You know, it would almost be funny if one did not care about this community. Every other week there is a story about our county on the local news media that makes us look, well, STUPID!

Now it is up to "$50" Judge Dan Dildine to take his turn in the spotlight. It was not enough that he offered people $50 to get out of Jury Duty. Oh no! Now he over-turns the UNANIMOUS jury conviction of a drug addict and it ends up on the evening news!

Just when you think things could not look worse for this county BOOM! Another shoe drops and the stupidity continues. When will the people of this area WAKE UP!

You have NO CLUE how the image of a community effects its welfare. Perception is reality, for the vast majority of the public. Lincoln County's image is holding it back and stories like this only reinforce a negative stereotype of our community!

What was his reasoning for over turning the conviction? Did cops plant drugs or lie in court? There is more to this story.

I'm wondering, too. We are not getting the whole story, but I am not willing to guess. It would not be cops planting drugs or lie, because those are grounds to keep the evidence out of court, not to overturn a jury verdict. The jury wouldn't have gotten that far. This might be a point of error committed during the trial itself.

I would have to say it was the decision of our most infamous judge. He has a history of making poor decisions. As the previous poster indicated, his $50 dollar deals set other convicted felons free, why would this be any different. There does not appear to be any errors on the part of the trial or else it would have been a mistrial and the attorney general would not be appealing his decision. I have friends in the court system. I will see if they have any insight. Unbelievable!!

Why is the Missouri Attorney General appealing the decision by the trial judge? Unless there is a legal error on the part of the Presiding Judge of the 45th Circuit, there should be no further action.

Once again Lincoln County sends out a smell that only pig farmers could love..........

If a "legal error" was commited during the trial, that is when it should have been recognized and a mistrial declared.

Does or does not "Double Jeopardy" come into play here? The ENTIRE trial was completed

A motion for a new trial, filed after a jury returns a verdict, addresses errors committed during the trial and gives the judge the opportunity to reverse his own trial rulings before getting the courts of appeals involved. An outright reversal (rather than an order for a new trial) says that the case was not sufficient to submit to a jury. Frequently it is a point of law that gets researched and then presented post-trial, and, if it shows the evidence was insufficient under the law, or other such grounds, the judge can decide that "double jeopardy" prevents giving the P.A. a second bite of the apple, and deny a retrial.

An appeal of a judge's entry of a judgment of acquittal is allowed without having double jeopardy ramifications.

What an elected judge does in his official capacity is everybody's business. What the story says is that the judge was persuaded after the trial that there was not sufficient evidence to prove that the defendant knew the heroin was there. There is an appellate decision that threw out the conviction of a guy in jail because his cellmate had access to the mattress the contraband was in. Period. Bad case, bad law, but it is the law in Missouri, and it is often used by defense lawyers to dodge drug possession convictions. It is not just Judge Dildine who accepts that appellate precedent.

Isn't it odd how the cops knew exactly where to look and their victim was shocked to see it? It was all caught on police video. These LC cops have a reputation for lying and planting drugs. This is just more proof of how bad these cops are. The victim may be a criminal of other sorts, but this particular arrest was obviously based on a plant by the cops.

What would you have the people do? I mean really...hopefully, you initially vote for a judge based on their past rulings. The person wouldn't be a judge, typically, if they were of "bad character."
So you vote.
Then, once seated, they make some bum rulings.

Next election...you vote for someone else.

Why are you laying this at the feet of the citizenry and what exactly would you have us do? And, why aren't you doing it?
