Too bad that Truth or Consequences has been plagued by Grag Neal, "Bing" Kearney, and their attendant suckers and dupes over the past four plus years. Perhaps if Elephant Butte, New Mexico( median age 63) decides in its infinitely aged wisdom that Hot Springs Land Development is a winning proposition, the decidedly undeveloped desert region directly west of this municipality of 1,500 residents may not suffer even further. Who knows? LMAO!!!

Unfortunately, deannexation is not a possibility in New Mexico as the authority to deannex land has not been granted to local governing bodies by the NM Legislature.(And specific authority IS required.)
This has been a known issue since at least 1990 when a legal treatise was written on the subject. Even the federal government has recognized that three states (including New Mexico) have failed to provide for deannexation.

C'mon, when has statutory law ever stopped public officials and/or employees of the City of Truth or Consequences from doing whatever they want?

With a do-nothing Attorney General like Gary King in office, the list of T or C's legal violations just continues to stack up... as do the billing statements for one Jaime F. Rubin, Esq. LOL.

Notice of public hearing is a constitutional requirement in property issues, including annexation, zoning, and master planning.

Posting notice of public hearing on the property is required by ordinance in our City Code, backed by statute and verified by the City Planning and Zoning every time P&Z Chair Billy Howell isn't around to threaten to arrest the women who raise the issue in testimony at public hearings. The matter of posting notice is non-discretionary.

In other words, if the property isn't posted with notice then the public hearing never happened. Ex-City Manager Jaime Aguilera did not require that the property be posted for the annexation, zoning and masterplanning public hearings. So for everyone who did not attend the public hearings, the public hearings did not occur.

Since only a few hundred people attended the public hearings, the other approx. 12,000 in Sierra County at the time were NOT given their constitutional right to notice of a public hearing. After all, how can any one person decide whether 12 square miles of development will cause harm to one's air, water, light, traffic, fire, property values, morals, and/or quality of life, when one doesn't know, exactly, where it is?

Now, this logic stuff is really hard for DurableBrad, because it appears to be Magic to him, so you can expect him to fuss about this:

Since the city is a construct of the constitution, it cannot make a decision that is contrary to the constitution. So, the annexation public hearing, which never had appropriate public notice, never happened. Annexation, zoning and the master plan never happened, all for the same reason: Jaime Aguilera was a dishonest public offical who deprived us of honest public officials.

Therefore, HSLD cannot be de-annexed because they were never annexed in the first place.

KIM, I thought you originally lost that case, and then were rejected on appeal? In fact, I believe that there were some sort of punitive sanctions ordered by the court that you've thuse far failed to pay.

It must be nice to live in an imaginary world where you can never be wrong, and generally accepted legal terminology is open to dispute whenver it suit your needs.

Wow, 2 guys too cowardly to play whiffle ball, but willing to degrade themselves humping each other's leg on a public forum.

From what I've seen so far, eg: IPRA, the 7th Judicial District soap opera ain't over 'til the blind lady puts down the trays, gains some weight and sings.

Just because nobody's gotten busted for the Municipal Court Building and King Peak/SVH land deal(YET), does not mean that a federal racketeering charge is not out of the realm of possibility.(hint-hint)

10 years ago Bobby Allen was being harassed by a gang of runaways/drug mules. He saw their destructive power. Now he uses the local kids as weapons of mass destruction. Their hangout is funded by the local, state and federal government. And Bobby Allen calls them cave people. That is how much he hates the local children.

An appeal must have relevant findings to be final. Certain issues were not addressed by Judge Kase in the Zoning-not-Annexation-Appeal of Ordinance 588: All of them.

Therefore his decisions are still not final.

Of particular interest at this point in time is the issue that was never addressed stating that Jaime Aguilera deprived the citizens of their right to honest public officials (Issue #26). Aguilera's now world-famous Extortion video, composed on City computers during business hours, is an example of that.

Aguilera destroyed the record of the public hearings on the annexation of the HSLD land, but he leaves an extortion video on a City computer. It was a 'cry for help'.
