Just seems odd to me that the city would sell to an LLC a piece of property in a downtown, historic district for less than what it would cost to buy a dune buggy. But then again this is TorC.

Huh...I typed a response but it is not showing up...so my apologies if it does finally show and I respond twice.

Never too late for an illegal act to be stopped or reversed.

Here's something simple. Find out the tax assessed value on the property. I(just go to tax assessor office and ask.). it is anywhere near $20,000, jump for joy and get a copy (it'll cost you a quarter). It will be an easy reversion. Let me know what you find.

The name Coppler was familiar. Then it dawned on me FRANK COPPLER is/was the Sunland Park city attorney who is/was the city Attorney during Aguilera and was slammed by the state.

Appears based upon some research today, Gerald A. Coppler and John I. Appel, who have appeared as the attorneys, were in practice with Frank Coppler until VERY recently.

It's all a process, Phalanx. I started with IPRA because the public record which determines whether public servants are "honestly, competently and faithfully performing their duties." When I started making IPRA requests, I also requested to inspect all other IPRA requests. There had only been FOUR ever made. IPRA is an invaluable tool to become an informed electorate and to uncover corruption. I am soooooooo glad my efforts have made this tool known and utilized in our community. T or C still hasn't learned their lesson, even with a loss at the Court of Appeals. But, they problems are so deep, I am not surprised that a large "slap" will be required (i.e., go for the $$$ next time rather than the "philosophical").

I take it you're wondering if my efforts will extend beyond our small little town. As I said, it is all a process. I'm learning which state governmental agencies are corrupt through the process of going to the state governmental agencies for assistance in dealing with the "abuse of local government."

FYI...all politics are local. Everyone in Santa Fe is from a small town.(There is no large city in NM...not even Albuquerque.) Think of the small town as the foundation. If the foundation is rotten, nothing you build on top of it will be good.

(Nice try on the "living in Abq. as you do." I live in T or C, although I am not home as often as I would like.)

But to answer your question on the politics of Abq., I am not involved. But, I do know that Abq. has received an award as one of the top 100 cities for "transparency in government." But, God help you if you have occasion to deal with the APD.

As for whether these issues are simply "small town"...no. We have lost sight of our basic founding principles, including:

(1) gov't exists for one reason only, to protect and provide for the general welfare, health, safety and property of the people. If their action does not accomplish this, it is an illegal action. I've noted that NM state agencies believe they exist to protect and hide the misdeeds of local government.

(2) our judiciary (the court) was first established for one reason, "to fight the abuse of local government." It was not created for crime or arguing over contracts. FYI...corruption of the magnitude in our community and in our state REQUIRES the collusion of the judiciary.

(3) all power vests from the people. We are not powerless.

We are a nation ruled by law, not by men.

Well when you get done slapping all these governments around, see if you can do something about the attitude. For the most part, its great. In comparison, our city offices are very friendly, all except for that tall wench in the city water office. Gawd what a sourpuss! Come to think of it, the gals at the front of Sierra Electric are none too friendly either. Wonder if its just the work, like DMV workers, always pissy. Hmmmm...

Pay your next utility bill in person and DEDUCT the trash collection fee charged after June 30, 2012, through October, and then deduct from next month's utility bill the November charge for trash collection.(Yep, 5 months for residential service is approximately $111, much more for commercial ratepayers.)

Local Ord 11-10 had the rates expiring on June 30, 2012, and the City neglected to amend the ordinance for a valid rate after June 30, 2012, until this week (which isn't effective for a month). No valid rate...no valid charge.

A local resident brought this to the attention of the City a couple months ago, offering to pay while requesting the City rectify the situation. Their response was to lie about it and threaten her. She didn't back down, and deducted the past four months from her last utility bill. And plans to deduct the next month from next month, too.

So can you!!!

That'll wipe the smirk off of "sourpuss," don't you think.

If Deb2me is now advocating not paying your monthly utility bill's trash collection fees from July 1 - October 31, she ought to follow the whole story to include the "unnamed" resident's after effects of doing so. The internal utility billing system will start adding late fees, and potentially could result in a disconnection notice for nonpayment of the bills.

Of course, Deb2me will cry foul. But, don't make easy conclusions that because it would be illegal do so based on findings the local ordinance lapsed, it's an easy "non-pay".

How can the example "unnamed resident" not pay without having a hassle, but instead likely need to prove through court procedure, e.g. the Toomey approach?

For Deb2me to say the resident "didn't back down" after being threatened implies she'll have a battle on her hands with the City to prove her point. Why would the resident want to create this kind of stress for $111.- just to prove another point for Deborah Toomey's crusade?

