Pa. teen sues school district over nude phone photos

There are 36 comments on the York Dispatch story from May 20, 2010, titled Pa. teen sues school district over nude phone photos. In it, York Dispatch reports that:

A Pennsylvania school district that was at the center of a highly publicized "sexting" case was sued Thursday by a teenager who claims her principal confiscated her cell phone, found nude images she had taken of herself and turned it over to prosecutors.

Her pictures of herself on her phone. Legally, it's not child porn (until the principal looked at them ironically...).
So if we assume that she never sent them out and did not intend for them to be viewed by anyone, then she's done nothing wrong (nor shameful, IMO. she's just naked. Naked happens, even at 17. No reason for shame).
The principal, if not malicious, is not very thoughtful in his actions. What outcome did he expect? He made the "child-porn" happen, as a voyeur, no less.

She's got a valid case and a great point.

Why do kids need cell phones at school during the day. If a parent needs to get the child call the school office. I am sure the rules say no cell phones in school. In that fact they had the right to confiscate it. By the way the phone did not belong to the 17 year old, but to the parents, so therefore it was criminal on the parents part. They had a minor naked on their phone. Put that in your pipe and smoke it.

Well if that is what you think, you are stupider then I thought. It isnt illegal for a parent to see or have pictures of their naked child. If thats the case then EVERY parent is going to jail im sure you got a nude picture of your child floating around some where in their baby books.(if you have childern)

My one son has a mental handicap and the other is, for lack of a better word, "normal". They are about as perfect as I could ask for, though.

BTW- I never said I was Perfect. I will state, however, that I have never used an illegal drug, and until I went to college- I never drank alcohol. I recognized at that age, with parental support, that if I wanted to make something of my life- then I had to work hard in school and participate in a number of different activities. As a result, I have a great job, a great family, and pretty satisfied with my life.

She admits in the article that only her "boyfriend" would see them. This would constitute publishing of the pictures.

Something similar happened to me in 1998, Cell phones were not popular with teenagers at that point. There were negatives of me that my boyfriend at the time had taken. Everyone looked at them, the school nurse, my photography teacher, Principal, VP, and the cops that were called in. I was going to be charged with public display of pornography and corruption of a minor. The DA's office dropped charges, because of the bad press the High School would get. Did I feel violated? Yes at that age I was mostly pissed off, but also felt violated and embarrassed. I feel that the situation should have been treated a little differently, but now being 30 I realize the MAGNITUDE and seriousness of what I did. This is no joke… Yes she needs to understand what this means and where she “could” have to go through if she continues to do stupid things like this. A lesson learned for her… She needs to take responsibility for her actions and deal with the punishment form the schools and learn from this. I don’t feel she needs to sue the school and I don’t think that the case will hold.

1. it says perhaps her boyfriend. 2. the principal broke privacy laws, he may be able to confiscate it but that doesnt give him the right to go through its contents without reasonable doubt. it seems he did it in hopes of finding something. this garbage has gotten way out of control and is just becoming laughable.

What privacy laws? There aren't any expectations of privacy while on a public school campus.

Example- The school admin can requrie you to open your vehicle while parked on campus.

yea because guns and weapons can be hidden and you must have suspicions to back up the claim. a cell phone on the hand is a totally different animal.

Having your 17 year old daughters naked picture on your phone is an issue. I think if you would have that on your cell phone you not only would be in jail, but getting a mental evaluation. Think before you speak. I might be "stupider" however, I am not practicing incest. Think before you speak.

actually im sure at the time the phone was in the parents name due to that fact that a minor cannot enter into a legal contract of any kind. so the fact that its a parents phone technically doesnt mean they actually used said phone that had the pics on in it.

The principle should have been charged with child porn, he illeagly viewed it, the DA is different he was doing it legaly as messed up as that sounds. I do think americans are sue happy nowadays but i hope this girl wins, school officials need to realize just how much power they have when it comes to students. Taking a phone is one thing, going through it is another.
