The bid awarded to the City for the location of the Spaceport Welcome Center has been cancelled by the NMSA.

General Counsel for the EDD reviewed the protests and found the City knowingly offered land for sale contrary to a US land patent governing this land. Appears the City gave only partial documentation in an attempt to hide the land patent, and offered to quit claim rather than warranty deed in order to avoid detection of the fraud.

That land may only be utilized for recreational purposes or a municipal golf course. Any other use or attempt to sell the land immediately reverts ownership of the land back to the US government. The attempt to sell the land to the NMSA imposes the reversion according to NMSA.

Now here is another thought to ponder...those 6 acres are only a part of that land grant. It appears this large tract of land that the City has been parceling out over the years--the college, recycling center, new waste center collection sight, including some failed economic development projects like the salsa factory and shutter factory--are all on land which falls under this patent. The city no longer owns the land as they have violated the land patent to use it for recreational purposes or a golf course.

And committed fraud in the process. Any bets that our do nothing district attorney Wellborn will do nothing?

Deb, if this is all true, then wouldn't it mean that the land being considered for the waste transfer station is no longer under deed to the City of Truth or Consequences?

That would mean the City of Truth or Consequences could not move forward on their plan to endanger the health and well being of Williamsburg residents by building a waste transfer station on that particluar piece of property... because it's technically no longer in their possession, correct?

Sure sounds like poetic justice to me. LOL.

I believe all of the other bidders filed protests.

I'd assume that the City Attorney advised the City.

I hope everybody is doing jumping jacks now that another blow to the local economy has been landed.

What's randy going to do with his empire once the town dries up?

Without something significant built at the south end of town, you can pretty much count on t or c blowing away after the southern access road to the sp is built.

Wow. Wish I could say I am surprised. The general counsel for the EDD reviews the bid by the City of Truth or Consequences and finds the City committed fraud, and your only comment is its a blow to the local economy.

WTF??? How do you expect to have a vibrant local economy if our local government is committing fraud? Or is the fraud simply OK if you feel there is some good advantages to it?

Where is your moral code????

Maybe you accidentally dumped it in the Truth or Consequences dumpsters.

You got it right! WTF is wrong with this community? It appears that no matter how often the evidence shows our City governs outside of the law, I continue to hear people defending the City and disbelieving the evidence. Of course, this number dwindles by the day.

After several conversations over two days with a local shopkeeper downtown, I heard about how she personally benefits from the good ole boy and gal network. The County paved her circular driveway as a surprise and repave it every couple of years over the last 20. She explained some other benefits she's rec'd, and that it was all good. Her only complaint was a stop sign had been down for 2 years.

Now if I was the type of person who verbally accosts people on the street as Mr. Lester once claimed, I would have responded, "The stop sign hasn't been replaced, because they are too busy helping you steal from the public coffers." And started yelling, THIEF! THIEF!

Instead, I politely made my excuses and left. I also left behind the respect and admiration I held for this business woman who had managed to survive these many years downtown. Now I know how. By stealing from the public.

And that, rude dude, is WTF is wrong this community. I was expected to admire her ability to steal from the public, and to even be jealous that I had not achieved this benefit. Others admire and are envious of her ability to "get things done" and hope to emulate her. And her ability is to steal from the public coffers and feel good about it.

I wonder if friday's paper gloss over 70% of the determination letter that explains how the City committed fraud? Even the other comment left in this forum ignores the fraud and land patent, and attacks the protesters, one of whom is Ashbaugh.

And anyone who stands up, it is made a sport to attack until they leave in disgust. Just didn't work with me.

I'm so sorry I even made a comment since it appears you are the keeper of all that is good here.

Pardon me if I ass-umed this land was free to sell since the city was negotiating to put a factory there and leased it to another company to store equipment on. Funny, nobody cried foul previously..are you really a puppet for somebody else?

Excuse me if I don't bow down to you queen deb for all the wonderful things you have done for sierra county and you personally turning this forum into something I go to for amusement.

I don't need to research it. As the state determined, Jay Rubin's legal argument (which wasn't really a legal argument) has no basis in law. The patent remains in force, and the 25 year timer doesn't begin to expire until 25 years after the paperwork is filed with the Feds, and that paperwork remains unfiled.

While there might have been steps taken to get around the patent legally, the City has been disqualified because they did not follow the RFP rules. Pure and simple.(which reiterates the statement I've been making for years: when the city does not follow then law/rules, we the people get hurt. We just got hurt by the city's inability to follow clear rules on the RFP.

I believe the City is stupid enough to appeal this lawsuit without any legal stasis. For all those who screamed my IPRA lawsuits were frivolous (like the one that made case law), the actual definition of frivolous lawsuit is a suit without a basis in law. My suits all had a solid basis in law; the City's defense was frivolous in that they had no basis in law. Court of Appeal even said so, when they lambasted Rubin for being incoherent, without leal argument or analysis.

So, yes, I believe the City is stupid enough to appeal this decision without any basis in law, and that only one person will be enriched by such a decision: Jay Rubin.

I expect a continuation of city defending themselves without any legal basis.

Mite the Feds modify or remove the problem restrictions ?
Do they, or we, really care this far down the road ?

Is it more important/satisfying to continue to "lambaste" the
city even tho "we the people get hurt" ?..

1. It is completely irrelevant what federal authorities may or may not do, in regards to the restrictions on the original land patent. The RFP response was deemed null and void by the State of New Mexico, and there can be no new submissions on the part of the City of Truth or Consequences. HOWEVER, there could actually be a taxpayer-financed appeal filed with the court.

2. Any appeal authored by City Attorney Jaime F. Rubin, and City Manager Juan Fuentes, whom were the two parties responsible for the original failure to properly submit an RFP response, would be EXTREMELY ill-advised... and co$tly.

3. The actions signed off on by City Attorney Rubin and City Manager Fuentes, have resulted in hundreds of thousands of dollars of lost revenue$ and INCREASED legal co$ts during the past year.

Examples:$85,000 of lost revenues on original pool cover contract.
$69,000 settlement for October 4, 2011 unlawful arrest.
$152,000 of lost revenues for NMSA Welcome Center site.

*This list does not include the co$t billed to the City of Truth or Consequences by Mr. Rubin for his "professional legal services."

IMO- until the City of Truth or Consequences stops spending hundreds of thousands of taxpayer dollars on issues of fiscal mismanagement, legal incompetence, malfeasance, nepotism, and cronyism... then there will continue to be a need to "lambaste" those city officials responsible for such waste, fraud, and abuse.