If Deb2me is so confident this approach is viable, she should print a public Letter To The Editor and encourage ALL T or C utility bill payers to take action. Why advocate just on a hardly read Topix forum?

Sounds like another renegade agenda to ensure the City of T or C will stay embroiled with Deborah Toomey's jabs.

Or, better yet. Since Toomey loves to boast about being a T or C resident and property owner, wouldn't you think she pays a T or C monthly utility bill? Why didn't she use herself as an example about not paying trash collection fees?

We know - because she doesn't have City utilities and it isn't because she's "gone green". It's because the housing on her properties is boarded up and unlivable. She doesn't live on her properties, but only "visits" T or C.

I don't need to name the "local resident" on an internet website. That "local resident" did, however, attend Monday's City Commission meeting and spoke--for the first time--at public comment on this exact issue. This was the same meeting wherein the City had on the agenda an amendment to 11-10 so they can legally charge a rate (and Comm. Green suggested filling Torres' vacant seat by pulling a name out of a hat).

I'm NOT the only person in town who as the ability to think and act nor am I the only person who has the gumption to stand up to the City, even after they've been threatened and lied to.(It was the threat and lie that made the local resident put her foot down and refuse to pay.)

I've never publicly mentioned more than 10% of the "dirt" I know from my research over the years; I just simply don't have time for all of it. Thinking about filing suit on that so we don't have to pay more than $500,000 to close it since it was never authorized by the community. Here's another one: City did not legally enact Impact Fees. So, if you've ever paid an impact fee (more than $500,000 has been paid to date), go get your money back.

You question why a resident of TorC would put up with the stress of fighting the City? I've answered that before: honor, integrity and courage. It can also be said right is right. Wrong is wrong. Their illegal governance hurts us all. You may prefer to live your life as a coward or lazy--and refuse to act because it might cause you stress or take some effort--but thank goodness not everyone is you. That includes 64 other plaintiffs on a current lawsuit.

The utilities where I live are NOT in my name, not uncommon. But you can try and be the lord who decides where I do and do not live, but you will fail. Just as you fail at everything else you try.

Regardless, what business is this of yours, April? You don't live nor own property in our community, and haven't for years. You don't even live in the state of New Mexico.

I agree she did a good job...and she deserves some props. But, simply getting up to speak doesn't make her a "public persona" whose name should be spread all over the internet, especially in this forum with nut jobs like April or sore losers like Jay...or RudeDude who occasionally likes to make slightly inappropriate comments.

We all go through different phases of life and as we go along we pick and choose our fights. At this point in time in my life I will probably never run a marathon or be a doctor, and make no excuses for not training or going to school. Likewise, I am no longer willing to fight political fights. I do, however, enjoy watching. Not unlike sports. We don't have to be on the field to enjoy the game. Now Deb, in my mind you don't "live" here. Which is ok, really. I care not. But I will say that I have come to enjoy watching you work to hold our local government accountable. Trash fees might seem a small issue. But the idea behind it, the lack of following the rules, and the keystone cops aspect of our commissioners...I hafta say that I have begun to look at things differently. So while I will not be joining you at commission meetings and will probably not get to experience the thrill of exasperating the hell outta that sourpuss in the utility office but not paying trash fees, I wwill be in the stands cheering you and all who join you in RIGHTEOUS activism. Thats a lot different that Brad browbeating some older defenseless woman, mind you. Its also different than others who have sought to stop all building and expansion. This is our government being totally ignorant and arrogant at the same time. So educate 'em. Of course, I don't live in T or C either but its fun to watch the show now.

I am thrilled that you have "begun to look at things differently." My "fight" is and always has been about nothing more nor nothing less than illegal governance, while they act ignorantly and arrogantly.

This illegal governance (i.e., corruption) has hurt our community in the past (there's never been a "golden age" of prosperity as our community has only experienced the poverty of corruption), hurts us in the present (pick from the many such as solid waste collection on top of our drinking water wells in the literal front/backyards of our neighbors while violating our RIGHTS), and will hurt us in the future (pick from the many such as RCPUD across the river where City has committed to providing utilities that they absolutely cannot provide). And, there's no statute of limitations for these illegal acts of governance. In other words, its gonna "bite us" in the future.

Yes, I could simply "move on" as so many have demanded I do, and I would thrive "back in the real world." But I call T or C home because I cannot get what T or C has anywhere else in the entire world...the exact mineral content of our hot mineral water.

Although, I do encourage you to attend the City Commission meetings. Not so that you'll "stand up," but because there really is no better entertainment.

(OK...I admit that at first you'll get angry...real angry. But the anger does dissipate...to disgust. Which is entertaining in a sick sort of way...welcome to humanity.)
