

I am 99.99% sure that you conspired to reach a hung jury. Like many others have said, you would never EVER reach a hung jury anywhere outside of Kansas. Here's the bottom line evidence:

- Mike's DNA on the porch...hidden under the floor.
- No one else's DNA on the porch.
- Mike was never allowed to pick up his son at the house.
- Chad just bought a gun prior to Mike's disappearance.
- They tried to make it look like they paid Mike off but this was proven to be fraud on Shannon and Chad's part.
- Shannon and Chad are liars under oath or under sworn testimony and thereby committing perjury.
- A witness informs the court during testimony that Chad told him [the witness] he could get rid of the body and no one would ever know...dump him in a well.

What more evidence do you need tough guy? I would rip you to pieces in a jury down where I live. You would not last more than one trial before going back to KS.

You, the jury, Shannon, Chad and even the Floyd's will eventually get the appropriate punishment, plus interest. Remember...judgment from G-d is retroactive.

I feel very sad for you and anyone related to you. Just imagine what Mike was going through fighting for his life down that well. I cannot even imagine the suffering he went through. If I had my license in KS I would come over there and rip a big hole in that County.

My prayers are to G-d for a swift injunction from an honest judge in Johnson County that isn't afraid to do what is right. It may not be the most popular but I guarantee you...you will sleep well at night.

Oh...and one more thing I forgot to mention. How come little Mikey was never questioned about what happened that day? Where he was...what was he told...and did his father ever come by? The most important piece of evidence, missing, right now is whether or not Mike came by the house as the defense team built their whole case around - that Mike never showed up!

Wow, those two are guilty! People on the jury were paid! Wait until little mike grows up and thinks about all of this. He's going to know his mother and step father killed his real dad. They should really have the trial with people from out of town.

RIP to Michael's mother who passed away recently. I just watched this episode. I'm curious to know, why didn't they interview Mikey after the first or second hung trial? What was the evidence in the employers truck? How many abandoned wells are there in the area? Can they put cameras down them to check for evidence? Whatever happened to Brooke and Kameron? Why didn't the parents try to exercide their grandparents rights or try to get custody b/c his parents are murderers?
Follow-up episodes would be good.

I hope 48 hours continually airs this show until the killers are brought to justice. You say the wound has been reopened. Well, sir, I don't think it ever healed. God forbid, if I were to ever kill someone I would want you as my attorney, your pretty good. It's too bad the prosecution couldn't request that this trial be taken out of Stanton county like you defense attorneys can, because I can almost bet those two would be in the cross bar motel by now. Money talks.

Yes, follow up shows would be great!!!! Keep airing the show until justice can be served!! Dan (defense) can gloat all he wants....but he is also the one who gets to live with his conscious of defending a murderer for money!! The evidence is more than obvious, and it didn't take 48 hour to prove that. It just took taking the evidence outside of Stanton County!!! I wanna know as well what dna was found in Mikes bosses truck? Fingerprints? Hair? Blood? They are guilty as hell....and I hope in this case the media actually helps break this case once and for all!!
