A Ukiah man has filed a lawsuit for alleged civil rights violations he says he sustained during his second arrest in a two-year-long series of marijuana events in Ukiah.
The attorneys of Memo Parker filed a complaint Oct. 15 with U.S. District Court Clerk Richard W. Wieking, San Francisco, that names seven defendants.
Robert Nishiyama, Peter Hoyle, Thomas Allman, the Mendocino County Sheriff's Office, the county of Mendocino and 100 "Does" are the defendants, as stated in the complaint filed by Parker's attorneys J. David Nick and E.D. Lerman.
The history of events leading up to the filing dates to several years ago.
On Oct. 16, 2006, brothers Memo Parker and Mark Parker were arrested on a search warrant served at two Gardens Avenue locations. At that time, officers seized 190 marijuana plants, 262 smaller "clone" plants and 170 pounds of processed marijuana. It was stated at the time that both Memo and Mark Parker had medical marijuana recommendations.
In August of 2007, a jury voted 11-1 that Mark Parker was not guilty of managing a location for the production of a controlled substance. He was also acquitted of all other charges.
The same jury that let Mark Parker walk then voted 10-2 to convict Memo Parker. Because jury members said that more deliberating would not yield a unanimous decision, a mistrial was declared.
On Sept. 5, Deputy District Attorney James Nerli said that the Mendocino County District Attorney's Office would retry Mark and Memo

Then, in February 2008, authorities returned to the Gardens Avenue locations of Memo Parker and in a raid took 297 marijuana plants and 34 pounds of processed marijuana, police reports stated. Memo Parker was arrested at that time on suspicion of cultivation of marijuana for sale and possession of marijuana for sale.
Following the second arrest, Parker pleaded no contest to conspiracy to commit acts injurious to public health or morality. By pleading as he did, all other charges against him were dropped.
The most recent event involving Parker prior to when the complaint was filed was when he entered Mendocino County Jail in mid-August to begin serving a 180-day sentence.
In a press release last week from one of Parker's attorneys, J. David Nick, Nick stated that the lawsuit focuses on a practice of questioning those arrested "without informed consent under the Miranda rights and illegal interrogations of suspects who are represented by counsel." In the press release, Nick also states that the Sheriff's Office uses the term illegal commercial growers' and the idea that all marijuana sales are illegal' to take away rights from medical marijuana growers.
Nick stated that the second arrest of Parker in February is when Parker was allegedly interrogated unlawfully by the Mendocino Major Crimes Task Force. According to Nick, the Sixth and Fourteenth Amendments of the United States Constitution grant Parker rights which were violated during the second arrest.

Too bad he chose to do such a dangerous mind and motor skill altering drug and attempt to drive. as a law enforcement officer you'd think he knew better. What I want to know is why "paid leave"? Why is he still drawing pay if he was under arrest? Must be nice to break the law and get paid for it by tax payers. What would it be like if this happened for all law breakers? Think aboout it. Why does this individual get paid when other law breakers just go to jail? I'm not advocating criminals should get paid. just the opposite. if your LEO or anyone else and break the law all pay should stop immediately IMO. If he's found innocent then back pay can be instituted.

I truly wonder if Deputy Goss's photo will appear in the Booking Photos?

I heard there was a bias as to who gets their photo in Mendocino's Favorite Website...

The rules always seem to be different for those who work in law enforcement. This act was of his own doing and if he is found guilty, I as a tax payer, think he should have to pay the money back at the very least. I wonder how many drunks he has locked up in the back seat of his car with no concern about them losing their jobs? Why should it be any different for him?

You drink, you drive, you should pay the price. we're lucky he was the only person in the accident. This guy has probably cuffed many people for the same thing. This is also karma for him. He's one of those badge abusers. Hopefully what goes around comes around.

everyone knows he's a drunk! IT was only a matter of time before he got in an accident. Let's just hope,(I won't hold my breath) that he doesn't drink on the job.

Well well well we shall really see how corrupt Allman and his puppets are. We will not see Goss's pic in the booking site and he will keep his job because Allman will say he really is a good guy!!! What a freakin joke this county's Law enforcement is. Why has the state not gotten involved? There is a sheriff in Southern Calif that is on trial for corruption it is only a matter of time before this Dept is discovered for its corruption. Let hang on for this ride and see what happens and what privilege this Dept gives to those it likes!!!

He will not appear in the booking log. When you are cited and
released, your picture does not appear. It happens quite often,
you'll see someone reported for DUI in the paper but you will
not see them in the booking log.

Seriously, the pay thing. I always thought you worked, you got payed. No work, no pay. The double standard for johnny law is ridiculous.

I know for a fact a majority of the police in this town drink and drive and feel like there are absolutly no consequences. I've seen it myself. Put a check point outside Vic's place, guaranteed to get a DUI from a cop within the first night!

As in you think law enforcement is in some way precluded from having a problem with drugs or alcohol.......what are you naive? As for this particular situation, their union has negotiated paid leave....if he is convicted? then he gets to pay it back and will most probably lose his job. Again, you are innocent until "proven" guilty and this blog is not a jury. As far as lots of law enforcement over abusing alcohol..........they do!

Although I agree with you, the reason is , your innocent until proven guilty. Also the deputies have a union and labor agreements come into play. It happens also in the business world, where someone might be implicated in a wrong doing an until charges are proven they can't discipline or terminate.

Again, to state: it is Standard Operating Procedure for paid leave. This guy is a good guy. Does he have a drinking problem? I'd say. but, like drug abuse, alcoholism is an illness. Ask the ADA. Look it up! if he worked in a factory, he would not lose his job. Let me readdress that. he might get fired, but any attorney worth his salt would get his job back citing illness. he will be punished for this, I garauntee.

It is really to bad that individual's don't think twice about how their actions can affect their family. This officer has a son who gets to deal with the criticism about his father's mistake and will be affected by it probably more than his father. It is about time he got caught, it was only a matter of time. Thank god no one else was injured or killed. People are right, the officer will probably remain in the sheriff department, just sit back and watch. I also wonder why he was released to someone and did not get to spend the night behind bars?
