Bridgeport to get "classy" strip club

BRIDGEPORT -- A truce has been reached in the city's strip club wars but business owners aren't exactly waving the white flag -- or, in this case, G-String -- of surrender.
In fact, it could be argued Joseph Regensburger and his associates got what they'd wanted all along -- permission to open a new club, Rapture, at 500 North Ave. that he hopes will put Bridgeport on the bump-and-grind map.
"This isn't just going to be a run of the mill strip joint -- this is a high end restaurant (and) gentleman's club," said Regensberger, likening the business to Rachel's, a well-known steakhouse in south Florida.
But Mayor Bill Finch's administration hardly gave away the store.
In return, one trouble magnet -- Club Allure on East Main Street, site of a 2011 drive-by shooting -- will be permanently closed, and property restrictions will keep that address and three others from being used for exotic dancing or other adult entertainment.
Also, the city will not be forced to pay Regensburger's substantial legal fees.
The settlement, finalized this week, wraps up a four-year battle over opening more strip joints in Bridgeport.
The city in 2010 denied Regensburger a zoning permit for 500 North Ave., so he appealed in federal court.
In the meantime the Finch administration sought to better regulate adult entertainment through tougher zoning laws and city ordinances aimed at keeping sexually oriented businesses out of residential neighborhoods.
But before those were adopted Regensburger and his business partners submitted zoning applications to open strip clubs at four additional locations: Allure at 2060 East Main St.; Jack Dempsey's bar at 520 Success Ave.; a building at 2012 Boston Ave.; and an old gas station at 1043 Stratford Ave.
All were denied, so the property owners filed multiple zoning appeals, swamping the city with litigation.
By early 2012 it was clear that the federal court battle over 500 North Ave. was not going Bridgeport's way and the city's former adult use regulations could be struck down as unconstitutional.
"The law is, whether you like it or not, dance is speech," said Ed Schmidt, the city attorney assigned zoning issues.
The judge sent the case to mediation.
"We knew the federal district court was going to set the tone," Schmidt said. "As a result we met on several occasions and talked."
In February the parties submitted the so-called one-for-four settlement to the court for approval.
Regensburger now has zoning approval to move ahead with 500 North Avenue. He must apply for building permits.
In exchange Regensburger and partners Gus Curcio, Julia Kish and Richard Urban withdrew their zoning appeals over the four other strip club applications and also signed property restrictions legally preventing those locations from housing adult entertainment in the future.
In fact, noted Schmidt, Allure - which Regensburger also owned - will be replaced with a new building with first floor retail and eight apartments.
"So we're trying to get rid of this bad adult entertainment place and upgrade it to a better building," Schmidt said.
All of the paperwork related to the appeals and restrictions was finalized this week.
Regensburger all along has made it clear his goal was to open 500 North Ave.
In 2011 he proposed a zoning swap to Finch - Regensburger would transfer his adult entertainment rights for Allure to 500 North Avenue, and place a deed restriction on the latter to prevent future strip clubs from opening there.
"We are trying to do a one-on-one trade," Regensburger said at the time. He even erected a sign outside of Allure -- unpopular with many residential neighbors -- that read, "We want to relocate. The mayor doesn't want us to."
